AN ORDINANCE REPEALING TITLE 8, CHAPTER 2(F) -ENTITLED "THE
ABATEMENT OF DANGEROUS BUILDINGS CODE" AND TITLE 9, CHAPTERS I
THROUGH 4 • ENTITLED "HOUSING REGULATIONS" OF THE ENGLEWOOD
MUNICIPAL CODE 2000, AND REENACTING I, NEW TITLE 8, CHAPTER 2(F),
ENTITLED "INTERNATIONAL PROPERTY MAINTENANCE CODE 2006" FOR
THE CITY OF ENGLEWOOD, COLORADO.
WHEREAS. the City has used the Englewood Municipal Code Title 9 Housing
Regulations as a residential property maintenance code since 1985 and is updated
periodically to keep pace with changing technology ; and
WHEREAS, the International Property Maintenance Code 2006 has been thoroughly
reviewed by the Englewood Building Safety Department and recommends adoption of this
International Propert y Maintenance subject to certain exceptions . modifications and
amendments :
NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO . AS FOLLOWS:
Section I. The City Council of the Ci ty of Englewood, Colorado, hereby repea ls Title
8, Chapter 2F , of the Englewood Municipal Code 2000, in its entirety .
S~ion 2. The Ci ty Council of the City of Englewood. Colorado, hereby repeals Title
9. Chapters I through 4, of the Englewood Municipal Code 2000.
Section 3. The City Council of the City of Englewood, Colorado, hereby reenacts a
new Title 8. Chapter 2F. entitled "International Property Maintenance Code 2006" of the
Englewood Municipal Code 2000 , to read as follows :

~ Safety Clauses . The City Council hereby finds, dctcnnincs , and declares
that this Ordinance is promulgated under the general police power of the City of
Englewood, that it is promulgated for the health, safety, and welfare of the public, and
that this Ordinance is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further dctcnnincs that
the Ordinance bears a rational relation to the proper legislative object sought to be
obtained .
~ Severability. If any clawe, sentence, paragraph, or part of this Ordinance
or the application thereof to any person or circumstances shall for any reason be
adjudged by a court of competent jurisdiction invalid, such judgment shall r ot affect.

circwnstanccs .

~7. Effect of rq,eal or modjficatjop. The repeal or modification of any
provision of the Code of the City of EnaJewood by thi1 Ordinance shall not release,
extinguish, alter, modify, or change in whole or in part any penalty, forfeiture , or
liability, either civil or criminal, which shall have been incurred under such provision,
and each provision shall be treated and held as still remaining in force for the purposes
of sustaining any and all proper actions, suits, proceedings , and prosecutions for the
enfo.cernent of the penalty, forfeiture , or liability, as well as for the purpose of
sustaining any judgment, decree , or order which can or may be rendered, entered, Jr
made in such actions, suits, proceedings, or prosecutions .
~ fmillY. The Penalty Provision or E.M .C. Section 1-4-1 shall apply to
each and every violation of this Ordinance .

The aduption of th e International Property Maintenance Code 2006 was reviewed by City Council
at the August 06, 2007 St ,,dy Session.
RECOMMENDED ACTION
Staff requests City Council approve a Bill for an Ordinance adopting tl·n ln!ern ational Property
Maintenance Code 2006 to establish clear and specific property maintenan:e req uirements with
required property improvement provisions .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IUENTIFIED
The City of Englewood has used the Englewood Municipal Code Titl e 9 Housing Regulations as a
residential prop erty maintenance code since 1985 and updates this code periodicall y to keep pace
with changing t echnology.
Th e Buildin g and Safety staff has thoroughly reviewed the International Property Maintenance Code
2006 and recommends adopti on subject to ce rt ain excepti ons, modifications and amendments.
FINAN CIAL IMPACT
Th e only costs associated with the O rdin ance would be for the purchase of code books. Th e
estimated amount is approximately $200 and has been budgeted for in the 2007 Budget.
