PENNSYLVA NIA STREET AND HIGHWAY 285. IN THE CITY OF ENGLEWOOD.

application to rezone the propeny from MU-R-3-B Mixed-Use Re sid ent ie.1 11 imited
Office-Retail District to Planned Unit De ve lopm ent (PUD) for the de ve l~p.,ie ot of
Senior Housi ng : and
WH EREAS, the Englewood Housing Authority propenie s create a .8 I acre site with
the proposed mixed•u se deve lopment of re sident ial and commercial uses; and
WH EREAS. the Planning und Zoning Commission held a Public Henring oi, Apr il
I 8. 2006 and took te stim ony on the subject propenic s which are currently zone d
MU-R-3-B Mi,ed-Use Res idential /Limited Office-Retail Di strict : and
Wll EREA S. the Planning & Zoning Co mmi ss ion rec ommend ed approva l of the
PU D with the following conditions:
I. Prior to being forwarded to City Co uncil th e following adju stments shal l be
made to the applicati on:
a. Vicinity map on sheet PUD I be redrawn to dem onstrate th e loca ti on of
the parking area on the west side of South Penn sy lv ania St reet.
b. Front and Rear set backs be estab lished on sheet PUD 3 for the weste rn
parcel.
2. Pri or to issuanc e of any Building Permits. the three properties on the east side
of South Penn sy lvania Street should be combined into a single parcel pu rsuu nt
to City of Englewood and Arapah oe County requirements .
3. TI1 e Eng lewood Traffi c Engineer should re view again the potentinl fo r a mid-
block cros si ng .
4. Re check the submitted plan s for cons istenc y of numbers on all sheets .

NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS :
~I. The Planned Unit Development, for propenies located at South
Pennsylvania Street and Highway 285, in the City of Englewood, Colorado, is hereby
approved with the conditions noted above .
~-Pursuant to Anicle V, Sertion 40 , of the Englewood Home Rule Chaner,
the City Counci l has determined that this Ordinance shall be published by title because
of its size. A copy is available in the omce of the Englewood City Clerk.
Introduced . read in full , and pas se d on first reading on the 15th day of May , 2006.
Publ ishe d as a Bill for an Ordinance on the 19th day of Ma y, 2006.

PREVIOUS PLANNING COMMISSION ACTION
Th e Plaonin g and Zoning Commission considered an applica ti on by th e Englewood H ous ing
Authority (E HA) for th e South Pennsy lva nia Str eet Senior H ousing Plann ed Unit D eve lopm ent
(PUD) at a Public Hearing o n April 18, 2006. Th e Co mmiss ion considered public tes tim o ny from
interes ted parti es and vo ted to forward th e PUD to City Council w ith a recommendati o n for
ap prova l with the foll owing conditions:

CONDITION RESOLUTION
The applican t has addressed Planning and Zoning Commission Conditi on s No. 1 and 4. As part o f
Condition 3 tl1e Traffic Engineer re viewed the potential for a mid-block pedestrian cro sswalk from
the surface pa rking lot to the residential building and re iterated Traffic Division's determination that
• mid-block cro sswalk is in consistent w ith standard traffic safety guirlelines. At this site a mid-block
crossing is not advised because its close proximity to the South Pennsyl va n ia Str ee t and Highway
285 intersection creates a danP,er to pedestrians using the crosswalk . Drivers turning from Highway
28 5 would ha ve limited stopp:ng distance from th e interse cti o n to the crosswalk and pedes tri ans
about to use the c rosswalk would also have limited vis ibility to see turning vehicle~. !,dditionally, a •
mid,block crosswalk would require no p arking areas on both sides of th e street w hich would further
limit the numbr,r o i on-stree t parking place s available to the n eighborhood. If warranted due lo
acci dent histor;, this issue ca n be reeva luated in the future.
RECOMMENDED ACTION
Staff recommends th at Counc il adopt a Bill for an Ordinance app roving th e proposed South
Pennsylva nia Street Senior Housing Planned U nit D eve lopm en t and set June 5, 2006 as the date for
a Public Hearing to consider testimony.
BACKGROUND
The four properties subject to th is PUD appli cation total 0.81 ac res and are loca ted at the northeast
and northwest corn ers of South Penns ylva ni a Stre et and US H ighway 285. Th e subject property is
zoned MU-R-3-8: M ixe d-U se Res idential/Limited O ffice-R eta il District and surro und ing properties
include a mix of singl e-unit, dup le x, and multi•unit uses along with commercial and profession al
office uses .
In late 2005 th e Englewood Housing Authority presented a concept plan to Commu ni ty
Deve lopment ior an affordable senior housin g deve lopment. As required by PUD reg ul ations, the
applicant presented a prelim ina ry plan at a neighborh ood mee ting on Janu ary 19, 2006. Th e
applicant submilled th e form al PUD application on March 3, 2006, w hich was reviewe d by the •
City's D evelopment Review Tea m. The Distri ct Pla n and th e Site Pl an have been combi ned and
submitted as one document for concu rren t review, as provided fo r in the PUD Ordinance .
PUD OVERVIEW
The Plann ed Unit D eve lopment is a rezoning process that es tablis hes zoning regul ations and site
plan c ri ter ia to specific properties to meet th e needs of a ~•articular development proposal tha t may
not b e accommodated within exis tin g zon ing reg ulati ons . Under c urrent MU·R·3·8 regulations, the
site may be developed at a densi ty of 17 resi dential units, and service units or facilities (i .e.
commercial uses ) fo r th e conve ni ence of tenants are all owed.
Th e Engl ewood Housi ng Authority proposes to co nst ru ct a 62 unit res idential deve lopment
des igned for age and income qualified seniors. The in dep en dent, non-a ssist ed li vi ng facility is
expected to fi ll the gap betwee n subsidized (i.e . Orchard Pl ace) and private seni or facilities (i.e.
Meridia n). The proposed five-story building will be located on th e east side of South Pennsylva nia
Str eet an d have 40 one-bed room and 22 two-bedroom units on floors two through five . At•gra 1e
parking is proposed on th e firs t floor (39 spaces) w ith an additi ona l twenty (20) parking spaces
proposea in a surface lot located across South Pennsylva ni a Street.
The west parce l is currently propos ed to be a surface parking lot. The PUD requem apµroval for
future use of th is p arce l for B-1 mixed-use commercial uses . This request is bein g made at th e
behest of th e Community D eve lopment Departm ent to provi de for future flex ibility in use . Th e
parcel is adjacent to the B-1 Mixe d-Use Commercial District l o the west. Because of this p arcel's
location on US Highway 285, good planning practice suggests mi xe d-use is appro priate at th is sit e. •

