Mr. Rothe said the only disappointment this year was that last )-ear'~ Mayor's Choice award winner drln1 even
enter again this year. That was kind or a disappointment, but we are trying to encourage more people 10 enter.

(i) Acting Information Technology Director Flaherty presented a recommendali)n from the
Department of lnforrna'·on Technology lo approve , by mclion , lhe purchase of computer servers , vir ualizahon
software , storage Iech11ology, and related implemen tation services from LongView Sys tems in the a nount of
$336,089.00. He said th is item comes forward as a project that Information Technology, in particul, r Don Ingle,
prior to I-.aving, had been working on pretty extensively for lhe better part of lhis year. This entails t 1e
replacement of a number of servers that the City currently has, lo operate our numerous technology h,form;;tlon
systems . New technology allows for what they call virtual server utilization. whereas we can elim im:te a grea t
number of servers . We currently have nearly 50 servers . We'll be cutting that down to something on lhe
neighborhood of four lo five servers. At one time , each of the various applications that the City owm,d that were
provided to us with our lnformalion Technology services, sue :, as our Finance and HR system , req ui ·ed th:it we
only put the ir software on an individual server. Through current te chnology, it has been proven, lhat we can
virtually separate those software appllcallons, so lhal !here Is no intermingling or problems between 1arious
different software applications being provided on one server , The primary benefit to this is a large savi ngs .
We'll be replacing our current servers with new servers. our existing fleet of nearly 50 servers with 5 11ew
ser,ers , and the required application software th.,t allows for this v1rtualization . The payback on lh is
$336,000.00 is 16 .5 months and, of that , $243 ,000 .00 is In lh e form of IT capital replacemen t costs fe r servers
and the balan ce is for other general fund expenditures . which include IT system adminis tr alion and
maintenance, as well as a very large power consumplion savings th~t we will be able to rea lize ongoi1,g , We

Council Member Jefferson said my next quest ion Is about the provider there I noticed that we had some
cornparables fo, people doing each of these services, but It seemed like there was no o ther provider that had all

Mayor WOOdward said t just want to make a couple of comments. One was, I noticed from the financial mpact,
thal the food,ng for this project was budgeted n the 2007 capttal Fund
Mr Flaherty saod yes tt is aod actually part of rt $139,000.00 ... ,s actually be,ng paod by the Wastewater
Treatment Plant, because !heir applicatoons arc pretty extensive and they WIii be receiving the benefit of this
project as well, and will be paying fo, the~ pro•rata share .
Mayor Woodward said okay. I do have a question, Regarding the L11tleton/Engtewood Wastewater Treatmen t

Mr. Flaherty said that is a budgeting function that Wastewater goes through I'm not sure exactly how they
break this parlicular expenditure out, but under most circumstances Capital Expenditures are 50/50. I can't say,
spOClfically, that this will be handled that way with this particular expeod iture. And to address what Council
Member Jefferson mentioned too, we actually, with the servers that we had, we had excess cap:ic1ly. ti's Just
that prior to server virtualizaloon capab~1toes, we coud nol mix applications on serve ·• So, in fact we have far
more capacily lhan we ever, ever needed, bul because or Ille requirements ol the s, tware pr?Voders, we could
nol run their softwa,e mixed with another we could not run lwO applications on one S8fVer. Now with the
technology, they can virtually dMde that server, so that the software can legaly run on lhe same server

