conversat,on that you had with , I think ,twas Peggy Cote, of the Littleton City Council, regarding meeting length

over the last year. that have gone past midn,ght, well past midnight. and there were a handful lhal went very

member of this community has the nghl to know how you obtained that dec1s1on and how tne process was
followed throughout that procedure Voting on five top .s or four loplCs all al once undei one vote thats not
conduave to keeping the commun,ty rnvolved wit~ the procedure~ and the processes that City Council follows

spent quite a bit of time on the 7,000 and the definition of the weight and the Tratric Coide

Jeffarson said yes , you can gel them from your local merchanls, If you shop at any of the local stores. Mayor
Woodward said BID stores? Council Member Jefferson said yes , any 810 store will have them. Aflhough there
are a limited amount being put out there and so the merchants are a ltlUe b1l discretionary as to who !hey give
them loo Some of their better customers Is kind of the Idea people nol In the area is kind of lhe idea Council

I have searched this bill thorough!) to try and find the verbiage that included. Grand
Fathering, Subject to new permit requests. or any comments that clarifies or states that
this Council Bill would not afTect our residents that presently have dri veways that would
not fit the new requirements of this Bill. Aller much consideration, speaking with othe r
residents. and even legal council. I am left \\ ith only one thought abou t this Bill and that
is that the Council Bill #79 is anempting 10 do the following:
1.) Punish well-intentioned and la,1-abiding citizens who have done nothing
wrong by mandating that they "Improve"' their driveways implying that they
did not meet some delegated public standard. h must be noted Lhat to thi s
point. oth er than 10 some on this co uncil. the se ci ti zens have met ull zoning
requirements. broken no city rules. have been good citizens of this cit). and
faithful tax payers.
:?.) Make Englcll'ood similar to a ··Covenant Controlled" commu nit y where
excessive rules and regulations arc forced upon its residents. The issue "ith
this is that many people huve mo\'ed to Engle" ood because it was not
'"Co1·cnan1 Contro ll ed" and there was free dom 10 live a lifestyle that met the
homeowners desire,, ithin reason. This includes buying propenies that did not
have paved drives.

This is a ridicules request. This bi ll would make it Illega l to work on yo ur mothers or fathers car. And now
it would be illegal to take any compensation. Then lets add. It is illegal 10 help a Neighbor in need for any

(I) The sale of goods or merchandise at a City-approved or sponsored event; or
(2) Use of a motor vehicle, trailer, or shipp ing or storage container in connection

Desi gn Group, hereinafter referred lo as the "Consultant", party of the second part, for
the following :
PROJECT : Englewood Downtown and Medical District Master Urban Design and
Publlc Improvement Plan
WHEREAS, a proposal pursuanl to said project has been received by the City of
Englewood and reviewed by the Director of Community Development; and
WHEREAS. the Contract has been awarded to the above named Consultant by the City
and said Consultant is now willing and ab le to perform all of said work in accordance
with his proposal.
NOW THEREFORE, in consideration of the compensation to be paid to the Contractor,

A Contract Documents: It 1s agreed by the par1ies here to that the followli ·g list
of lnslruments, drawings and documents which are attached hereto, b ,und

drawings, and documents taken together as a whole constitute the Contract

a lawful Cour1 Order directing such disclosure. All docu ments provided by the
C ty to Consultant shall be returned to the City. Consultant is authorized by the
C.ty to retain copies of such data and materials at Consultant's expense.
C Scope of Services: The Consullant agrees to and shall furnish ;,'I labor, tools,

the negligent act or omission , error, professional error, mistake, accident, or

F. Ownership of Work Product : Upon payment to Consultant pursuant to this •
Agreement, all work, drawings, designs, plans, reports , computer programs (noo-
proprietary), computer Input and output, analyses, maps, or any other materials
developed for this project ;,rP and shall be tt>e sole and exclusive property of the
City However, any reuse of the documents by the City without prior written
authorization by Consultant other than for the specific intended purpose of this
Agreement will be at the City's sole nsk . The Consultant will provide the City with
a ten (10) day written notice prior to disposal of project documents II has retai ned
during which time the City may tal<e physical possession of same al the storage
Sile.
G. Terms of Payment. The City agrees to pay the Consultant for the
performance of all the work requ ired under this contract, and the Consultant
agrees to accept as his full and only compensation therefore , such sum or sums
of money as may be proper In accordance with the price or prices set forth in the
Consultant's fee schedule hereto attached and made a part hereof. the total cost
thereof not to exceed Fifty-one Thousan d and Five Hundred Seventy-five
Dollars ($5 1,575 .00).
H. Appropriation of Fund s: At p resent, $51 ,575.00 has been appropriated for

contra ry, in the event no funds or insufficient funds are approp riated and
bu dgeted by the governing body or are oth erwise unavailab le by any means •

work documents shall be transferred to and become the sole property of the City
prior to payment for services rendered .
I. Contract 81nd 1ng: It Is agreed that this Contract shall be bind ing on and inure

and successors.

K. Terminat,on and Assignment of Contract The Consultant warrants that it has
not employed or retained any company or person, other than a bona fide

prior to entering into this Contract. Contracto r further verifies. Contractor will

knowledge that a subcontractor performing work under this Contract knowingly
employs or contracts with an Illegal alien, the Co ntractor shall;
( 1) Noti fy the subcontractor and the City wllhin three days tho I the
Contractor has actual knowledge that the subcontractor is employing or
contracting with an illegal alien; and
(2) Term inate the subcontract with the subcontractor if, within three
days of receiving notice that the Contractor has actual knowledge that the
subcontractor Is employinq or contracting with an illegal ahen. the
subcontractor does not sto., employing or contracting wllh the Illegal alien.
