WHEREAS , the City of Englewood currentl y has an agreement with DRCOG to inspect elevators and escalators for the City unt il December 31, 2008 ; and WHEREAS , the Ci ty antic ipates renewing the agreement with DRCOG to continu e the required inspection s; and WHEREAS, the passage of thi s Ordinance will permit the City of Englewood to identify the responsibilities of each pan y for ensuring the safety of convoyances within the State through compliance with ·.he Act and all promulgated rules and regulations; fonnalize the cooperative working i"d:t tic;,shi ps between the Parties; and provirle procedures for l.Ommunications, exchange of infm,uation and re.;olutio n of problems as neces sary to carry ou t the provisions of the Act and all promulgated rules and regul ati ons; NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO, AS FOLLOWS : Section I Cv!orado State Amended Statutes regarding Elevato r and Esca lat or Certificatio ns C.R.S. 9-5 .5-i0I et seq., which requires cities to contract with the State that the Ci ty inspect such conveyances or all ow the State to inspect and ceni fy them . SEC TIO N I. REC ITALS 1.1 Back gro und Th e El eva tor and Esc alator Ce rtificati on Act (the Act), Tit le 9, Arti c1e .'.5, Sec ti ons I 01 through 120, Co lorad o Rev ised Statutes (C.R .S.), declares tha t in ord er to ensur e minimum sa fety stand ard s througho ut Col orad o, th e regu lat ion of conveyan ces is a man er of statewide con cern. Th e Act stat es tha t: • All co nveyance s in Colorado sha ll be registered with th e OPS ; • All con veyan ce cont ractors, me chani cs and in spectors sh all be li cen sed wi th OPS ; • All co nveyance s shall be inst alled, altered , repaired, se rvi ced , and maintained acc ording to Col orado adopted nati onal safety standards ; and • A qu alifi ed loca l auth ori ty having jurisdiction (AHJ) may el ect to en ter into an MOA wi th OPS to re gulate conveyan ces that are loc ated within th eir jurisdicti on terri tory . Following OPS ' ap proval of th e AHJ's conve yance standard s and executio n of thi s MOA , th e AHJ will be considered an Approved AHJ . 1.2 Purpo se Thi s MOA is bein g ent ered into by th e ab ove-menti oned partie s for th e foll owin g purposes : a) To identify th e re sponsibiliti es of each party for en suring the safety of conveyan ces withi n the State of Colorad o through co mpli ance with the Ac t and all promulga ted rule s and re gulation s; b) To form ali ze th e coo perative working re latio nship s between the Parti es ; and , c) To prov id e procedur es for co mmunication s, ex change of information and res oluti ~n of problem s as nece ss ary to carry out the pro visions of the Act and all promul gat ed rul es and regu lati ons. 1.3 Authori ty Th e prin cipl e au th ori ty for thi s agreem ent is co nt ain ed in Tl,e Eleva tor and Esca lator Certificati on Act §9 -5 .5-11 2 (2), C.R.S. "Cenifi cate of Op era ti on" mean s a document iss ued by th e OPS or an Approved AHJ for a conveyance indi cati ng th at the conveyance has bee n in spec ted by a tni rd-party lice nsed co nveyance in spec tor and co mp lie s wit h rul es of th e OPS or Approved AHJ (§9-5.5-1 14, C.R.S.). '·Co nveyance" shall have the meanin g as delinea ted in §9-5.5 -1 04 , C.R.S. "Territory" mea ns a city, cou nty, or city and co un ty for whi ch th e regul ati on and/o r in spec ti on of ro nveya nces is con trac ted to a company or organiz ati on . "Varian ce req ues t" means the sub mitt al of doc um entati on to th e Ad mini strat or or App roved AHJ by a co nveyance ow ner or co ntra ctor th at ju stifi es the use of alt ern ate method s or mat eri als for the impl ement atio n of sta nd ards ado pt ed pursuant to §9-5.5-11 2 (\), C.R.S. SECTION 3. RESPONSIBILITIES Th e res ponsibi liti es of th e OPS an d Approved AHJ are presented below : 3.1 OPS a) Th e OPS is des ignated th e impl ementin g age ncy as delin ea ted in §8 -20-1 01 C.R.S. As such, the o~s has th e