AN ORD INANCE AMENDING CE RTAIN SECTIONS OF THE ENGLEWOOD
MUN ICIP AL CODE 2000 PERTAINING TO THE LEGAL PUBLICATION PROCESS .
WHEREAS , the Englewood Home Rule Chaner docs not define what is requ ired by
"publicati on;" and
WHEREAS . the Englewood City Council und erstands th at mo re and more citizens are
recehong informa ti on through th e World Wide Web: and
WHEREAS. the provisions of this Ordinance provide fo r the greatest di sseminati on of
information regarding maners of public concern to the ci ti zens of Englewood , Co lorado;
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , CO LORADO, AS FOLLOWS:
Section I. The City Co uncil of th e Ci ty of Englewood, Co lorado hereby authorizes
amending Title I, Chapter 8, Section 3 -"Publication Requirements'', and Title I, Cha pter
JO, Section 2, Subsection 6 -<;Public Noti ce" of the Englewood Municipal Code 2000 to
read as follows :

1-8-3 : Publication Requirements .
Whenever publication shall be required by the Chaner , the Co lorado Statutes , or
ordinances in connec tion wi th municipal elections or procedure rel ative thereto, such
publication sha ll be made by oublishing on the Citv·s official website or bv oub lication
in th e new spaper designated by the ~Counci l fer the ~ublieetieR efether legal 11etieos

1-10 : NOTICE AND HEARING PROCEDURE S
1-10-2 -6 : Public Notice .
If required. public notice of the date , time and place of the public hearing shall be given
in the manner provided by the Cha n er, Statute or ordina nce pursuant to which said
hearin g is to be held . In th e absence of any specific provision de '.·neating the manner in
which pub li c notice is to be given, no t,ce of th e date, time. place and purpose of th e
hearing to be he ld shall be mad e bx nublishinR on th£ Citv 's officia l website or published
once in that newspaper designated by City Counci l as the City's official newspaper, not
less than ten ( I 0) days prior to th e date of sa id hearing. In the event the public hearing is
postponed , notice sha ll be given of the date, time and place to which the hearing has

4-2-8 : Time of Application ; Later Deferment.
At the tim e of publication of th e notice of an ordinance to estab lish a specia l district for
im provement. published th erewi th shall be notificatio n th at eli gi ble pro pe rt y owners may
have thei r asses sment deferred by comp lyi ng with the provisions of this Cha pt er and by
ap pl yi ng for the de fem 1en1 not later than six ty (60) days after the final publication of the
ordi nance. Co ncurrently. the Ci ty shall cause to be published pp the Citv·s official
~ at least twice in a newspaper efgenerel oi,e•letien i!ltin tee Cit)~

of the availability of assessment deferments fo r eligible property owners alo ng with

In the event an eligible property own•,r desires to defe r an assessment transferred to the
Co unt y Treas urer fo r co ll ec tion. th e prope rt y ow ner may make applica tion fo r sai d
deferral : upo n meeting th e eligibi lit y cri teria of th is Chap ter, th e assess ment shall be
deferred . The Cit y shall req uire the applicant to co mplete nil ot her nece ssm,• procedure s
fo r deferral. Upon a det ermination of th e prop ert y owner's eligibi lity, th e assess ment
shall be deferred and removed from the roles of the Count y Clerk and Reco rder.

Mr. Knoth sta ted th e Commission has imposed fa irl y ti gh t restrictions on the development
and does not feel giving th em a littl e leeway in where th ey can build and where the
foo tprint is , is ou t o f the qu estion .
Ms. Krieger agreed with Mr. Kno th . In genera l, in a PUD you have a buildin g en velope and
yo u can build only in a certain area and have guide lin es yo u must fo ll ow .
Mr. Fi sh sa id we have an are a th at w e essentially have thrown away all the zoning
require ments for. Ms. Kr ieger disagreed. She said the Commission has oea,ed ne w zoning
require ments for th e PUD. Mr. Fish said he is not propos ing the developer come to pub lic
hearing all the time, the additional wordin g gives the Commis si on a chance to rev iew th e
progress and if the Commission sees a problem to do so met hing abo ut ii. Ms. Krieger sa id
the developer is not going to ha ve any progress until they come before the building
department wi th finished plans and th at is th e wrong tim e to be telling ;omebody that
th ey've go t to go back and spe nd tens of th ousa nd s of doll ars redes igning a building
because we don't like it. Mr. Fish said everyone that comes to the Comm uni ty
Developmen t Department to build something mu;t sub mit a plan . Ms. Krieger said they
submi t a plan that fits w ithin the requirements . We already have the requirements for this
project and they should ha ve the same rights as everyone else . Once we ha ve given the
deve loper the bas ic requ irements for th eir zone the y should have th e righ t to come fo rward
wi th so mething th at fits with in th ose requi re ments that w er e give n to them and ha ve a
re aso nable assu ran ce that it is go ing to be app rove d . Mr. Fi sh agre ed , but all PUD's ha ve to
go through a public process, do n't tl'.ey? M s. Kri eger said this is th e publi c pro cess . Mr. Fish
sa id aren 't we abd icating th at right? Ms. Kr ieger said no, w e are sa ying as long as the

Mr. King sa id it is in th e best interest of the develo per to study th e parking very carefully
since th ere is no outs ide parkin g. If th ey don't have enough parking it \\•ill be a deal killer
for a lot o f things.
Mr. Ro th said when th e Commission originally approved th e developme111 the building
hei gh ts and posi ti ons were set , now they are not. O ne of th e possibilities he hear d
mentioned was tha t we co uld end up with the tower in En elope 3 and no t in En ve lope I ,
which would be the worst case sce nario for the residents . H e would like to see a stip ul ati on
on height in En ve lope 3. He sugg~s ted anding ho tel use back into Enve lope 3. H e
