SEC TION 11. OF TH E ENGLEWOOD •I UN ICIPAL CO DE 2000. PERTAINING TO TH E EXTENS ION OF THE LIMIT ED WAIV ER OF THE WASTE TRANSFER SUR CHARGE . WHEREAS, the Ci ty Coun cil of the City of Englewood, Co lora do pas sed Ordi nance No . 25 , Series 1987, instituting th e Waste Transfer Surcharge wh ich imposed a twent y cent surcharge on each cubic ya rd or port ion the reof by eac h perso n disposing of trash at a was te transfer fac ilit y; and WHEREAS, th e Eng lewoo d Cit y Co un cil pa ssed Ordinance No . 30 , Serie s of 1993, which granted a limit ed waiver of the Wa ster Transfe r Surcharge until Decemb er 31, 1995; and WHEREAS , the Englewood Ci ty Cou ncil passed Ordinance No. 22, Series of 199 5, which authori zed a limited waiver of th e Wa ste Tran sfer Surcharge until December 3 1. 1998; and WHEREAS , the Englewood City Co un ci l pass ed Ordinance No . 31 , Seri es of 1999, whi ch granted a limited waiver of the Wa ster Transfer Surc harge until Dece mber 31 , 200 1; and WHEREAS , the Englewood Ci ty Council passed Ordi nanc e No. 14. Series 2002 ext ended the wa iver until Decem ber 3 1. 2004 ; and WHEREA S, the Englewood Cit y Co uncil pa ss ed Ordinance No. 29 . Series 2005 ex tended the waiver of the surcharge unti l December 3 I, 2007; and WHEREAS, th e r sage of th is proposed Ord in ance wi ll extend the waiver of the su rcharge until December 3 1. 2009; NOW, THEREFORE , BE IT ORD AIN ED BY n m CIT Y COU NCIL OF THE GITY OF ENGLE WOOD . Th e Cit y Co uncil here by find s, detenni nes, and dec lares that thi s Ord inance is pro mul gated und er th e genera l poli ce power of th e Cit) of Engle wood, th at it is promul gated for the hea lth , safety, an d wel fa re rf th e public , and that thi s Ordin ance is necessa ry fo r th e prese rvati on of hea lth and s1fe ty and fo r th e protec ti on of public co nvenience and wel fa re. Th e City Co un cil further determin es that the Ordin ance bears a rati onal relati on to th e pro per leg islati ve object so ught to be obt aia ed. Sec ti on 3. Sevcrabili ty. If an y clause , sent ence , paragra ph , or part of thi s Ordinance or the applicati on thereo f to an y pe rson or circumstanc es shall for an y reaso n Le adjudged by a court of co mpetent jurisd ictio n inva lid. such judgment shall not affect, imp air or in va lidate the remainder oflhis Ordinance or it appli ca ti on to other persons or circumstances. Secti on 4. Inconsi stent Ordinances. All oth er Ordin ances or poni ons thereof inco nsistent or conflicting with thi s Ordinance or any poni on hereo f are hereby repea led to th e ex tent of such inconsistency or confli ct. Sec ti on 5. Effec t of repeal or mod ifi ca ti on. TI,e repea l or modifica ti on of any pro vision of th e Cod e of th e Cit y of En glewood by th is Ordinance shall not release, ext in1:,'l.li sh, alter. modi fy, or change in whole or in pan any penalt y, fo rfeitu re , or liab ilit y, eith er civ il or criminal, which shall have bee n in curred 1, \'ti er such prov ision, and eacl , provisio n shall be treated and held as still remaining in fo rce for the purposes of ,;ustaining any and all proper acti ons, suit s, proceedings, and prosec uti ons for th e en fo rcement of the penalt y, fo rfeiture, or liability, as we ll as fo r the purpose of sustainin g any judb,m ent , dec ree , or ord er which ca n or may be rend ered, ent ered, or made in such acti ons, sui ts , proc eedings, or prosec uti ons. BACKGROUND, ANALYSIS, AND ALTE RNATIVES IDENTIFIED The Ci ty of En glewood initiall y passed Ordinance 75 Serie of 1987 o n April 20, 1987 insti tuting th e W as te Trans fe r Surcharg e. Th e Surcharge imposes a n,. enty-ce nt surcharge on ea ch c u b ic ya rd or portion th ereof by each person disposing of tras h at a was te tr ansfer faci lity. Th e defini t io n of "person " in th e ordin ance includ es politica l subdivisions of th e State of Colorado. The Ci ty of Eng lewood has re~eived reques ts to con tinu e th e waiver of the surc harge fo r publi c p urposes. Englewood, Li :tl eton, and Sher idan have reques ted waivers for th eir annual "cl ea n-up " p rog rams . Th e waiver sun se ts on D ecembe r 3 1, 2007 so th e waiver must be ex tended at thi s tim e for th e 2008 and 2009 an nual cleanups .
