J.e_ SERIES OF 2006 BY AUTHORITY COUNCIL BILL NO . 6 INTRODUCED BY COUNCIL MEMBER TOMASSO AN ORDINANCE AMENDING TITLE 5, CHAPTER 8, SECTION 3, SUBSECTION C, OF THE ENGLEWOOD MUNICIPAL CODE 2000, WHICH PERTAINS TO REFLEXOLOGY EDUCA TJON REQUIREMENTS . WHEREAS, the City Council of the City of Englewood passed Ordinance No . 54, Series of 2005, penaining to Reflexology licensing in the City of Englewood, Colorado; and WHEREAS, the Englewood City Council amended the transitional period for Reflexology Licenses ; and WHEREAS, the passage of this Ordinance will amend the education requirements frr Reflexologists allowing applicants a license if they possess a valid ccnificate from any State recognized cenification Board rather than limiting the cenification to only one ccnification group; NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO , AS FOLLOWS : ..swilmJ . The City Council of the City of Englewood hereby approves amending Title 5, Chapter 8, Subsection 3, Subsection C (2), of the Englewood Municipal Code 2000 , which shall read as follow s: Chapter 8 REFLEXOLOGY 5-8-3 : Application for License . C. Education : I. The applicant must provide complete disclosure of his or her education and experience as a reflexologist. 2. To obtain a reflexologist license the applicant must have : a. Graduated from a school accredited by the State f.ducational Board or division charged with the responsibility of approving private occupational schools , or from a school with comparable approval or accreditation from another state with transcripts indicating completion of at least two hundred (200) hours of training, including a minimum one hundred ten (II 0) hours of supervised class iastruction , in refle,ology . For the purposes of this Chapter, a reflexology school may inc lude an equivalency program approved by the State Educational Board or division charged with the responsibility of approving private occupational schools . 9 b I b. In the alternative, the applicant must possess a current, valid certificate fro m 1he Afflerieen ReAe,rnlogy Ger1iHea1ioft Boa,d a stale recognized reOcxoloqy certification board ~ Safely Clauses The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Englewood , that ii is promulgated for the health, safely, and welfare of the public, and that this Ordinance is necessary for the preservation of health and safely and for the prolcclion of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought lo be obtained. ~ Scvcrabjljly If any clause, sentence , paragraph, or part of this Ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this Ordinance or its application to other persons or circumstances . ~-Inconsjstcnt Ordinances. All other Ordinances or portions thereof inconsistent or conflicting with this Ordinance or any portion hereof arc hereby repealed to the extent of such inconsistency or conflict. ~-E[cc1 of repeal or modjfjcatjon , The rcpca 1 or modification of any provision of the Code of the City of Englewood by this Ordinance shall not release, extinguish, alter , modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the purposes of sustaining any and all proper actions, suits, proceedings, and prosecutions for the enforcement of the penalty, forfeiture , or liability. as well as for the purpose of sustaining any judgment, decree, or order which can or may be rendered, entered , or made in such actions , suit s, proceeding s, or prosecutions . ~-hnall:t. The Penalty Provision of Section 1-4-1 EMC shall apply 10 each and every violation of this Ordinance. Introduced, read in full , and passed on first reading on the 17th day of April, 2006 . J.Q., Series of 2006. .~ • • • COUNCIL COMMUNICATION Date: Asenda Item: Subject : April 1 7, 2006 11 a i Bill for an Ordinance Amending Tille 5, Chapter 8 (Reflexology) of the Englewood Municipal Code Initiated By: Finance and Administrative Services D epartmen t I Staff Source : Frank Gryglewicz, D irec tor COUNCIL GOAL AND PREVIOUS COUNCIL ACTION City Council has discussed this topic numerous times, including the September 19 and October 3, 2005 study sessions. Council passed Ordina nce 54, Series of 2005 on November 11 , 2005 which added Reflexology licensing to the Englewood Municipal Code. Council also passed Ordinance 3, Series of 2006 which amended the transitional period for reflexology licenses. RECOMMENDED ACTION Staff recommends Council approve the attached Bill for an Ordinance amending the education requirements for reflexologists to allow an applicant a lice nse if they possess a valid certificate from a slate recognized reflexology certification board. The language in the Code would read as follows: 5-8 -3-C-2: b. In the alternative, the applicant must possess a current, valid certificate from a state recognized reflexology certification board. City staff has worked with a number of reflexologists in developing th is license to insure only qualified practitioners are allowed lo be licensed and practice their profession in the City of Englewood. Staff believes a reflexologisl holding a current, va lid certificate from a stale recognized reflexology certification board has th e necessary education and experi ence for li censing in the City of Engl ewood.
