WHEREAS, the United States Govcnunent, through th e National Affordable Hou sing Ac t of 1990 , ha s established the HOME In ves tment Partn erships Program and has allowed each sta te to elect to adminis ter suc h federal funds , subject to certain conditions, fo r decent, safe , san itary and affo rdable housing; and WHEREAS, Arapahoe County has elected to administer such feder al funds; and WHEREAS , the Englewood City Council pas sed Ordinance No . 62, Series of 2003 authorizing the execution of an intergovernmental agreement for the Federal HOME Investment Partne rships Program wi th Arapah oe County for $100,000 to support the Housing Rehabilitation Loan program ; and WHEREAS , Englewood City Council pa sse d Ordinance No . 7, Series of 2004 authorizing Amendment Number One to the inte rgovrmmcntal agreement for the Federal HOME Inve stment Partnerships Act with Arapahoe County for an additional grant of $50,000; and WHEREAS, the City of Englewood ha s been awa rded an adJitional gra·,,i of$ I 50 ,000 increa sing the total grant to $300,000 to provide funding for it s low and moderate income homeowners for rehabi lit ation of at least 25 single-family , owner-occupied homes ; NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF ENGLEWOOD, COLORADO , AS FOLLOWS: Section I. HOUSING REHABILITA110N Thi s Amendment is made by and between the City of Englewood (SubGrantec) and the Board of Co unty Commissi oners of Ara pah oe Co unty , Colo rad o (County). WHEREAS , the SubGrantee agreed to complete the project known as Housing Reh abilitation, and entered ioto a HOME Investment Partnerships Act Agree ment (Agree ment) with Cou nty , dated Oc tober 2, 2003 ; and WHEREAS, the County and SubGrantee would like to mod ify the project goals and budget in order to reflect an increased funding amount ava ilable to the project; and WHEREAS, th e SubG rantee has requested a waiver to the maximum HOME investment per house specified in the County's lead based paint policy for housing rehabilitation projects. NOW, THEREFORE, for the murual consideration of the parties , the receipt an d sufficiency of wh ich are here by acknowledged , the County and SubGrantee agree to increase the total project funding amount by an additional SI 50,000 .00 to 5300 ,000 .00 . The County and SubGrantee further agree that the project quantifiable go als shall be as follows : The SubGrantee will provide below market intere st rate loans to twenty-fi ve (25) inc ome eligible Englewood • homeowners for the purpose of home improvements . Specific rehabilitation activi ties funded by the program may include (but are not necessarily limited to): plumbin g, eleo uical, ramps and oth er accessibility modifications, roofs , strucrural work, and other activities related to health , safety or cod e co mpliance . All improvements funded under this grant are to be performed in co mpliance with applicable local or industry codes snd standards . • The Co unty and SubGrantee also agree that the total amount of HOME funds used to ass ist a sin gle home under this project may not exceed S24 .999 . Th;, amoun t incl udes any HOM E fu ndin g used fo r p•-ojec t based administrative expenses. The County and SubGrantee further a!I">•: that the project budget attached to the original Agreement is co nsidered null and voi d, and the budge t attached htce to is now in effect under the terms of the Agree ment. All other terms , co nditi ons and sec tions of the ori gi nal Agree ment and the Co unty 's policies related to lead based pai nt mitigation not inc onsistent with thi s Amendment are reaffirmed and inc orpo rated herein by thi s reference.