decorat ing awards . I know, hav ing partic ipated in that in the past, it is fun for the members and I thin k it is
certainly fun fo r the cil izens and residents that participate in that.
(ii) Mayor Woodward said Saturday night I gol lhe opportunity to en joy , over al Hampden
Hall, Gifts of th e Magi that has o, ~n runn ing for the last couple of weeks . It was a musical play and it ,snow
over, but it was really fu n.
(iii ) Mayor Woodward said I would like lo talk to Council or discuss wit h Counc il, ou r
Donor's Fund . or in our Donor's Fund, setting up a part of our Donor's Fund . an account that wou ld be specified
for med ical expenses for our late Mayor Olga Wo losyn . Th is wou ld g,ve people lhe opportun ity to be ab le lo
donate to that fund . II Is my understand ing that. that may be a lax deductible type or evenl. depending on each
person 's charitable contributions ... depending upon the adv ice from the ir own accoun ta nts . tam not ask ing to
make contributions to that, from the City ... l am ask ing that we set that up through our Donor's Fund . And
maybe Dan, if you want to comment any more or exp lain ii any further, if an ybody has any ques ti ons regar di ng
that.
Counc il Member Jefferson sa id what was the sp ecific use of It? Mayor Woodward said ,t would be o help of fset
the costs of the medical expenses for Mayor Olga Wolosyn ... her doc tor and hosp ital bills were pretty
overwhe lming , So , th is basically gives cit izens , or anybody that would like to, an avenue to make a donation
toward those medical expenses .
Council Member Jellerson sa id what would be the gene ra l advan tage to having 11 as pa rt of the City ra the r than
just be ing tota ll y private ?
City Allorney Bro tzman said it would be a charitable contribution. If you gave money directly to the fa mily ii
wouldn't be a charitable con tr ibution . Counci l Member Jefferson sa id th is would set up as some sort of charity ?
Mr. Brotzman said righ t. Mr. Jefferson said I was just wonder ing if there was ad dit ional ben efit for them to have
this in place ?
Mayor Woodward said no . As I understand it. if they were to do ii persona ll y, then they would go throug h the
expe r 8e of legal fees of sett ing up a 501-JC , or some thing like that, as a charitable donation and a charitable
expense , which would be add ing to the expense at this poinl. And , he said , there is an avenue through the City ,

Funds or any other funds . II is totally separat e accounting .

Habitat for llumanityor Mdro Denver, Inc. (IIFIIMD) is excited ahout a
potenlial new development in 11,e City or Englewood. We have had excel! ~nt
experiences partnering with the City on the hou se we remodeled al 2399 West
Wesley nnd now building duplexes at West Hill side and Vassar. Muny home
sponsors have supported th :sc projects including the South Metro Denver
Realtors Association, Thnvenl Financial, Holy Hammers and individuals.
The families are thrilled about their new homes and living in Englewood .
HFHMD is looking at a similnr project lo the Vassar development locutcd at
Wesl Harvard Avenue where we wou ld partner with the City of Englewood,
Arapahoe County, and home sponsors to build four (4) duplexes, for a total of
eight (8) homes .
HFHMD has signed the contract 10 purchase the property with the closing
schcd,Jlcd for the end of January 2008. AOcr purchasing we will subdivide
the property, tlcmolish the honhc currently on the site and begin selecting
families nnd dohg the archi1et·t11rnl drawings. We expect to complete all
eight homes by the end or200'J.

RECOMMENDED ACTION
The Department of Safety Services, Po lice Division is recommending that City Council a,Jopt a Bill
for an Ordinance authorizing th e Director of Safety Ser.ices to sign and attest to the subgrant
waiver of the Direct Subgrant Award Juvenile Accountab ility Incentive Block Grant.
BACKGROUND , ANALYS IS, AND ALTERNATIVES IDENT IFIED
The Juvenile Assessment Center completed its seventh yea r of operat ion in lune '.?007. TI1e fac il ity
is open 24 hours a day for law enfo rcement. The faci lity is a "one stop shop" fo r yo uth , families ,
an d law enforcement. Since its inception, the Juvenile Assessment Center has provided a multi•
agency focus to th e indi vidl1al needs of at-r isk youth and th eir families . The Ju venile Assessment
Center maximizes lim ited resources and reduces duplication of effor ts across participating agencies.
The Juvenile Assessment Center co ntinues to serve as a single point entry and saves law
enforcement a significant amount of time spent on processing juveniles.
For the Juveni le Assessment Center to provide the leve l of service expected by all ager,cies and
loca l governments, it is expec ted th at an additiona l $464,956 will be requ ired to maintain ope rat ion
through 20 8. Due to the decreases of federal grant funding provided to the Juvenile Assessment
Center, th e Chiefs of Police and Sheriffs of the 18'" Judicial District agreed on the impleme ntat ion of
a funding formula tha t is based upon 50% usage and 50% popu lation. By adopt ing a Bill for an
Ordinance this will allow for on-going yearly Wdivers w it h administrative approval.
FINANCIAL IMPACT
The City of Englewood's matching con tr ibution to the Juvenile Assessment Center for fisca l year
2008 is $14,682.49 which is includ ed In the Safety Services budget.