authori ty and res ponsibili ty to adopt nati onall y recogni zed conveyance safety stand ards pursuan t to §9 -5.5-112, C.R.S. an d as they arc ame nd ed (§9 - 5.5 -103, C.R.S.). b) The OPS shall reco gn ize that the Ap prove d AHJ is so lely res ponsi bl e fc ,he reg ul ati on of co nveya nces within Ap prove d AHJ's territory so long as, pu rs uant to §9-5 .5-11 2 (2), C.R .S., th e App roved AHJ ~as standards th at are equ al to or grea ter th an th ose ado pted by th e OPS. c) The OPS shall recog ni ze that the Ap proved AHJ is so lely res pon sible fo r iss uan ce and enforce ment of Ce rti fi cates of Opera ti on fo r th e installat io n, alterati on, opera tion, an d maintenance of co nveya nces within the rerritory of th e Ap proved AHJ , per §9-5 .5-11 4, C.R.S. d) Pursuan t to §9-5.5-11 2 (2)(b), C.R.S., the OPS sha ll , in coopera tio n with th e Approve d AHJ , es tab li sh a sc hedule fo r the Ap proved AHJ to ado pt stand ards li sted in §9-5.5-11 2 (l ),C.R.S. Based on re sult s of thi s rev iew, th e OPS and the Ad visory Board wi ll de1 em1ine wheth er th e OPS and Appro ved AHJ s will ado pt th e addend um or suppl ement pri or to th e adoptio n of th e next ve rsio n of th e standard . f) The OPS has th e au th ority and res ponsibili ty to ensur e that nil new ly in stall ed and ex istin g co nveyances are reg istere d with th e OPS . Th is process will in cl ud e th e co ll ec ti on of a one-ti me registration fee from th e conveya nce ow ner pursuant 10 §9 -5 .5- 111 (2 }(a), C.R.S. g) Pursuant 10 §9-5.5-106 through 108, C.R .S., the OPS has th e au thority and res ponsibility 10 ensure tha t all co nve ya nce contrac tors, mec hani cs, and in specto rs are li ce nsed through th e OPS . Th e li cen sin g process requ ir es th at th e li censee rem it pay ment to th e OPS of nn ann ual li cense fee pursuant 10 §9 -5 .5-108 (5), C.R.S. a) Approved AHJ The Approve d AHJ shall be sole ly re sponsibl e for th e regulation of conv eya nce s within th e terri tory of th e App rove d AHJ if th e Appro ve d AHJ ha s stand ard s th at arc equal to or greater than those adopted pursuant to §9 -5.5-1 12 (2), C.R.S. b) Th e Approved AHJ shall, in cooperation with the OPS , establi sh a schedul e for the Approved AHJ to adopt stand ard s li sted in §9-5.5-112 (I), C.R.S. This sch edul e will includ e th e requirem ent that th e Approve d AHJ adopt th e fo ll ow in g standa rds by December 31, 20 10 : 1) ASME Al 7.l -2007 2) ASME Al 7.3 -2005 3) ASME Al8 .I -2005 c) Follow ing th e initial adoption of standards desc rib ed in 3.2(b), th e Approved AHi ag1<.es 10 rem ain current in adopt ion of future standard ve rsi ons within 90 days from th e dtt t, at which th e OPS adopts the standard . d) Pur suant to §9-5 .5-112 (3)(a), C.R.S., co nvey nn ces in stall ed pri or to July I, 200 8 are exem pt from comp li ance with ASME Al 7.3 , although the Approv ed AHJ , in coop eration wit h th e OPS, may require th e impl ementation of all or any port ion of AS ME AJ 7.3 neces sary to mitigat e a material risk to publi c safety . e) Th e Approv ed AH! shall be resp onsib le for issuance and enforce ment of a Certiii ca te of Op eration fo r in stallation , alterati on, uperation, and mai nt enance of conveya nces 1vit hia th e territory of th e Ap proved AHJ, er §9-5.5-114 , C.R.S. f) Th e Approv ed AHJ shall b, ,es pon ,,ble to review and determin e th e va lidity of atl variance requests to the adop ted standard s in 3.7.