HomeMy WebLinkAbout2007 Ordinance No. 015• • ORDINANCE NO. 6_ SERIES OF 2007 BY AUTHORITY COUNCIL BILL NO. 14 INTRODUCED BY COUNCIL MEMBER WOODWARD AN ORDINANCE ADOPTING A NEW TITLE 8, CHAPTER 2, ARTICLE G, OF THE ENGLEWOOD MUNICIPAL CODE 2000 , PERTAINING TO THE RESIDENTIAL CODE FOR ONE-ANl' TWO-FAMILY DWELLINGS IN THE CITY OF ENGLEWOOD, COLORADO. WHEREAS, the Cit)' of Englewood has used the Unifonn Building Code as a model const ructi on code since 1971; and WHEREAS, this Code is updated periodically to keep pace with changing construction technology ; and WHEREAS, internationally, code officials recognized the need for a comprehensive, staud ••lone residentia l code addressing the design and construction of one and two-family dwellings and townhouses using prescriptive provisions, this Internation al Residential Code, in this 2006 edition. is designed to meet these needs; and WHEREAS, the City of Englewood Division of Building and Safety staff has thoroughly reviewed the International Residential Code For One-and Two-Fam ily Dwellings 2006 and recommends adoption thereof subject to ce rtain exceptions, modification s and amendment; NOW. THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD. COLORADO. AS FOLLOWS: Section I. The City Council of the City of Englewood . , ado hereby adopts the International Residential Code For One-and Two-Family Uwellings 2006 as Title 8, Chapter 2. Article G, of the Englewood Municipal Code 2000 , to read as follows: CHAPTER2 CONSTRUCTION AND SAFETY CODES ARTICLEG RESIDENTIAL CODE FOR ONE-AND TWO-FAMILY DWELLINGS 8-20-1 : CODE ADOPTED : There is hereby adopted, by reference thereto, the International Residential Code For One-and Two-Family Dwellings 2006 falition, in its entirety including errata updates , published as part of this Code, published by the International Code Council, Inc ., 405 I West Flossmoor Road, Country Club Hills, Illinois 60478-S795, subject to the -1- 9 b vi exceptions, modifications and amendments set forth in Section 8-20-2 of this Anicle (hereinafter R""idential Code). The Clerk shall maintain a copy of the Code and errata updates which will be available for inspection during regular business houn. 8-20-2 : SPEC:.FlC MODIFICATIONS TO ADOPTED CODE : The following specific changes, modifications and amC".1dments are hereby made in the provisions of the International Residential Code For One-and Two-Fanuly Dwellings 2006, hereinabove adopted: A. CHAPTER 1-ADMINISTRATION (Shall be amended to read) I. RlOJ.J Tille. (Shall be amended to read) These regulations shall be known as the Res idential Code for One-and Two- Fanlily Dwellings of the City of Englewood, hereinafter referred to as "this Code". 2. R102.7 Existing Structures. (Shall be amended to read) The legal occupancy of any structure e<isting on the date of adoption of this code shall be pennitted to continue without change, except as is specifically covered in this code within Title 9 EMC or the International Fire Code, or as deemed necessary by the building official for the general sa fety or welfare of the occupants and the public . 3. (Shall be amended ro rend) The Division of Building and Safety is hereby created and the official in charge thereof shall be · :nown s; the building official. 4. RI04.J0.J Areas prone to flooding. RECOMMENDED ACTION Staff recommends Council approve a Bill for an Ordinance adopting the lnternatic nal Residential Code 2006 to establish minimum requireme nts to safeguard the public health, safety and ge neral we lfare . BACKGROUND, ANA l\'SIS, AND ALTERNATIVES IDENTIFIED The City of Englewood has used the Uniform duilding Code as a model construction code since 1971 and updates this code periodically to keep pace with changing construction technology. Building and Safety staff has thoroughly reviewed th e International Residential Code 2006 and rec om mends adoption subject to certain exceptions, modifications an d amendments . FINANCIAL IMPACT The only costs associated with the ordinance would be for th e purchase of code books .
