AN ORDINANCE AUTHORIZING THE CITY OF ENGLEWOOD , COLORADO
TO OPT-OUT OF MUNICIPAL CANDIDATE NOMINATION VACANCY
PROVISIONS AS SET FORTH IN THE MUNICIPAL ELECTION CODE OF THE
COLORA DO REVISED STATUTES.
WHEREAS, Co lorado Statute, Title I is the "U niform Election Code of 1992" and
Title 31 , Article 10 is the "Co lorado Municipai Election Code of 1965 "; and
WHEREAS, when the City of Eng lewood particip ates in a coordinated election the
City follows Title I, which refers to Title 31 for the municipal nomination petition
proc edure s, with the exc eption of 1-4-8 05 C.R.S. which establishes the circulation date s
for nomination petitions and 1-4-1101 C.R.S . concerning write-in candidate affi davit s;
and
WHEREAS, 1-4-805 C.R.S. provides that municipal candidate petitions "may be
circulated and signed begi nning on th e ninety-first day prior to the election and shall be
filed with the municipal clerk no later than the scvcnt :, fi rst day prior to the date of the
el ection "; and
WHEREAS, the Governor has signed Senate Bill 05-206 which provi des fo r the Ci ty 's
ballot being certified to Arapahoe County by the 60'h day prior to an election ,
l-5-203 (3)(a) C.R.S.; and
WHEREAS, this leave s nine days for the City to comply with the vacancy provi sions;
and
W. I REAS, the Colorado Municipal Clerks Association, working with Colorado
Munic,, "! League, is in the proce ss of preparing a bill to take forward that wo uld address
various election iss ues and they arc working to dctcnnine if there is any reason to re tain
or amend tht vac ancy provi sions at the municipal level; an d
WHEREAS , at their June 8, 2005 meeting th e Englewood Election Commission
revi ewed the vacancy provisions and recomm ended that the City "el iminate vacancy
provisions until such time as State St at ute s arc amende d to pro vide a timeframe that
accommodate s the res olution of deadlines and ot her issues''; and
WHEREAS , The Englewood Home Ruic Charter provision regarding vacancies on
Co uncil shall be appli cable;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ENG LEWuOD , COLORADO , AS FOLLOWS :

(CML), is in the process of prepa rin g a bill to take forward that would address va rious elec ti o n
iss u es. Th ey will b e workin g to determin e if th ere is, ind ee d, any reason to retain th e vaca ncy
commillee provisions al a muni cipal level. If so, th ey w ill recom m c~d th at th e dead lin es be
am ended.