(b). g) Th e OPS will co nsider li ce nsing a perso n to in spect co nv eyaoces if th e per son was em plo yed or contracted by th e Appro ved AH J to in spec t co nveyances pri or to Jsnu my I, 200 ~. The App roved AHi shall immediately refer all such government a,11 government- de signn ted inspectors 10 th e OPS fo r li ce nsing . h) An inspec tor who qualifi es acc ording to (g) of thi s Sec ti on sha ll not remain li ce nsed by OPS after Jul y 1, 2010 if th e in spector hos not rec eived ccrti fi co ti on through a nati onall y recognized conveya nce assoc iat io n (§9 -5.5-107 (2)(a), C.R.S.). i) The OPS will co nsider li ce nsing o person 10 inspect co nveyances to enable the perso n ,o obtain the minimum one year of exp erien ce required for ce rtifi ca ti on te sting by o nati ona lly recog:i ized co nveyan ce assoc iation . The testing for national certifi caiion m\.S l occ ur at th e earli est opportu nity followin g li ce nsure wi th the OPS . Annu al information submitted lo OPS shall be relay ed no later th an January 3 1" following th e previous twelve -month reporting peri od. Thi s informa ti on shall in clu de th e follow,ng : I) Name, addre ss, co nta ct, nnd ph one number of owner or mas ,ge mcnl company res pon si ble for conveyance 2) Name and ad dress of facility where co nveyance is loca ter 3) Number of conveyances al th e fac ility 4) Con veya nce type(s) (i.e . elevator, esca lator, etc .) 5) AHJ-a ss igned co nveya nce ID number , co nveyance seria l number , or other identifier 6) Dat e of las t annual in specti on 7) Dat e of las t iss ued Certificate of Operation I) Th e Approved AHJ shall be responsible for immediately nodfying OPS of any and all accide nt s resultin g in injury to an indi vidual th at have been reported to th e Approved AHJ . m) In the event that the Appro ved AHJ identifies conveyance s not registerc<l through OPS and any contractors or in spectors working in the Approv ed AHJ territory that arc not li cens ed wit h OPS, th e Approved AHJ shall immedi ately inro!l!l the OPS of these entities . n) The Approved AHJ shall be responsible for th e impl eme ntati on of enforcement acti ons necessary to en sure conveyance comp lian ce with the A.cl. except as exempted in this MOA . o) Pursuant to §9 -5 .5-111 (2 )(a), C.R .S., the Approved AHJ may set fees and collect or contract the co llection of the se fees to offset th e cos t of plan review or inspection of conve) ances loca ted within the Approved AHJ territory. Fee amounts will be determined by th e Approved AHJ or co ntractually ,greed upon by th e Approved AHJ and th e inspection company or organizati on . Co nveyance owne rs shall be notifi ed of any adjustment of fees a minimum of thirty (30) days pri or to th e effec tive date of the change. SECTION 4. ACCESS TO INFORMATION Eac h party sha ll , to the ext en t all owed by law, make availabl e to each oth er, al no cost, information regarding conveyances within it s possess ion . Reqnests for info rmat ion shall not impose an unreaso nable reso uoce burden on the oth c, party . SECTION 5. EFFECTIVE DATE AND TERM Thi s MOA shall be effective on Au gust I, 2008, an d extend through Jul y 31 , 2009 (o ne year). Unless previou sly termi nated by one of th e partie s pursuant to th e term s of thi s MOA, thi s MOA shall automatica ll y renew for four (4) success ive terms of one (I) year each begi nn ing on Augus t l, 2009. ADDITIO NA L PRO VJS IO NS 7.1 Le ga l Auth ori ty Th e partie s warrant that each possesses ac tual, lega l authorit y to enter into this MOA . Th e parti es further wa rrant that each has take n all actions required by it s app licable law, procedure s, ru les, or by-laws to ex ercise that authority, and to lawfu ll y authorize its undersignec' signatory to exec ut e th is MOA and bi nd that party to its term s. Th e person or pe rsons si gning thi s MOA , or any att ac hm ents or amendments hereto , also wa rrant(s) tha t suc h pe rson(s) possesses actu al, legal author it y to execute this MOA , and any attachments or amend ments here to, on behalf of th at party . 7.2 Notic e of Pending Litigation Un less ot herw ise pro vid ed fo r in thi s MOA, th e Approved AHJ ' ,all notify th e OPS with in five (5) wo rking days after bei ng serv ed with a su mm ons, co mplain t, or othe r pl eadin g in a case whi ch invol ves any services provided und er thi s MOA and whi ch has been filed in any fede ra l or state co urt or aclminis trative age ncy.
