Section 3 Severability . If any clause, senten ce, paragraph, or part of this Ordin ance or the
application thereof to any person or circumstances shall for any reason be adjudged by a co un of
competent ju risdicti on inva lid , such judgmen t sha ll not affec t, impair or invalidate the remai nder
of th is Ordinance or its application to other persons or circwnstan ces .
Section 4. Inconsistent Ordinan ces. All oth er Ordinances or portions thereof incon sistent or
con fli cting with this Ordin ance or any portion hereof are hereby repealed to th e ex.tent of such
incon sistency or con flict .
Section 5. Effect of repeal or modifi ca tion . The repeal or modifi cati on of any provision of
the Code of th e City of Englewood by this Ordinance shall not release, extinguish, alter, modi fy,
or change in whole or in pan any penalty, forfeiture, or liabilit y, either civi l or criminal, which
shall have been incurred under such provision , and each provisi on shall be treated and held as
still re maining in force for the purposes of sustaining any and all proper actions, suits,
proceedings , and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well
as for the purpo se of sustaining any judgment , decree , or order which can or may be rendered ,
entered, or made in such actions , suits , proceedings , or prosecutions .
Section 6. Penalty. The Pen alty Provision of Section 1-4-1 EMC shall apply to each and
every vi olati on of this Ord inance.

COUNCIL GOAL AN D PREVIOUS COUNCIL ACTION
The Ci ty Council discussed this issue al th e St udy Session o n October 13, 2008 and dire.:ted staff to
prepare a bill for an ordinance making the proposed changes.
RECOMMENDED ACTION
Staff recommends City Council adop! a bill for an o rd inance de leting the curren t la nguage in 4416
and adding new language to th e Englewood Municipal C ode .
BACKGROUND , ANALYSIS , AND ALTERNATIVES IDENTIFIED
Currently, th e language i n 4416 reads as fo ll ows and w ill be deleted:
A ll notices required to be given to th e retai ler o r vendo r under the pr ovisions of th is
Chapter shall be in w riting and, if mai led, postpaid by certified o r regis tered mail, return
receipt req ues ted, to him at his last known add ress, shall be sufficient fo r the purpose of this
Chapter.
The language proposed for 4-4-16 reads:
A ny no tice required to be given to any taxpayer or the agen t or personal representative of
the es tate of any taxp aye r sh11l be sufficient if mail ed, postpaid by first-c lass mai l l o th e last-
known address of the tax payer o r th e agent or personal represen tative of th e estate of th e
tax payer. The first-class mailing of any notice under th e pro isions of Title 4 Munici pal
Fi nances and Taxa tion Chap ter 4 Sa les and Use Tax crea tes a presumption that suc h noti ce
was received by th e tax payer o r agent o r pers o nal represen tative of th e es tate of th e
taxpayer if the City maintains a record of th e no tice and mai ntains a certifica tion that th e
no ti ce was deposited in th e United States mail by an employee of th e City . Evidence of the
record of the notice mailed to th e las t-k nown address of th e taxpayer o r agen t or personal
representative of th e es tate of the tax payer as shown by th e records of the City and a
certifica tion of maili ng by first-cluss mail by a City employee is p rima facie proof that th e
notice was received by the taxpayer or agent or personal represen tati ve of the es tate of th e
taxpayer.