By Ordinance (8-1-5 EMC) the Englewood Housi ng Authority is exe mpt from all Building Permit
fees . The amount of the exemption is based on proje ct valuation and w ill not be determined until
submittal of th e Building Permit application. By Resolution No. 46, Council wa:,ed develo pment
fees of approxi mately $1,600 impos ed by Titl e 16 regulations associa ted with th e PUD .

BACKGROUND:
The subj ect site was orig in all y zon ed R-2, Res idence District in 1940. The area was rezoned
in 19 55 to R-2-A, Two Family Residence Di strict; in 1963 to R-3-A, Multi-Family Res id enc e
District; and in 1975 to R-3, Hi ~h Density Residence Di stri ct. In 2004 with the adoption of
the Unified Deve lopmen t Code (U DC) the Distri ct was renamed MU-R-3-B and maintained
its high density designa ti on.

for an affordab le se ni or hou sing developm ent in late 2005. O n January 19, 2006 th e
Autho rity ho sted a pr e-s ubmittal neighbor ho od meeting as required by the PUD Ordinance .
The formal So uth Penn sy lva nia St re et Senior Housing PUD appli ca tion was submitted on
March 8, 2006 and wa , reviewed by th e City's Dev elopment Review Team . The District
Plan and the Si te Plan ha ve been co mbin ed and submitt ed as one do curn ent for co ncurrent
review, as provided fo r in the PUD Ordinance. An Overa ll Concept Plan (OCP) wa s not
req uire d as part of thi s submittal based 011 a Community Deve lopm e nt Dep art ment policy
prepared frfowing the Febr uary 2006 City Council eco nom ic development retreat. That
policy holds that submittal of an OCP in conjunction with a PUD re zoning application is
redundant, time consuming and cos tly to the applicant, duplic ates review work for City
staff, and is counter to City Council 's objection of encouraging economic growth in the
City. •

Traffic Division reviewed the PUD proposal and determined no modifications tc> existing
intersections or roadways was required and that the leve l of traffic generated by the
proposed use did not warran t a Traffic Study .
Shadow:
A shadow study was not required as part of the app li catio n as the proposed ma xi mum
building height within the PUD is the same as th e MU -R-3-8 maximum building height
standard . The City does not cur ren tly reg ulat e so lar access or shadow regulations.
Utilities:
Adequate City of Englewood water and sanitary sewe r services are available to the site .
Drainage :
Engineering staff has reviewed and conditionally approved the Preliminary Drainage
Report. A Final Drainage Report will be required as part of the Building Permit
application .
PUD Modification Proce dure:
Modifications to the PUD are all owed pursuant to th e modification procedures of Title
16: Unified Development Code under which the PUD was submitt ed. Major
modifications to ei th er the District Plan or Si te Plan may on ly be made through the •
same public process under which the PUD was approved. Limit ed minor modific ati ons
to the District Plan may be a pprov ed by the City Manager or designee for tech11ical
reasons . Limited minor modifications to the Site Plan may be approved by the City's
Development Review Tea m.

used in the developmen t are included in the PUD for illustrative purposes only. Final

