'i2._ SERIES OF 2008 BY AUT HORITY COUNC IL BILL NO . 5 1 IN rRODUCED BY COUNC IL MEMBER MOORE AN ORDINANCE EXTENDING A TEMPORARY SUSPENSION OR MORATORIUM ON THE ESTABLISHMENT OF NEW ''ROOMING OR BOARDING HOUSE " USES . WHEREAS , it ha s been brought to Council's auenti on that the current Uniform Development Code doe) 0 0 1 adeq uatel y define or limit ''Rooming or Boarding House" uses; and WHEREAS, the stated purpos e of resi dential di stri cts in Ti tle 16, the prior Code was to "prohibit all activities of a general commercial nature except certai n reg istered home occupations which are contro ll ed by specific limitations"; and WHEREAS , with the implementation of the Uniform Development Code, the definition nf "Roomi ng or Boarding House" was omi tted and the term was inadvertently added to the definition of large and sma: · group homes . This ha s crea ted a conflict with the stated purr ·se of residential district s; and WHEREAS, City Council has directed staff 10 review and revise. if necessary, the provisions regarding "rooming or boarding hou ses"; and WHEREAS . staff will need suffi cient time to review and coordinate the provisions relating to "rooming or boarding houses" in the Code: and WHEREAS , Ci ty Counci l deems it necessary 10 coord ina te th e re view of th e Uniform Development Code and finds it appropriate to prohibit the estab li shment of new "rooming or boardi ng hou ses " in the City until the re view by the staff and Ci ty Co uncil ; and WHEREAS , in order for the City to comply with equal protection issues, the morat ori um or temporary suspension mu st apply to all zone district s unless specifi c exemptions can be legi timate ly set forth due 10 a findin g that a particular zone district sho uld be excluded ; and WHEREAS, the revis ions to the Uniform Development Code and the upd ati ng of the uses allowed in all zone district s will help pro tect the pub lic health , sa fety and welfare by preserv in g a sa fe , healthy. and so und en vironm ent within the City ; and WHEREAS, the citizen s of Englewood and the Cit y Co un ci l ha ve determined th at further revi sions to the Unifonn Development l.xle are necessary to promote , coordi nat e, and implement a high quality plan to produ ce we ll bala nced zonin g in the City; and WHEREAS , the current listing of uses is not meeting the above criteria ; and 9 bi WHEREAS. the Eng lewood Cit y Co uncil established a mora torium or temporary suspen sion • of th e estab li shment of all new ··roo min g or boardin g house·· uses necessary to implement 1h e re visions to th e Uni fon n Deve lopment Code by the pas sa ge of Ordina nce No . 23 , Series of 200 8: and \VHEREAS. th e Englewood Ciry Counci l desires an ex tension of the mora torium through December I, 200 8 to provide addi ti onal time 10 complete the ndop tion process for amendments to Ti tl e 16 of th e Eng lewood Municipa l Code including an updated definit ion and use-specific standa rd s fo r boardi ng or room in g houses use. NOW , THEREFORE, BE IT ORDAINED BY THE CIT Y COUNCIL OF TH E CITY OF ENGLEWOOD , COLO RADO . Said moratorium or ternporaI)' suspens ion shall be fo r all new "roo ming or boa rdi ng house'' uses wi thin the Ci ty of Englewood. Section 3. The Ci ty Co un cil finds th e pro visions of thi s Ordinance are temporary in nature and are intended to be repl aced by subs equent legis lati ve enactment so th at the mora tori um or temporary suspension as spec ified in thi s Ordinance sha ll tenninate on December I. 2008 .
