AN ORDINANCE AMENDING TITLE 2, CHA PTER 12, SECTIONS 3 AND 6, OF
TH E ENGLEWOO D MUNICIPAL CO DE 2000, PERTAINING TO TI-IE TE RM OF
TI-IE TRANSPORTATION ADVISORY COMM ITT EE .
WHEREAS, the Engl ewood Transportation Advisory Comrr,ittee (ET AC) was
estab li she d with the adoption of Ordinance No . 65 , Series of200 1; and
WHEREAS , ETAC was established as an advisory committee to Englewood City
Co un cil for th e purpose of gathering citizen input, reviewing , monit oring and making
recommendations to City Council regarding transportation iss ues in the City of
Englew ood; and
WHEREAS , increasing the term limi ts fr m two years to four yea rs and increa sing the
ET AC officers term from one year to two years would facilitate tho comple tion of
projects that could potentially be length y and provide more contincily in transpo rt ation
projects with which ETAC dzals; and
WHEREAS, the Englewood Transportation Advisory Commi !',:e unanimou sly
passed motions to increase member and officer terms at their Ja,1t•.l:-l 13, 2005
meeting;
NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNC IL OF TH E CIT Y
OF ENGLEWOO D, COLORADO, AS FOLLOWS:
~. The City Counc il of the City of Englewood, Co lorado hereby amends Titl e
2, Chapter 12, Section 3, of the Englewood Municipal Code 2000, to read as fo llow s:
Chapter 12 TRANSPORTATION AOVISORY COMM ITTEE
2-12-3 : Terms of Members .
Memb ers will be appo inted to over lapping term s of~ li!l!f-® years. The City
Co un cil shall make appoi ntm ent s to fill vacancies fo r unexpired terms.
~-Th e City Counci l of the Ci ty of Englewood, Co lorado hereby amends Tit le
2, Chapter I 2, Sec ti on 6, of th o Englewood Municipal Code 2000 , to read as follows :
2-12-6 : App oi ntment of Officers and Adoption of Rule s.
A. Th e committee shall organi ze, adop t admini strative rul es and proc edures and
elect from its member s s1Jch offk:crs as it shall deem neces sary to acc omplish
it s purposes. Officers of th e committee sha ll be elected for a ooe-f1+-~
yea r term . No officer shaH s..:rvc in th e sam e capacity fo r more th an two (2)
consecu ti ve term s.

B. Th e Chairp erso n may app oint such stand ing or spec ial sub -commi ll cc s fr om
th e memb ership of th e co mmittee as the committee shall det ermi ne
necessary or useful in carryi ng out it s purposes and powers. The purpose, term
and members of each s ub-committee shall be determined by the C hai rperson .
~-Safety C lauses . The City Cou nci l hereby rind s, determ in es, and
declares th at thi s Ordinance is promulgated under the general police power of th e C it y
o f Eng lewood, that it is promulgated for th e hea lth , safety, and we lfare of the public ,
and th at thi s Ordinance is nc cc'-:s ary for the preservation of hca' . and safety and for
the protection of publi c conveu icncc and welfare . The City Co 1.111ci l further

~-Effect of rep eal or modjfjeatjon The repeal or modirication o f any
provision of the Code of the City of Englewood by this Ordinance shall not rele ase,
extingui sh, alter, modi fy, or change in whole or in part any penalty, forfeiture, or
liability, either civil or crimin al, which shall have been incurred under such provi sio n,
and each provision sha ll be treated and held as still remaining in force for the
purposes of sustaining any and all proper actions, suit s, proceedings , and prosecutions
for the enforcement of the penalty, forfeiture, or li abi lity, as well as for the purpose
of sustainin g any judgment, decree, or order which can or ma y he rendered, entered,
or made in such actions , suits, proceeding s, or pro secutions .

eac h and every violation of thi s Ordinance .

BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The En glewood Transportation Advisory Committee (ETAC) was es tabl,;,1e d in 2001 as an adviso ry
committee to Ci ty Coun cil fo r th e pu rp ose of ga th er 1ng citizen in pu~ reviewin g, m o nitorin g, an d
m akin g recommen da ti ons to City Counc il regardin g transpo rtatio n iss u es in th e City of Engl ewood.
Currently, ET AC m embers are appoi nted to serve two ye ar terms ; offi cers serve terms of o n e yea r.
ET AC m em bers believe tha t four yea r term s woul d be helpful in fac ilitatin g th e completion of
proj ec ts that co uld p o tenti all y b e len gth y, and w ould p rovide more co ntinu ity in transport ati on
p roj ec ts w ith w hich the co mm itt ee dea ls; li kewise, two year officer term s would offer th e sa m e
b enefi ts. O n Jan uary 13, 2005, ET AC una ni mous ly passe d motions to increase m ember an d officer
term s. D iscuss ion con tin ued for se ve ra l m onth s rega rding the poss ibility of also inc reas ing th e
number o f members fr om fi ve to seve n. U ltimately, ET AC members rej ected th at pro posa l,
b eli ev i ng it would no t be nefit th e com m itt ee at this tim e.
