WHEREAS, the City of Englewood Safety Service Department applied for funding under the VALE Grants Program to be used for funding Lie Victim/Witness Program in the Englewood Municipal Coun; and WHEREAS , the Victim/Witness Program in the Englewood Municipal Coun has served the victims of domestic violence since 1990; and WHEREAS , the City of Englewood has previously applied and been granted VALE Grants for the years 1990 through 2008 ; and WHEREAS, the staff seeks Council approval of an Ordinance accepting a 2008 VALE grant funding in the amount of $15,876, for the period of July I, 2008 to June 30, 2009; . NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: ~-The City Council of the City of Englewood, Colorado hereby authorizes the acceptance of the VALE Grant and accompanying intergovernmental agreement, a copy of which is marked as "Exhibit A" and attached hereto . The City Manager, the Chief of Police and the Director of Finance/ Administrative Services are hereby authorized to sign said VALE Grant and accompanying intergovernmental agreement on behalf of the City of Englewood . These co ntacts were to an swer qu estio ns and to discuss clien t's ner.ds. Ms. Wenig also counsels family memb ers who come lo court wi th th e vict im s. Asian Pac ifi c Organi zation has sent brochures on dome sti c vi olen ce and servi ces avai lab le for us to give to vict ims who speak Eastern languages. We use the service s of the Translation an d Interpreting Center for tran slations in court, Mandarin and othe r Eastern lan guages . All of th e court infonnation is tran slated into Spa ni sh . We have a Spa ni sh speak in g tran slator fo r co urt hearings whic h are schedu led once a month lcr all th e Spani sh speakin g cli ents. These services are provided by Execu tive Languages. We have ava il ab le a list of agencies from man y ethni c ba ck!,'t'Ound s and are co nstantly updatin g thi s li st. 3. A. What number of peop le is in need of the services as propo sed by thi s project ? (Id en tify source of infom1ation ). • In th e 200 6 gra nt period , th ere were 137 new vi ctims served in th e Municipal Court as documented by cou rt records . There was an averag e of 12 arraignm ent s per month in 2006 . The Victim/Witness Advoca te attempts to ccr.:act all those whose li ves are impacted by domes ti c violence, identified by eith er offense reports or in cident report s . At pre se nt th ere are approxi mately 235 cases active in Muni cipal ourt and approx imatel y 242 victim s bein g se rv ed from 2006 and previous years . Each month abu ut IO cases are finali zed so thi s numb er of ac ti ve cases is co nstantl y changing . C. What perc ent of th e vict im s yo u se rv e are m-o ,,olin gual Spanish speakers? There are appro xi m:'. ;1y 2% mono lin gual Spa ni sh s:,eak in g victim s. One afl ern oo n per mont h is design ated as a Spanis h-speakin g doc ket. All of the Spa ni sh-speak in g dome sti c vio lence cases are se t on th h docket. The Victim /Witn ess Advocate has access lo th e interpret er and is abl e to int erview victims nt thi s tim e. D. How wi ll yo ur proj ec t diminish or e liminat e any dupli ca ti on of serv ices? Thi s proj ect has been designed to refer victim s to serv ices that will respond to their speci fi c need s . Through appropriate referral , eac h victim will be match ed with referral reso urces that will meet her or his needs. E. How will you coo rdinate servict s with si mil ar or lik e program ~7 There are no similar services avai labl e through municipal court. 4. Define the man age ment plan for th e program/project. The Vic ti m Witness Advocate, Nancy Wenig, sub mits a daily record of co urt ac ti vi ty to Ms . McDonnell which in clud es victim nam e, referrals mad e, victim comp ensat ion infonn at ion , restitution requests, etc . Ms . McDonnell and th e Cit y Acco untant, Kathy Cassa i, are res ponsibl e for th e ex penditure of th e gran t fund s under th e sup ervisio n of th e Chi ef of Poli ce, Thomas Vandem1ee, and the Director of Finan ce Frank Gr;glewicz. Ms. McDonnell will be retiring at tl,e end of March . Once a new pe rso n is hired , th eir res um e will be forwarded to th e VALE board. 5. Process Evaluation: The program has met its goa ls and objectives by pro,idin g victims with ongoin g support during and after his/her court appearance. We maint ain cont ac t wi th vic tim s to help them throu gh "trouble spots" such as holidays, difficult treatment issues and changes in living conditions. Outcome Evaluation : Our goal is to provid e safety and support for victims of domestic violence as well as to educate the victim of the co urt proces s and serv;ces available . Unfortunatel y, victims are often resistant to change and do not always take advantage of the help offered to th em. In 2006, 44 % of the 140 victims contacted at arraignment took applications for Victim Compe nsation . We constantly encourage victims to participate in co unselin g. We hope our efforts to enco urage counseling for victim s will eventuall y help th em make 'healthier choices in the futu. ·. Overall agency success: Our relationship witl1 th e Cit y Atto rn ey and Judge is excellent. The process with which victi ms move through the court pro cess is efficient and comforti ng. Surv ey reports and follow up ph vne ca ll s reflect a po siti ve experience in th e Co urt . Victims are encouraged to kee p in contact with Ms . Wenig to work th ro ugh th e inevitable rough spo ts in their recovery. SECTION D: CONSTITUTIONAL AMENDMENT 1. A. Define how thi s program/project will address th e guid elines for ass urin g th e rights of victim s and witr.csses as outlined in th e Vi ctim Right s Act (Section 24-4 .1 -302 .S C.R.S.). Ther e are toys in th e o ffi ce and shon video s on dome sti c violence to watch . We cannot provide transportation to court. 2. Does your agency have a statutory mand ate to notify victim s und er th e Victim Right s Amendment (V RA)? _X __ Yes No How do you presently notify victims of th eir rights under the VRA? A folder i~ provid ed to each victim at arraignment which contains No Co ntact Orders, literature on Domestic Violence , a Victim's Rights brochure , Victim Compensation application and the Victim/Witness Advoca1e 's card . Ms . Wenig explains these Victim's Right s to her/him at the arraignment and continues to keep the victim informed of changes in the status of the case , sc hedules and results of hearings , availability of property return and other information pertinent to the vi ctim 's cas e while the cas e is active in court . Ms. Wenig makes thes e contacts in person , by phone and by letter. What is the approximate m1mb er of clients who receive notification s made by yo ur agency each year? (N = # of clients) There were approximately 273 victims contacted during the 2006 gran t peri od. These victims had cases in various stages of resolution , each ne eding information on the status of the case as we ll as other information pertinent to th e victim's need s, e.g. property return , Victim Co mp ensation infonnation, etc . The se paration of Englewood Safety Serv ices into Eng lewood Po lice and Eng lewood Fire will not change the goa ls and objecti ves of thi s progra m, nor th e app li cat ion of th e program in the Municipal Co u11.
