NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS :

MATTERS: AND DRUG -F REE WORKPLACE REQUIREMENTS
Applicants should refer to the regulations cited below to determine the certification to which they are required to
attest. Applicants should also review the Instructions for certificalion included in the regulations before completing
this fo rm . Signature of th ,~ form provides for compliance with certification requirements under 28 CFR Pert 69,
"New Restrictions on Lobbying" and 28 CFR Part 67, "Government -wide Debarment and Susp ension (Nonpro -
curement) and Government-wide Requ ir&ments for Drug-Free Workplace (Grants)." The certif ications sha ll be
treated as a material representation of fact upon which reliance will be placed when the Department of Justice
determines to award the covered trJnsaction , gra nt, or cooperative agreement.
1. LOBBYING As requi red ~y Sec tion 1352, Title 31 of the U.S. Code , and implemented at 28 CFR Part 69, for
persons entering into a grant or cooperative agreement over $100,000, as defined at 28 CFR Part 69, the
applicant certifies that :

As required by Exec utive Order 12549, Debarment and Suspension , and implemenled at 28 CFR Part 67, for
prospecli ve part icipa nts in primary covered transactions, as defined at 28 CFR Part 67, Section 67 .510

obtain, or performing a public (Federal , State , or local) tra nsaction or contract under a public transaction ; violation
of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery , fals ification or
destruction of records , ma kin g false statements, or receiving stolen prop ert y;
(c) Are not presently indicted for or otherw ise crimi nally or civilly charged by a governmental entity (Federal, •
or local) with commission of any of the offenses enumerated in paragraph (1 )(b) of this certification ; and (d) Ha ve
not within a three -year period preceding th is application had one or more public transactions (Federal , State, or

3. DRUG -FREE WORKPLACE (GRANTEE S OTHER THAN INDI VI DUALS)
As required by the Drug-Free Workplace Acl of 1988, and implemented al 28 CFR Part 67, Subpart F, for
grantees, as defined at 28 CFR Part 67 Sections 67 .615 and 67 .620
A. The applicant certifies that ii will or will continue to provide a drug-free workplac e by :
(a) Publishing a statement notifying employees that the unlawful manufacture, distribulion, dispensing,
possession, or use of a controlled substance is prohibited in the grantee's workplace and specifying the actions
tha l ·;,,Ill be taken against employe es for violation o ' su rh proh ibition ;
(b) Establishing an on-going drug -free awareness program lo inform employees about
(1) The dangers of drug abuse in the workplace;
(2) The grantee's policy of maintaining e drug •free workplace ;
(3) Any available drug counseling, rehabililallon, and employee assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse violations occurring in the workpiece ;
(c) Making ii a requirement Iha\ each employee \o be engaged in \he pertormance of the grant be given a copy of
the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a condition of employment under
the grant, the employee will ·
(1) Abide by the terms of the statement ; and
(2) Notify the employer in wrtting of his or her conviction for a violation of a criminal drug statute occurring in the
workplace no later than five calendar days after such conviction;
(e) Notifying the agency, in writing, within 10 calendar days after receiving notice under subparagraph (d)(2) from
an employee or otherwise receiving actual notice of such convic-tion . Employers of convicted employees must
provide notice, including position title, to: Department of Justice, Office of Justice Programs , ATTN : Control Desk,
633 Indiana Avenue , N.W., Wash ington , D.C. 20531 . Not ice shall include the identification number(s) of each
affected grant ;
(f) Taking one of the following actions, wit11in 30 calend ar days of receiving notice under subparagraph (d)(2), with
resp ect to any employee who is so convicted
(1) Taking appropriate personnel act ion against such an employee , up to and including termination, consistent
with the requirements of the Rehabilllallon Act of 1973, as amended ; or
(2) Requiring such employee to participate satisfactor ily in a drug abuse ass istance or rehab ilitation program
approved for such purposes by a Federal, Stale, or local healih, law enforcement, or other appropriate agency;
(g) Making a good faith effort to continue lo maintain a drug-free workplace through implementation of paragraphs
(a), (b), (c), (d), (e), and (f).

Grant be used to purchase a ductless evidence drying cablnel. This drying cabinet Is a 11ented
and flltered enclosure speclrlcally designed to safely dry and store evidence that hos been
contaminated with blohazards . The cumml drying cab lnot Is obsolete, dol!s not meet rurrent
evidence co/lectlon standards and would not withstand legal scrutiny In a court or law. The
Englewood Pollce Division has committed to sharing this asset with the Greenwood VIiiage,
She ridan and Chorry HIiis Police Departments, All four cities are suburbs bordering the
soulhem clly \\mils of Oen\ler, Colorado. We recommend \he purchase of a ductless e11\dence
drying cabinet slmllar to Mod el ACEVDG0A made by Slrchle Fingerprint Laboratories, Inc. The
approximate cost Is $9 ,800 .00. We would use the remainder of the grant monies to purchase

The Engle wood Department of Safety Services, Police Division , plan s to use the JAG
Grant funds 2006 ($11,258 .00) to purchase a ductless evidence drying cabinet. This
cabinet will be made available (or use to at least three other pol ice agencies that do not
have a drying cabinet. The monies will be spent as follows :

Narrativ~ #2 is a description of the process, as required by the City of Englewood,
Colorado Charter, to create an ordinance accepting the tenns of an lnteragency
Agreement (!GA}. Jn this instance, the agreement is the acceptance of the FY 2006
Edward Byrne Memorial Justice Assistance Grant (JAG).
The Grant Administrator will submit a Council Communication explaining the details of
the 2006 JAG Grant and the proposed use of the b'Tant fun ds. The City Attorney's Office
will draft an ordinance accepting the 2006 JAG grant and establishing the lnteragency
Ab'Teement (JOA}.
The ordinance will be introduced to the Englewood City Council on February 20, 2006. lt
will be fonnally read and public comment is allowed . If pas sed upon first reading, the
ordinance will be published in full and posted for public viewing. The second rending
will occur on April 3, 2006. Public comments will be allowed before the vote by city
council. If the ordinance passes, it will be signed by the Mayor and become effective
immediately . This usually happens 1-2 days after the vote . Copies of the sib'Tled
ordinance and associated documents will be subsequently forwarded to the Bureau of
Justice to prove compliance with the terms of the grant.
