WHEREAS, the City of Englewood has used the National Electrical Code as a model construction code since 1970; and WHEREAS, this Code is updated periodically to keep pace with changing construction techno logy; and WHEREAS , internationally, code officials recognized the need for provisions to administer the National Electrical Code. The International Code Counci l Electric al Code- Administrative Provisions, in this 2006 edition, is designed tG meet these needs; and WHEREAS , the City of Englewood Division of Building and Safe !y staff has thoroughly reviewed the National Electrical Code 2005 and the Int ernational Code Council Electrical Code Administrative Provisions 2006 and recommends adoption thereof subject to cenain exceptions. modifications and amendment ; NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Secti on I. The City Council of the City of Englewood, Colorado hereby authorizes the repeal ofTitl c 8, Chapter 2, Anicle D, of the Englewood Municipal Code 2000, in its entirely . Section 2. The City Council of the City of Englewood , Colorado hereby adopts the National Electrical Code 2005 and the International Code Council Electrical Code 2005 Administrative Provisions 2006 as Title 8, Chapter 2, Article D of the Englewood Municipal Code 2000, to read as follows: CHAPTER2 CONSTRUCTION AND SAFETY CODES ARTICLED ELECTRICAL CODE -1- 9 b ii 8-2D-l : CODE ADOPTED: There is hereby adopted , by reference thereto, the National Electrical Code 2005, Published by NFPA and the International Code Council Electrical Code Administrative Provisions 2006 Edition, published by the International Code Council, Inc., in its entirety, 4051 West Flossmoor Road, Country Club Hills, Illinois 60478-5795 , including errata updates , published as part ofthis Code, subject to the exceptions, modifications and amendments set fonh in Section 8-2D-2 of this Anicle. The Clerk shall maintain a copy of the Code which will be available for inspection during regular business hours . 8-2D-2 : SPECIFIC MODIFICATIONS TO ADOPTED CODE: The foll owing specific changes, modifications and amendments arc hereby mu . ,c in the provisions of the bttemational Code Council Electrical Code Administrative Provisions 2006, hcrcinabovc adopted: A. (Deleted in its entirety. Substitute the f ollowing) Refer to Section I 05.5 of the amended (IBC) Building Code of the City of Englewood for requirements of this section. 2. 403.3 Extensions. (Deleted in its entirety. Sub,titute the following) Refer to Section 105.5 .1 of the amended (IBC) Building Code of the City of Englewood for requirements of this section . 3. 404.2 Schedule of permit fees. (Deleted in its entirety. Substitute the following) Refer to Section 108.2 of the amended (IBC) Building Code of the City of Englewood for requirements of this section . 4. 404.5 Refunds. (Deleted in its entirety. Substitute the following) Refer to Section 108 .6 of the amended (IBC) Building Code of the City of Englewood for requirements of this section. D. Chapter 10 -VIOLATIONS . (Deleted chapter in its entirety) Refer to 8-1-7 EMC for requirements of this section. ~ Safety Clauses The City Council hereby finds, determines , and declares that this Ordinance is promulgated under the general police power of the City of Englewood, that it is promulgated for the health, safety, and welfare of the publi c ind that this Ordinance is necessary for the preservation of health and safety and for :b protection of public convenience and welfare . The City Council further detcm•S .,es that the Ordinance bears a rational relation to the pmper leg;slative object so ught'"' be obtained . Section 4. Severability . If any clause, se ntence , para gra ph, or pan of thi s Or1i c ,·nre or the application thereof to any person or circumstances shall for any rea so n be adjudged by a court of competent jurisdiction invalid , such judgment shall not affect, impair or invalidate the remainder of this Ordinance or it application to other persons or c ircumstances. Section 5. Inconsistent Ordinances. All other Ordin:mces or portions thereof inconsi ste nt or conflicting with this Ordinance or any po1~ion hereof are hereby repealed to the extent of such inconsistency or conflict. s ~c tion 6. The repeal or muditication of any provision of 11, Code of the Ci1y of Englewood by this Ordinance shall not release, extinguish, alt cs·. modify , or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal. which shall ~.ave been incurred under such r-ovision, and each provision shall be treated and held a< still rema ining in force for th. purposes of sustaining any and all proper actions , su its , proceedings, and prosecutions for the enforcement of the penalt y, forfeiture, or liability, as well ar. Any party who has a pending app licati on, where the permit application and final site plan have been submitted to the City bsfore the date of final adoption of this Ordinance, shall make an election to proceed under e;ther the current Code or the 1997 Code but not a combination thereof. Section 8 Penalty. The Penalty Provision of E.M.C . Section 1-4-1 shall apply to each and every violation of this Ordinance. RECOMMENDED ACTION Staff recommends Council approve a Bill for an Ordinance adopting the National Electrical Code 2005 and International Code Council Ele ctrical Code -Administrative Provisions 2006 to establish minimum requirements to safeguard th e public health, safety and general welfare. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The City of Englewood has used the National Electrical Code as a model construction code since 1970 and updates this code periodically to keep pace with changing construction techn ology. Building and Safety staff has thoroughly reviewed the National Electrical Code 2005 and the International Code Council Electri cal Code -Administr 1tive Provisions 2006 and recommends adoption subject to certain exceptions, modifications and amendments. FINANCIAL IMPACT TI1e only costs associated with the ordinance would be for the purchase of code books. The estimated amount is approximately $200 an d this has been budgeted for in the 2007 Budget.
