WHEREAS , lhc passage of !his Ordinance will allow lhc Englewood Municipal Judge flc xibilily and discretion in determining appropriate penaltie s in individual cases: and WHEREAS, !his amcndmcnl will allow lhc Englewood Municipal Court 10 be in alignmcnl with mo st other metro area jurisdictions regarding false alarm penalties ; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO, AS FOLLOWS : ~. The Ci ly Council of !he Cily of Englewood hereby approves amending Tille 7, Chapler 6B , Scc1ion 11. of !he Englewood Municip al Code 2000 , wilh lhc dclelion of Subsection E in its entirety, to read as follows: 7-6B-1 I: Police and Fire Alarm Syslem Reports . A. II shall be unlawful for a person 10 knowingly cause a false alarm for fire , poli ce, or other emergency to be tran smi tted to or within any organization , official or vohmtccr . B. II shall be unlawful for a person 10 knowingly cause a false alarm for fire , police, or olher emergency 10 be 1ransmi11ed lo a public safely agency . C. False alann shall mean any alann signal originaling from an alarm device , dial alann , audible alarm device or ccnlral alam1 Slalion 10 which a public safety agency responds and which resulls from : I. False aclivalion where !he ac1iva1or knows or should reasonably know Iha! such alarm is false, including reporting a robbery where no aclual or ancmpled robbery has occurred or reporting a burglary where !here is no evidence to subS1an1ia1e an allempled or forced enlry 10 !he premises or reporting a fire or medical emergency where there is no evidence to substantiate such an emergency : 2. Alarm lriggered by negligence; 3. Failure 10 corrccl a malfunclion in an alarm sySlcm which has previously rcsullcd in a false alann , including overly sensitive se ttings . D.
