HomeMy WebLinkAbout2007 Ordinance No. 008• • • ORDINANCE NO . fl SllRIES OF 2007 -- BY AUTHORITY COUNCil, Bll,L NO. 4 INTRODUCED BY COUNCIL MEMBER WOODWARD AN ORDINANCE AUTHORIZING THE PERMANENT REMOVAL OF A BILLBOARD LOCATED AT 2730 SOUTH BROADWAY AND REBUILDING THE BILLBOARD AT 2896 SOUTH BROADWAY . WHEREAS, at the present time there arc two legally permitted billboards located at 2730 and 2896 South Broadway; and WHEREAS. the property owner for each of these properties is interested in removing one of these billc ards to make way for a mixed-use infill redevelopment project located at Broadway and Yale; and WHEREAS, the site is currently encumbered with a long term lease throuf'h CBS Outdoor, a bill boa.-,! nnd advertising agency; and WHERI:AS, the property owner has worked with CBS Outdoor to renega:iate the billboard lease agreement; and WHEREAS, the Englewood Zoning Code does not allow new billboards to be constructed, modified or permitted within the City; and WHEREAS, the City does not have the authority to issue a permit for this project without City Council approval ; and WHEREAS, the Community Development staff has determined that the c•.,rrent Sign Cooe does not adequately address the iss •tr of billboards and this "two for one" policy may be incorporated in any new Sign Code revision : NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCP.. ~w THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS : ~-The City Council of the City of Englewo!'d, Colorado hereby approves !he permanent removal of one billboard at 2730 South Broadway and the rebuilding of the billboard located at 2896 South Broadway, which shall be considered a nonconforming sign subject to all the requirements of rto11~nfonning signs. RECOMMENDED ACTION Staff requests that Council approve the attached Bill for Ordina nce authorizing th e removal of a billboard at 2730 South Broadway and rebui ld ing the billboard at 2896 So uth Broadway. • BACKGRO UND, ANALYSIS, AND ALTERNATIVES IDENTIFIED • There are curre ntl y two legally permitted billboards located at 2730 and 2896 South Broadway. Th e property ow ner for each of these properties, Mr. Jon Cook, is interested in removi ng one of these billb oards to make way for a mixe d-use infi ll redevelop ment project at Broadway and Yale . Th e site is currently encumbered wi th a long term lease through CB S Outdoor, a billboard and advertising agency. As part of th e neg otiati on efforts to move the proposed rede ve lopme nt forward , Mr. Cook and Director Simpson have worke d wit h CBS Outdoor to renegotiate th e billboard lease agreement. Th e proposal wo uld involve permanentl y removing one billb oard at 2730 South Broa dway and reb uildin g the billb oar d at 2896 South Br oa dway. Th e Englewood Zoning Code does not allow new billboards to be constructed , modified or permitted witnin the City . As a resulL staff does not have the authority to issue a permit for this project wi thout approva l from City Council. Community De velopme nt staff has det erm ined that the et :rrent Sign Code does not adequately address the issue of bill board s and th is "two for one " policy may be in corporate d in the new Sign Code revision . With the proposed Co un ci l action, th ere would be a red uced number of billboards on Broadway and ii makes way for a Br oa dway infill red eve lopm ent project. The attached Bill for Ordinance is a Council authorized permit to rebuild an existi ng billboard at 2896 South Broadway an d permanently remo ve a billboard at 2730 South Broadway . FINANCIAL IMPACT There are no increased financial costs associated with this Ordinance . The economic Impacts from the proposed project at Broadway and Yale will be considered when more details of the project are provided by the developer.