its permanent facility at the Arnpahoc County Detention Center ,omplex. The facility is open
twenty-fou r hours a da y for law enforcement and Monday through Fr iday from 8:00 a.m. until
7:00 p.m . for the general publk . The facility is n "o n~ stop shop'' for youth, families, and law

AN ORDINANCE AMENDING TITLE 7, CHAPTER 6A, SECTION 4, OF THE
ENGLEWOOD MUNICIPAL CODE 2000 PERTAINING TO HARASSMENT.
WHEREAS. this secuon of the Englewood Municipal Code has not been updated since 198S: and
WHEREAS. the current ordinance limits the effectiveness of prosecuting indi\'idWlls engaged in
acts of Domestic Violence specifielllly when the suspec1's actions do 1101 meet the definition of an
assault. or menacing nor do they involve the use of a telephone: and
WHEREAS. the current I lornssment onhnancc does not take into accounr the use of computers,
pcnc,nal dnta assistants and other electronic communication devices and their applielltion which can
be used to send harassing messages 10 others: and
WHEREAS. the passage of the proposed Ordinance would clarify nod greatly enhance the ability
to properly prosecute domestic violence= where the underlying focts indicate harassment or
stalk.mg by an offender: and
WHEREAS, the passage of this proposed Ordinance will update the City's Harassment Ordinance
and adopt ponions of the Colorado Revised Statutes 10 clarify and strengthen the City's prohibitions
regarding Harassmenr and Stnlking:
NOW, THEREFORE. BE IT ORDAINIED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD. COLOlv\DO, AS FOLLOWS:

COUNCIL GOAL AND PREV IOUS COUNCIL ACTION
The current Harassment Ordinance was last amended In 1985. No oth er Council action has
occurr ed regarding the current Ordinance since tha t time.
RECOMMENDED ACTION
Recommendation to adopt a Bill for an Ordinance authorizing the amendmen t of Til le 7, Chap ter
6A, Subsection 4 of the Eng lewood Municipal Code 2000 pertaining to Harassment to bring the
City's ordinance in line with State Statutes .
BACKGROUND , ANALYSIS, AND ALTER NATIVES IDENTIFIED
The cur rent Ordinance limit s the effect ive ness of prosecu tin g individuals engaged in acts of
Domestic Vio lence. Specifically when the ac t does not arise 10 an a!sault, menaci ng or under the
current Ordina~ce the use of a telephone. During a tria l the defendant was charged with
ha rassment wh~re the defendant poured a drink over the victim's head wh ile the vic tim was al the
hospital , and holding the couples newborn. Since the victim was not st ruck, no r fell pain, assaul t
was not approp ria te, nor was the victim threatened by the defndant, and menacing could no t be
charged. This left ha rassment as the only cha rge, and the City was unab le to prove that the victim
would have acted in a violent or disorderly manner due to the fac t tha t the victim was holdi ng the
newborn .
In add ition, the current Ordinance does not take into account the use of computers, persona l data
assistants, and other electronic communi ca tio n device s ar1d their app lication which can be used to
send harassing messages to others.
The cu rr en t City O rdinance Is lim ited in its scope, and th e amendmen ts would narrow and specify
prohibited behav ior, especiall y in the arena of Domestic Violence cases .
There are no alterna tives identified.

