AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE 1990 BIG DRY CREEK
INTERCEPTOR AGREEMENT REGARDING FEES .
WHEREAS, the Big Dry Creek Basin Interceptor is a major trunk line serving the Southgate ,
South Arapahoe, South Englewood and part of the City of Englewood's Sanitation Districts for
sanitary sewer transp,m ; and
NHEREAS, the Englewood City Council approved entering the Big Dry Creek Basin
Interceptor Agreement between Englewood , Southgate Sanitatioa District , South Arapahoe
Sanitation District 1111d the South Englewood Sanitation District No . I, by the passage of
Ordinance No . 30, Series -~f I ~90; and
WHEREAS, the Englewood City Council authorized the passage of a Resolution in 2004,
establi ohing maintenance fees for Big Dry Creek Basin Interceptor; and
WHEREAS, in 1990 at the time the Fig Dry Creek Basin Interceptor Agreement was signed,
eight capital construction projecls were anticipated as well as line and advanced tap fees to pay
for such capital construction, in addition , a small charge for repair and maintenance was
est a bl is hcd ; and
WH EREAS, after the comple1ion of three capital projects , Southgate Sanitation District
reasse »cd the condition of the interceptor and determined that the interceptor has capacity
adequate to meet the existing and future demands and that no further capital projects 11re needed;
and
WHEREAS , under the 1990 Agreement , funding mllf ' now be provided to proceed with a
repair, maintenance and rehabilitation program; alld
WHEREAS, the passage of this proposed ordinance implements Southgate's proposal to
tenninate the Advanced Tap Fee collection for capital projects; disburse that unused tap
fee/capital revenues to the participating distri c1 s and establish a ,epair, maintenance and
rehabilitation, fund and schedule, with a p.,; U• ,usar.d gallon charge of $0 .108406, to replace the
previous charge of $0 .00S434
NOW, THEREFORE, BE IT ORDAINED \' THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:

the 1990 Big Dry Creek Interceptor Agrcemer,l by tennioating the Advanced Tap Fee collection;
disbursement of unused tap fee/capital revenues 10 the panicipating districts; and establishing a
repair, maintenance and rehabilitation program, funded by a charge ofS0.108406 per thousand
gallons per single family equivalent.

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
The Bi g Dry Creek Basin Int ercep tor Agr eemen t between the City of Englewood, Southgate
Sanitation District, South Arapahoe Sanitation District, and the South Eng le wood Sanitation District
No. 1 was approved by Council as Ordinance No. 30, Series 1990.
Resolution passed October 18, 2004 establishing maintenance fees for Big Dry Creek Basin
Int ercepto r.
RECOMMENDED ACTION
The Englewood Wate r and Sewer Board, at their March 13, 2007 meeting, recommended Council
adopt a Bill for an Ordinance approvi ng the Big Dry Creek Int erceptor finance charge of $0.108406
per th ousa nd gallons.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The Big Dry Creek Basin Interceptor is a major trunk line serving the Southgate, Sou th Arapahoe,
So uth Engle wood and part of the City of Englewood Sanitation Districts for sanitary sewer transpo rt.
Th e in terceptor begins at Clarkson and Orchard, runs northwesterly along Big Dry Creek to
Santa Fe Drive, and then north to the Littleton/Englewood Wastewater Treatment Pl ant.
In 1990 the City of Englewood enter ed into the In tercep tor Basin Agreement ;IBA ) wi th Southgate
Sanitation District, along wi th other connecting sanitation districts . At the time of the agreement,
eight capital construction projects we re anticipated. Line and advanced tap fees for ca pital
co nstru ction, along with a small charge for repair and maintenance, were established. After
completion of three capital projects, Southgate Sanitation District reassessed the condition of the
interceptor and determined that it has ca pacity adeq uate to m~et the existing and future demands
and that no further ca pital projects are needed . Under the 1990 Agreemen~ funding must now be
provided to proceed with a •epair, maintenance and rehabilitation program.
FINANCIAL IMPACT
In accordance with the 1990 Agreemen~ Southgate has propos ed terminating the Ad va nced Tap
Fee collection, disbursement of unused tap fee/capital revenues to the particip ating districts, and
establishing a repair, maintenance, and rehabilitation schedule . The per thousand gallon charge will •
Increase from $0.005434 to SO. 106406. The typical, residential customer will see their bill go from
$0.45 per year to approximately $9.00 per year.
