AN ORDINAN CE AMENDING TITLE 7, CHAPTER I A, SECTION 4, OF THE
ENG LEWOO D MUNICIPAL CO DE 2000.
WHEREAS , the current Title 7, Chap ter IA, Section 4, has outd ate d and confusing lan guage:

WHEREAS , with the adopt ion of thi s propo sed Ordin ance, th e ou td ated an d confusing
language shall be deleted fro m the Englewood Municipal Code ;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO UN CIL OF TH E CITY OF
ENGLEWOO D, COLORADO , AS FOLLOWS :

(3) dogs or ca ts currently ow ned but sha ll not maintain more th an two (2) dogs and two
(2) ca ts up on the death or loss of owners hip of one (I) or more of the currently ow ned
three (3) dog s or ca ts .
~ Safe ty Clauses . The Cit y Co uncil hereb y finds , determines, and declares that
this Ordinance is promulg ated un der th e ge nera l police power of the Ci ty of Eng le wood , th at
it is promulg ated for th e health , safe ty, and welfare of the pub li c, and that th is Ordinance is
necessary fo r the prcsc rv ali on of hea lth and safe ty and for the protection of public
convenience and we lfare. The City Co un ci l funhcr determines th at the Ordinance bears a
rntiona l relati on to the proper legis lative objec t sought to be ob tai ned.
~ Scvcrabili ty If any clause , sen ten ce, paragraph , or pa rt of this Ordina nce or
th e app l.ication thereof to any person or circumstances sha ll fo r any reason be adjudged by a
court of co mpetent jurisdiction inva lid , such jud gme nt shall not affect, impair or in va lid ate
the remainder of this Ordin ance or its app lica ti on to other per sons or circ um stances .

~-Inconsjstent Ordjnanccs All other Ordinances or portions thereof
inconsistent or conflicting with this Ordinance or any portion hereof arc hereby repealed to
the extent of such inconsistency or conflict.
..s.wion.i, Effect of a;pe•I or modjficatjon The repeal or modification of any provision
of the Code of the City of Englewood by this Ordinance shall not release , extinguish , alter,
modify, or change in whole or in part any penalty, forfeiture , or liability, either civil or
criminal, which shall have been incurred under such pro vis ion, and each provision sha ll be
treated and held as still remaining in force for the purposes of sustaining any and all proper
actions , suits , proceedings, and prosecutions for the enforcement of the penalty, forfeiture,
or liability, as well as for the purpose of sustaining any ju dgment , decree , or order which can
or may be rendered, entered, or made in such ac tio ns , suits, proceedings , or prosecutions .
~-~ The Penalty Provi si on of Section 1-4-1 EMC shall appl y to each
and every violation of this Ordinance .

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
City Council disc uss ed this topic at the Study Session on April 17, 2006 and agreed to consider the
proposed changes to Title 7-1 A-4 of th e Englewood Municipal Code at the May 1, 2006 Council
Meeting.
RECOMMENDED ACTION
Staff recommends Council adopt a Bill for an Ordinance deleting outdated and confusing language
in Title 7-lA-4.
FINANCIAL IMPACT
This will not impact the City's financial position.
