MUNICIPAL CODE 2000 BY CLA RIFYING TH E POLICY FOR ALLOW ING PROPERTY
OWNERS TO ··OPT-OUT " OF THE CONCRETE UT ILITY PROGRAM AN D CLARIFY IN G
THE PRIORITY FOR CREDITING UTILITY PAYMENT .
WHEREAS . when the Co nc ret e Util ity was adopted , a voluntary "opt-out"
provision was incl uded to ensure the program being crea ted would function as a ut ility
and not as a t.:ix; and
WHEREAS , to p· :vent property ow ner s from abusi ng the Concrete Utility and
jcopardi ziu g th e viability of th is progra m. it is neces sary to add an addi ti onal
proviiion to th e Co ncrete Utility; and
WH EREAS. th e City"s "opt ou t" provision should not be availab le after the
concre te utilit y has perfonncd wo rk on or adjacent 10 the property; and
WHEREAS . the City wishes to cla rify th e sta tu s of funds and priority for
application of such funds paid on the City of Englewood Utilit y bills;

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
In A ugust, 2004, City Council passed Ordinance No. 41 amending Article 12-8-12 of th e Englewood
M unicipal Code. This o rdinan ce was adop ted in ord er to prevent property owners fr om
j eopardizing th e viability of th e Concrete Utility Program by executin g a non-pa rti cipation
ag re ement after work had bee n performed to the right-of-way conc rete adjacent to their property .
RECOMMENDED ACT ION
A pprove a Bill fo r an Ordinance amending Article 12-8-12 F of th e Englewood Municipal Code
adding a section to clarify th e "opt-out" provisions .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
Upon fur th er rev iew of Ordinan ce No. 4 1, staff has id entified conditi o ns in th e o rdin ance th at nee d
to be addressed to protec t th e Concrete Utility Program 's via bility. Th e original intent of the
program crea ted a funding mec hanism fo r repair of th e :ity's ag ing concrete th at ben efits th e
co mmunity as a whole. The moni es paid in by prope rty ow ne rs mimi cs an insurance policy crea tin g
a fund that all ows th e City to repa ir th e conc rete at an individual's property. In most cases, it w ill
take a singl e propert y years to offset th e cos t of th e repai r work don e.
Refl ec tin g City Coun cil's recommendat ion, Section F w ill be revised to sti pu late th at a property
own er will not be all owed to ex ecut e a no n-p arti cip ati on agree men t afte r work has bee n periormed
on th e right-of-way co ncrete ad j ace nt to th eir property. With thi s modification, th e Concrete
Utility's viabi lity will be pro tec ted .
Ad diti onall y, th e o rdinance is b eing amended to specify the paymen t appli cati on order of the
vari ous charg es so th at pa yments wi ll be appli ed to sa ti sfy st o rmwat er charg es, Concrete Uti lity
charges, sa nitary sew er charges , and wa ter fund charges , re spectively, th rough th e Util ities
D epar tm ent hi lling sy st em. Thi s w ill eliminate th e poss ibility of prope rt y owners making partial
payment to their Utilities bi ll w ith th e expec tati on th at th e Concrete U tility portion wi ll go unpaid .
FI NA NCIAL IMPACT
Th e Concrete U tility Program will remain finan ciall y viabl e with th ese amendmen ts in place. •
