AN ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT
ENTITLED "JOINT DEFENSE AND CO NFIDENTIALITY AGREEMENT''
BETWEEN THE CITY OF AURORA. COLORADO; THE NORTHERN COLORADO
WATER CONSERVANCY AND THE CITY OF ENGLEWOOD, COLORADO,
PERTAINING TO A JOINT DEFENSE FOR THE FRICOIUNlTED LITIGATION .
WHEREAS, the FRICO litigat io n is a series of •. iscs being filed by FRICO, Ea st
Cherry Creek Valley, Hcnrylyn and Burlington Ditch and Reservoir and is the largest
request in the history of Colorado for water rights changes on the South Platte River; and
WHEREAS, the FRJCO participant s have submitted applications trying to change
water rights from agricultural to municipal use, alter augmentation plans and change
points of diversion ; and
WHEREAS, Dcn\'Cr and FRICO ha ve a 1999 ab'l'eement which allow s Denver to
1ivcrt out of priority, which would injure Englewood's water rights and affect
Englewood's Mclellan rights ; and
WHEREAS, the passage of this proposed Ordinance will allow Englewood's Nater
Rights Attorney to work with the City of Aurora and the Northern Colorado Water
Conservancy District (NCWCD) on the FRICO/Unitcd litigati on in the exchange of
information and to share costs and stra tegy during the FRJCO litigation ; and
WHEREAS , the FRJCO litigation co uld change a r,reat number of water rights , and
Englewood wants to insure that historical patterns c f diversi on arc protected in
accordance with past decrees;
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL o; THE CITY
OF ENGLEWOOD, COLORADO. AS FOLLOW~
Secti on I. The Intergo vernmental Agreement for "Joint Defense And Confidentiality
Agreement" is hereby accepted and approved by the Englewood City Council and
is attached hereto as "Exh ibit A".
~ The Director of Utilities is authorized to sign sa id Agreement for and on
behalf of the City of Englewood .

• BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED

Englewood's water rights attorne)', David Hill of Berg Hill Greenland and Rusc itti, submitt ed a Joint
D efe nse and Confidentiality Agreement to allow Mr. Hill to work wi th th e City of Au ro ra and th e
N orth ern Colorado Water Conservancy Distri ct (NCWCD) o n ti ,e FRlCO/United litigati on. This
agreement would all ow En glewood, Aurora and the NCWCD to exchange informati on and share
costs and strategy during the FRlCO litigation. With thi s ag ree m en t Engl ewood does not
compromise its wa ter rights in any manner. The agreement grants p ermiss ion fo r the parti es to
work together for this specific litigation only.

which means Denver could dive rt out of priority. D ownstream rese rvoirs would fill slower, affecting
Englewood's Mclellan rights .
Englewood has previously hired David Hill for the FRlCO litigation to represent Engl ewood rights
and ens ure that historical patterns of diversions are protected. Sin ce the FRICO litigation is
requesting to change a great amount of w at er rights, Englew ood wants to insure that the liti ga ti on is
lawful and in accordance with past decrees.
