AN ORDINANCE ADOPTING A NEW TITLE 8, CHAPTER 2, ARTICLE H, OF THE
EN GLEWOOD MUNlCIPAL CODE 2000, PERTAINING TO THE FUEL GAS CODE
OF THE CITY OF ENGLEWOOD, COLORADO.
WH EREAS, the City of Englewood has used the Uniform Plumbing and Mechanical
codes as a model construction code for fuel gas systems since 1972; and
WHEREAS, these codes are updated periodically lo keep pace with changing
construction technology ; and
WHEREAS , internationally, code officials recognized the need for a modem , up-lo-date
fuel gas code addressing design and installation of fuel gas systems and gas fired
appliances through requirements emphasizil\g performance . The International Fuel Gas
Code in this 2006 edition, is designed to mcet these needs; and
WHEREAS , the City of Englewood Division of Building and Safety staff has
thoroughly reviewed the International Fuel Gas Code 2006 and recommends adoption
there0f subject to certain exceptions, modifications and amendment; and
WHEREAS, the adoption of this Code will enhance the safety of the citizens of
Englewood;
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:
Section I. The City Council of the City of Englewood, Colorado hereby adopts the
Fuel Gas Code 2006 as Tille 8, Chapter 2, Article H oflhe Eng lewood Municipal Code
2000, lo read as follow s:

There is hereby adopted, by reference thereto, the International Fuel Gas Code 2006
Edition, in its entirety including errata updates, published as pan of this Code, published
by the International Code Council, Inc ., 40S1 West Flossmoor Road, Country Club Hills,
Illinois 60478-S79S, subject to th• :·eptions, modifications and amendments set forth
in Section 8-2H-2 of this Anicle. The Clerk shall maintain a copy of the Code which
will be available for inspection during regular business hours .
8-2H-2: SPECIFIC MODIFICATIONS TO ADOPTED CODE:
The followir,~ specific changes, modifications and amendments are hereby made in the
provisions of the International Fuel Gas 2006, hereinabove adopted:
A. CHAPTER J. ADMINISTRATION
I . 101.1 Title. (Shall be amended to read) These regulations shall be known
as the International Fuel Gas (IFGC) Code of the City of Englewood,
hereinafter referred to as "this Code ."

106.1 When required. (Shall be ,,nended to read)
An owner. authorized agent or contractor who desires to erect, ins!all,
enlarge, alter, repair, remove, convert of replace an installation regulated
by this code, or to cause such work to be done, shall fi rst make application
to code official and obtain the required permit for the work.
Exception : Where equipment replacements and repairs arc required to be
performed in an emergency situation, the pcimi t application shall be
submitted within the next working businc,,, day of the Division of
Building and Safety .
S. 106.4.3 Expiration . (Deleted in its entirety. S11bstitute the
following) Refer to Section 10S.S of the amended (IBC) Building
Code of the City of Englewood for requirements of this section.

Section 2. Safety Clauses. The City Council hereb y find s, detennines. and declares
that this Ordinance is promulgatc-d under the general police power of the City of
Englewood, that it is promulgated for the health, safe ty, and welfare of the public, and
that thi s Ordinance is necessary for the preservation of health and safety and for the
protection of public con\'eniencc and welfare . The City Co uncil fun her detennines that
the Ordinance bears a rational relati on to the proper legislative object sought to be
obtained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this Ordinance
or the application thereof to any person or circumstances shall for any reason be
adjudged by a coun of competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this Ordinance or it application to other persons or
circumstances.
Section 4. Inconsistent Ordinances. All other Ordinances or ponions thereof
inconsistent or conflicting with this Ordinance or any portion hereof are hereby repealed
to the extent of such inconsistency or conflict.
Section 5. Effect of repeal or modification. The repeal or modification of any
provision of the Code of the City of Englewood by this Ordinance sha ll not release.

liability, either civi l or criminal, which ..,b,(I h.we been incurred under such provision,
and each provisio.i shall be treated and helo ,, still remaining in force for the purposes
of sustaining any and all proper actions, suits, proceedings, and prosecutions for the
enfo rcement of the penalty, forfeiture, or liability, as well as for the purpose of

sustaining any judgment, decree, or order which can or may be rendered, entered, or
made in such actioru,, suits, proceedings, or prosecutions .
~. Chojce of Code . Any party who has a pending application, where th~ permit
application and final site plan have been submined to the City before the date of final
adoption of this Ordinance, shall make an election to proceed under either the current Code
or the 1997 Code but not a combination thereof.
~ fenlln'.. The Penalty Provision of E.M.C . Section 1-4-1 shall apply to
each and every violation of this Ordinance .

The adoption of the lnternatiooal Fuel Gas Code 2006 was reviewed by City Council at the August
2 1, 2006 Study Session.
RECOMMENDED ACTION
Staff recommends Council approve a Bill for an Ordinance adopting th e International Fuel Gas
Code 2006 to estab li sh minimum requirements to safegua rd the p'1blic health, safety and general
we lfare.
• BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
•
The City of Englewood has used th e Uniform Plumbing and Mechanical Codes as a model
cons tr uction code for installation of fu el gas systems since 1972 and updates this code periodically
to keep pace with cha nging cons truction te chnology.
Building and Safety staff has thoroughly reviewed the Internatio nal Fuel Gas Code 2006 and
recommends adoption subject to certain excepti ons, modifications and amendments.
FINANCIAL IMPACT
The on ly cos t s associated with the ord in a ice would be fo r,~ · purchase of code books. Tiie
estimated amount is approximately $200 and this has been uudgeted for in th e 2007 Budget.