SUMMARY:
Englewood 's built-ou t urban environment presents development cha ll enges for the City
including physi cal limitations to gro wth, a need for more diverse housing stock, and a need
to maintain an d deve lop community vitality. The Englewood Comprehensive Plan speaks
to revitalization, redevelopment and reinvestment to address these challeng es. The City
mu st provide opportunities for development of high quality pro jec ts that will hold value for
the City over time as well as provide needed services to citizens.
The South Pennsylvania Street Senior Housing PUD implements flexible site dev elopmen t
opportunities through creative and innovative design an d development without sacrificing •
traditional zoning objectives of health, safety and welfare of the community. The PUD
provides for future commercia l development of the west parcel which is an appropriate
development option since it is adjacent to the existing MU -8-1 business zone and fronts on

US Highway 285, The PUD furthers the City 's revitalization goals, fills a needed housing
gap for seniors, and helps establish a new standard for future development in the City .
Community Development Department believes the proposed South Pennsylvania Street
Senior Housi ng Planned Unit Development achieves these objectives and therefore should
be re co mmended for approva l with the above stated conditions .
PLANNED UNIT DEVELOPMENT CONSIDERATIONS:
The South Pennsylvania Street Senior Housing Plann ed Unit Deve lopment application was
submitted under provisions of 76-2-7 Official Zoning Map Amendments (Rezonings) of the
Englewood Municipal Code . Whtn considering the Pl an ned Unit Deve lopment
application, the Commission's recom menda ti on sha ll include wr itten findings o n each of the
foll ow ing points:

The applicalion meets the second criterio n because the proposed senior housing
development cou ld be achieved under MU-R-3-B slandards only through approva l of
minimum of ten variances for increase in the number of all owed residenlial uni l s,
encroachment into all serbacks, an d commercial use. A PUD rezoning provides
ne xibility and diversily in development thal may not be accompli shed within existing
zo ni ng developmen t regulations and also provides rhe opporlunity for unified
development contro l for multiple properties or mulriple uses.
Further, rhe Commission must find that the rezoning meets the following criterion :

This matter was he ard before the City Plar,ning and Zoning Commission on April 18, 2006,
in the City Council Ch~mbers of the Englewood Civ ic Center.
Testimony was received from Staff, from the applicant an d from area res id en ts . The
Commission received noti ce of Public Heari11 g, Certification of Po sting, Staff Report and
supplemental information from Staff, which were incorporated into and made a part of the
record of the Public Hearing.
After considering sta tements of the witnesses, and reviewing the pertinent documents, th e
m embers of the City Planning and Zoning Commission made the following Findings and
C ot>cl usions .

FINDINGS OF FACT
THAT the request to rezone the property from MU-R-3 -B Mixed-Use
Residential/limited Office-Retail Di strict to Planned Unit Development was fil ed by
Dawn Sheph erd of the Englewood Housing Authority on M ar ch 7, 2006.
THAT Public Notice of the Public Hearing was given by publication in the
Englewood H erald on April 7, 2006.
3. THAT the property was posted as required, said posting setting forth the date, time,
and place of the Public Hearing.
4. THAT Senior Planner Langon testified the request is for approval to rezone the
property from MU-R-3-B Mixed-Use Residential/Limited Office-Retail District to
Planned Unit Development. Ms. Langon testified to the criteria the Commission
must consider when reviewing a rezoning application . Ms . Langon further testified
th at Staff recommends approval of the rezoning app li cation with conditions.
5. THAT testimony was received from the applicant team, Ms. Dawn Shepherd and
Mr. O tis Odell.
6. THAT tes tim ony, both supportive and in opposition, was received from residents
regardi ng the proposed redevelopment of the site . Concerns were voiced about
impacts anticipated from traffic, building heights and property va lu es.
7. THAT the application is in conformance with the Comprehensive Plan and the
Unified Development Code.
8. THAT the application is consistent with adopted and generally accepted st andards
of development in the City .
9. THAT the application is consistent with the goa ls, objectives, design guidelin es,
policies and o th er ordinances, laws, or requirements of the City.
10. THAT the property cannot be developed under the exis ting zoning without an
unreasonable number of Zoning Variance s or Administrative Adjustm ents .
11. THAT the resulting rezoned property will not have a significant negative impact on
those properties surround in g the rezoned area and that the general public health,
safety and welfare of the community are protected.
CONCLUSIONS
1. THAT the application was filed by Dawn Shepherd of th e Englewood Housing
Authority seeking approval to rezone the property from MU-R-3-B Mixed-Use
Residential/Limited Office-Retail District to Planned Unit Development.
2. THAT proper notification of the date, time, and place of the Public Hearing was
civen by publication in the official City newspaper, and by posting of the property
for the required length of time.

Un it Development be recommend ed to City Council for approval.
The decision was rea ched upon a vote on a motion made al th e meetin g of th e City
Planning and Zoning C.ommission on Apri l 18, 2006, by Ms. Kr ie ger, second ed by Ms.
Mostell er, which motion states:
The Planning Commission recommends th e propo sed zoning change from MU-R-3 -B
Mixed-Use Residential/Limited Office-Retail District to Planned Unit Developm en t for
CASE #ZON200 6-00001 to allow the proposed South Pennsy lvania Street Senior
Housing Plann ed Unit Developm ent to City Counci l for favorable action with the