(b) A person commit> stalking if directly, or indirectly 1hrougli another person, such
person know ingly:
(I) Mnkcs :i credible th~nt 10 another person nnd, in connection with such thrca1 ,
repeatedly follows, appronches. coni;,cis, or places under surveillance that person, ,
member of that person's immed iate family, or someone with whoni that person has or has
hod a con tinuing relationship; or
(ll) Makes • credible lhreat to anod1er person and , in connection with such d1rea1,
repeatedly makes nny fonn of communica1ion with 1ha1 person,• member of that person's
immedi::ite family, or someone with whom that person has or has had a con tinuing
relntionship. regardless of whether a conversation ensues; or
(Ill) Repeatedly follows, approaches, cootacl>, places under surveillance, or makes nny
form of communicati on with ano1hcr person, a member of thot person's immediate family,
or someone with whom that person has or has had a continuing relationship in a manner that
would cause a reasonable person to suffer serious emotional distress nnd does cause tho:t
person, a member of tha1 person's immt!dinte famil y, or someone with whom lhat person
has or has had a continuing relationship to suffer serious emotional dis1ress. For purposes •
of this subparagraph (Ill), a victim need not show that he nr she received professional
treatment or counseling to show lhat he or she suffered ser'.ous emotional distress.
(c) For 1he purposes of this subsection (4):
(1) Conduct "in connect ion with" a credible threat means aclS which funhcr, advance,
promote, or have a continuity of purpose, nnd may occur hcfore, during, or after lhe cr«lible
lhreat;
(II "Credible threat" means a threat, physical ac1ion, or repealed cond ur1 thn1 would
cause o reasonable person to be in fear for the. person's safety or the safety of his or her
immedia1c fam ily or of oomcone with whom lhe pernin has or has had a continning
rela1ionship . Such threat need not be directly expressed if lhc lotalily or the conduct would
cnu~ D reasonable pcrsoo such rcnr.
(Ill) "Immedi ate family" includes lhe person's spouse nnd lhe person's parent. grand•
paren t, sibli ng, or child: and
(IV\ "Repeated" or "repeatedly" means on more 1han one occasion.
(5) Where a person commit.! stulking under paragraph (b) of subsection (4) of 1his
section, the following shall apply:
(a) A person commlls • class 5 felony for a first offense.
(a.5) For a seoond or subsequent offense, if suc h offense occur.; within seven years of
lhe dale of a prior offense foe which such person was convicted, the offender commilS ,
clnss 4 felony.
(a.7) Stalking is an exlmordi nary risk crime lhal is subjec1 to lhe modified pr,,umptive
senlencing range specifi ed in section 18-1.3·401 (10).
(b) If, •t 1he time of lhe offense, lhere was a temporary or pcnnanent protection order,
injunction, or condhion of bond, probation, or po.role or any other court order in effect

ordinance would formalize a propOSol from the Der,d, .:nent of Safety Services to re-establish a
separate Police Department and a Fire UepartmenL
BACKGROUND, ANALYSIS, ANO ALTER NATIVFS ID ENTIFIED
The retirement of the Director of Safety Sef\'ices on 2007 presented an opportunity to review the
organizationa l structure and goals of the Police and Fire Divisions that were consolidated under the
Department of Safety Services In 1989. During the 2008 budget process, the separation of the
Depa rtment of Safety Services Into separate Police a nd Fi re Departments was suggested. The City
Manager directed that current Safety Services management \taff proceed with a prellminary pla11 for
this reo rga nization for presentation 10 City Council. A committee was formed to identify Issues
related to the proposed reorganization. Are Oper,•i ns Division O,ief Michael Pattarozzl was
ass igned to chair the comm ittee comprised of memJers from the Police and Fire Divisions, the City
Manage,'s Office, Information Technology, and the 11uman Resources Department. The flndings
and recomm~:,datlon were presented to City Council on December 3, 2007.
FINANCIAL IMPACT
Approximately 570,000 was res~rved, from the S 170,000 savings realized by elim,natlon of the
Director of Safety Services posi tion, In the 2008 genera l fund budget for the Department of Safety
Services to pay for all costs associated with the reorganization. To date the total cost iden tified with
the re-organi zati on Is $33,879 .

Services in police contracts. The Fire Chief shall address all issues rela1ed to the
Director of Safety Services in fire contracts. In circumstances where it is unclear
whether the subject is that of police or fire the City Manager shall be dcsigna1ed and
shall resi,lvc all issues 10 the contract.

ext inguish, aher, modify, or change in whole or in pan any penally, forfeiture, or
liability, either civil or criminal, which shall have been incurred under such provision,
and each provision shall be treated and held as still remaining in force for the p111p0ses
of sustaining any and all proper actions, suits, proceedings, anJ prosecutions for the
enforcement of the penalty, forfeiture, or liabili1y, as well as for the purpose of
sustaining any judgment, decree, or order which ran or may be rendered, entered, or
made in such actions, suits. proceedings, or prosecutions.
