L SERIES OF 2006 BY AUTHORITY COUNCIL BILL NO . 9 INTRODUCED BY COUNCIL MEMBER WOODWARD AN ORDINANCE AMENDING TITLE I , CHAPTER 8, OF THE ENGLEWOOD MUNICIPAL CODE 2000 , BY THE ADDITION OF A NEW SECTION 7 ENTITLED CONTRIBUTIONS. WHEREAS, the passage of this propo se d Ordinance will allow City of Er ,wu,,c candidates to accept contributions from corporations and labor organizations, and WHEREAS, the Colorado Attorney General addre ss ed how rules in the Amendment 27 initiative, approved by Colorado voters on November 5, 2002, apply in election s in home rule counties and municipalities : and WHEREAS, the initiative amends both the Colorado Constitution and Colorado's Fair Campaign Practices Act (FCPA), now Article XXVIII of the Colorado Constitution; and WHEREAS , the Colorado Attorney General's opinion states that the "rules about contributions in local elections by corpornti ons and labor organizations do not apply to local elections" in Home Ruic cities; and WHEREAS, the Co lo .do Attorney General also stated, "the legisl ative hi story of thi s part of the amendment says that it is intended to apply to elections for statewide officials ."; and WHEREAS, the City of Englewood, Colorado is a Home Ruic City , thu s following the Colorado Attorney General 's opinion that the Englewood candidates would be allowed to accept contributions from corporations and labor organizaticms; NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS : ~. The City Council of the City of Engl ewood hereby approves amending Title I, Chapter 8, of the Englewood Municipal Code 2000, with the addition of a new Section 7, which shall read as follows . 1-8-7: Contributions Cand idate s will be allowed to accept contribu tions from cornora tions and labor orct1~ .5.i:la.i!m..l. SafcJy Clauses The City Council hereby finds, dc1cm1incs, and declares that this Ordinance is promu lgated under the general police power of the City of Englewood, that it is promulgated for the health, safety, and welfare of the public, and that this Ordinance is necessary for the preservation of health ar ~ sa,'cty and for the protection of public convenience and wc 1farc .
