HomeMy WebLinkAbout2007 Ordinance No. 061• • • ORDINANCE NO . 1P../_ SERIE!'; OF 2007 BY AUTHORITY COUNCIL BILL NO. 54 INTRODUCED BY COUNCIL MEMBER MOORE AN ORDINANCE AUTHORIZING THE VACATION OF TWO UTILITY EASEMENTS LOCATED AT SOUTH SANTA FE DRIVE AND U.S. HIGHWAY 285 BETWEEN THE COLORADO DEPARTMENT OF TRANSPORTATION AND THE CITY OF ENGLEWOOD, COLORADO. WHEREAS. the Englewood Utilities Department has recommended a Vacation of Sewer Easements across property owned by the Colorado Department of Highways (COOT) for two existing casements; and WHEREAS, the City of Englewood originally obtained these easements in 1967 from the South Arapahoe Sanitation District ; and WHEREAS, the sewer that existed in these easements was abandoned 2 years ago and the sewer main was relocated; and WHEREAS, Englewood's easements cro ss th e future entrance of "TI1e Park al Sheridan" devel!'pment; and WHEREAS, the Colorado Department of Transportation is the owne r of the property in these easements and will retain ownership and the developer of "The Park at Sheridan " will landscape the area and use ii for access: and WHEREAS, the Englewood Water and Sewer Board reviewed the vacation of the exi sting easement that is 20' by 10' and an additional triangular easement approximately 106' by 10' located at South Santa Fe and U.S . 285 at their September 4. 2007 meeting and recommended the vacation: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOn, COLORADO , AS FOLLOWS : Section I. The vacation of the existing casement that is 20' by 10' and an additional trianb,ular easement approximately 106' by JO' located at South Santa Fe and U.S. 285 for the Colorado Department of Highways (COOT) as shown on Attachment I, attached hereto, is hereby approved by the Englewood City Council. BACKGROUND , ANALYSIS, AND ALTERNATIVES IDENTIFIED The Utilities De partment has subm itt ed a vacatio n of two utili ty ease ments to be issued to the Colorado Department of High way s (COOT) fo r two exi sting easements. One is 20 ' x 1 0' and an additional triangular easement that is approximatel y 106 ' x 10', loca ted at So uth San ta Fe Drive and U.S . Highwa y ~85. The City originall y obtained these easements April 11 , 196 7 vi a a Bill of Sale from South Arapahoe Sanitation District. The sewer that existed in these easements wa s aband oned two years ago and the main relocated . Englewood 's easements cross the future entrance ofThe Park at Sheridan . COOT is the owner of the property in the easements . COOT wi ll retain ownership but the deve loper of The Park at Sheridan can landscape the area and use for access. The Utilities Engineer determined that Engl ewo od 's ea sements serve no purpos e for th e City and should be vacated for th e proposed rJevelopment. FINANCIAL IMPACT None .
