WHEREAS , thi s change is requested becau se there are empl oyees wh o earned n vested benefit in the NonEmergcncy Empl oyee Retirement Plan (NERP) and ei1her opted into the money purcha se plan in 1987 or wc,e prom oted and changed plans and under the current language in th e Eng lewood Municip al Code arc not all owed to receive their benefit if th ey continue working for the City beyond Normal Retirement Age; and WHEREAS, changes to the NonEm<"gcncy Empl oyee Retirement Plan (Nl,;RP) will allow deferred vested pa rti cipant s to collect their pension benefit s even if they continue working for the City . This Ordin ance shall be effecti ve for those emplo yees wh o meet the qualificatio ns on January I. 2008 and after . Sec ti on 3. Safety Clau ses. The City C~un ci l hereby find s, de1em1 ines, and decl ares th at thi s Ordi nance is promulgated under the genera l police power of the City of Englewood , that it is promulgated fo r the health, safety , and welfare of the publi c, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare . The City Council further determines that the Ordinance bears a rational relation to the prop er legi slative object sought to be obtained . Section 4. Severability. If any clause, sentence, paragraph , or part of this Ordinance or the app licat ion thereof to any person or circumstances shall for any reaso n be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect , impair or invalidate the remainder of this Ordinance or its app lication to other person s or circumstan ces . Section 5. Inconsistent Ordinances . All other Ordinances or portions thereof inconsistent or conflicting with this Ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict . Section 6. Effect of repeal or modification . The repeal or modification of any provi sion of the Code of the Ci ty of Englewood by this Ordinance shall not release , extinguish, alter , modify, or change in whole or in part any penalty, forfeiture , or liability, either civil or criminal, which sha ll have been incurred under such provision, and each provision shall be treated and he ld as st ill remaining in force for the purposes of sustaining any and all proper acti ons , suits , proceedings , and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well as for the purpo se of susta ining any judgment , decree, or order which ca n or may be rendered, entered , or made in suc h act ions, suits, proceedings, or prosecutions. Section 7. Penalty . The P.na ll y Provi sio n of Section 1-4-1 EMC shall app ly to eac h and every vio lati on of thi r Jrdinancc. Th is chan ge is requ es ted b ecau se th ere are employees who ea rn ed a ves ted benefit in th e NERP and either opted into the mo ney purcha se plan in 1987 o r were pro mo ted and change d plans and under the current lan guage in the Code are no t all owed to receive their benefit if th ey contin ue work ing for th e City.
