'iJfo-A."07 COUNCIL BILL NO . 43 INTRODUCED BY COUNCIL MEMBER WOODWARD AN ORDINANCE APPROVING SUPPLEMENT NO. 162 TO THE SOUTHGATE SANITATION DISTRICT CONNECTOR'S AGREEMENT FOR THE INCLUSION OF LAND WITHIN THE DISTRICT BOUNDARIES. WHEREAS, Southgate Sanitation Di strict recommends the inclusion of approximately 2.17 acres into the District; and WHEREAS, said inclusion is located between Belleview and Orchard, west si de of Quebec in Greenwood Village at 7105 East Powers Avenue; and WHEREAS, the zoning of d:iis property in Greenwood Village is Single Family Residential and which is the pro posed use of thi s property; and WHEREAS, said annexation of this parcel ofland will not increase the tap allocation to the Southgate Sanitation District; and WHEREAS, the Englewood Water and Sewer Board recommended approval of this Agreement at its July 10, 2007 meeting; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO , AS FOLLOWS : Section I. The Agreement between the City of Englewood and Southgate Sanitation District entitled "Supplement No . 162, to Connector's Agreement", wl,:ch includes 2.17 acres located between Bellevi ew and Orchard, on the west side of Quebec in Greenwoud Village, is hereby accepted and approved by the Englewood City Counc il. A copy of said Agreement is attached hereto as "Exhibit l" and incmporated herein by r,,ferenct . Section 2. The Mayor and City Clerk are hereby authorized to sign and attest, respectively, the said Agreement for and on behalf of the City Council and the City of Englewood, Co lorado . Fonda, Director of Utilities COUNCIL GOAL AND PREVIOUS COUNCIL ACTION None. RECOMMENDED ACTION The Water and Sewer Board, at their July 10, 2007 meeting, recommended that Council adopt a Bill for an Ordinan ce approving Southgate Supplement No. 162. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The City of Englewood provides sewage treatment to approximately 32,000 accounts outside the City through contracts with numerous connector districts. The area is defined by the natural drainage and extends south and east from Br oa dway to the Valley Highway and from Hampden to Lincoln Avenue excluding Highlands Ranch . By contract, the City of Englewood must approve any additions of land to be served by the distri cts . Thes e are usually in-fill situations that are within w hat the City considers to be the area it has committed to serve . Adequate capacity has been provided in the treatment plant to accommodate all such future inclusions. Annexation of this parcel of land will not increase the tap allocation of the Southgate Sanitation District. A request was made by the Southgate Sanitation District representing the owner, Jared and Eileen Slattery, for inclusion of Supplement No. 162 consisting of a parcel totaling 2.1 7 acres into the Southgate Sanitafon District. This is in conjunction with a reno vation of their residence and they are requesting inclusion into the district for residential use. The property is currently zoned residential and no changes in zoning or use are anticipated. The legal is attached as Exhibit "A". The property is located between Belleview and Orchard, west of Quebec in Greenwood Village at 710S East Powers Avenue. FINANCIAL IMPACT None . UST OF ATTACHMENTS Bill for Ordinance • • •
