Box 900 2, Li ttleton, Colorado 80160 -9002. WHEREAS , the City desires to assist the students in the ACC/ ACTS program to gain experienr:o for their Comprehens ive Building Trades ACTS cl asses; and WHEREAS, ACC/ACTS desires to provid e practical on-the-job experience to Student Laborers regularly enrolled in its Comprehensive Building Trades classes; NOW, THEREFORE, in consideration of the mutual promis es made herein the parties agre e as follows : ARTICLE l -DlITIES A. ACC/ACTS : I. ACCI ACTS shall provide student laborers to perform cou..'1ructi01l jobs rel cted to the construction of a dwelling located at 2397 West Harvard Avenue (the "Proje..-t'1, according to the plans and specifications to be provided by the City. ACC/ACTS shall provide work crews in separate classes . 2. ACC/Acrs shall instruct the Student Laborers in the construction trades' skills , which they will need in order to perioIID their tasks in the construction of the dwelling . ACCIACTS makes no representations that the Student Labor= will be skilled in the tasks they are asked to perfonn by the City. (See att nched Task List outlining responsibilities of the City and ACC/ACTS . 3. ACC/ACTS shall make available al the construction site for use by the Student Laborers in construction of the dwelling, hand and power tools , except those mentioned in Article J.IJ. 3, as ACC/ACTS shall deem adequate in quality and quantity. To the extent that other equipment is needed fo r the Project and is available without co st to ACCIM::rs, ACC/A CTS shall provide the equipment. All othet equipment shall be the respons ibility of the City .. 4. Transportation will be the respons ibi lity of the student laborers and/or school districts where npplicable and provid ed. B. TFIECITY: I. The City shall man age and sup erv ise the constructio n ProjecL The City shall obtain all permits, licens es, inspections and cenificatcs, blueprints nnd utilities (temporary service). 2. The City shall pay the costs of aU materials used on the Project, for all su bcontractors other than ACC/ACTS and aU other cos ts associated with th e Project, ex cept th os e which nrc to be paid by ACCIACTS as set forth in thi s Agreement. • X ~ e I T A 3. ARTICLE ID TERMINATION • • • • • • A. Either party may tenni.natc this Agreement at aoy time upon 30 day~ written notice malled or delivered to the address set forth above . The parties agree th.a! prior to tennination of thls Agreement by this provision; the parties shall me:t or attcmp: to meet tor .:solve any dispute. Either party may, for any reason whatsoever, terminate this Agreement after any such meeting or attempted meeting pttm!Altl to this provision. Neither party shall be liable to the other for aoy actual or perceived lock of good faith in attempting to resolve any di8putc in accordance with this provision. B. In the event of termination, the parties shall have no further obligation whatever wider this Agreement and the Student Laborm may keep any tool belts and tools, which have been, supplied them. C. Tiiis Agreement may also be terminated if ao acceptable site is not provided by the City by a date mutually acceptable to the parti es. ARTICLE IY -BOUAL OPPORTUNITY ACCJA<:rS shall adhere to all federal, stale and local statutes, ordinances and regulations including. but not limited to, equal opportunities and civil rights laws . ARTICLE. V -WA'Y)lR No waiver of auy provision of this Agreement shall be construed to be a waiver of any aubscqucnt breach of the some or any other provision of this Agrecmcat. ARTICLE YI -INTEGRATION Any and all prior agreements between the parties hereto with rcspc:ct to the subj cot matter of this Agr=ncot arc hereby canceled and tenninatcd. BACKGROUND, ANALYS IS, AND ALTERNATIVES IDENTIFIED In April 2008, th e Gove rn or's Energy Office (G EO) laun ch ed th e In sulate Colo rado program by awa rd ing $41 6,000 in fundin g to 43 p rogram spo nso rs. D ue to : crease d interes t fr o m additional loca l governm ents, GEO has issu •.e d Round II Matching Grant Applica ti on to all Colorado citi es, co unties, and utiliti es wis hin g to join the ex ist in g prog ram as a pa rti ci patin g 2008 sp o nso r. GEO works cl ose ly with Colo rad o partn ers to support th e pro11er in stall ati on of in sul ati on and air- sea lin g meas ures in Co lorado homes. Th e prog ram aim s to in crease co nsum er awar eness of resid ential energy effi ciency options an d ac ti ve ly prom ote th e install ati on of addition al w hole-h ouse energy sa vin g m ea sur es. M atchin g G rant Appli ca ti on req ues ts may b e made for any fu n ding am ount up to a maxi mum of $25,000 . To p articipate in th e program, a hom eowner mu st wo rk w ith an eli gible insulati on co ntractor and res id e w ithin a p articipa tin g partn er's o ffi cia l jurisdiction. Re bates are l o be distribut ed on a first-rece ive d, firs t-paid proces s, with th e pro gra m clos in g when fund s ar e no long er availab le. Reba 1es are limi ted to one per add ress. Home owners choosing to self-ins tall or m e a "non-eli gibl e" ins ulati on co nt rac t r will not qualify lo receive th e re bat e fr om • th e city partn er. The GEO sta tes tha t Xce l Energy will be o ffering a simi lar insulati o n reba te program propose d 10 star t in Janua ry 2009 ior th e Xce l serv ice ar ea. Xce l's progra m will not o.li y cove r the insula tion rebate prog ram, bu t will als o lnclud e reba tes for purr h.i ses of Energy Star applian ces , 1,vi nd ows, elc. Th e GEO Is reques tin g th at co mmu nities in th e Xce l servic e area appl y for sma ll er gran t monies. A $5,000 m,1 1ch was su gges ted 10 ac t as a "bridge" program until Xcel's program is up and runnin g. A n appli ca tion stal in g th e amount 0f th e match doll ars is all that is needed to sec ure th e grant. The GEO would pre fer tc have th e prog ram dva il ab le to all resi d ents in th e communi ty . The GEO did no t recomm end federal 111onies as a match th at would I es tric t th e eli gible participa nts. Once th e appli ca tion :s received by th e Gl:O, , Purchase Order will be automa ti cally approved th at w ill be used for rei mbursem en ts of th e insulati on reba tes iss ued to ho meowners. Th e GEO's grant program ca n overl ap with the start o f th e Xce l program un til all monies are ex pended. Once the Xce l progra m is full y o peratio nal, th e GEO will focus its c urr ent program mo nies o n areas that are outsi de of Xcel 's service area. Based on th e GEO's recommendati o n o f a to tal $10,000 rebat e program, averaging $200 per ho me, th e program could ass ist 50 fami li es in the City of Engl ewood. FINANCIAL IMPACT " $5,000 m atc h is req uired to receive a $5,000 gra nt from th e GEO .
