AN ORDINANCE AUTHORIZING AME NDI NG TITLE 16: UNIF IED
DEVE LOP MENT CODE OF THE ENGLEWOOD MUNI CIP AL CO DE 2000,
THESE ARE HOUSEKEEPING AMENDMENTS .
WHEREAS , Ti tl e lo : Unified Developm ent Code wa s adopted wi th th e pa ssag e of
Ordi nance No. 5, 2004 ; and
WHEREAS , Ordinan ce No . 5, 2004 was the first maj or rewrite of the zo ning and
subdivision re gulati ons in alm os t tw enty years; and
WHEREAS, Ordinance No . 5, 2004 reformatte d, reorgani zed and updated the Code as
well as establishing new regulations ; and
WHEREAS, due lo the complexity of the re organi za tion it was anticipated th at small
overs ight s and errors were inevitable and that a "hou sekeep in g" amendment would be
initiated to correct them ; and
WHEREAS , th is propo sed Ordinance incorporates correc ti ons, omiss ion s and
cln.ri fi cation and also provi de s con sistency with th e other sec ti ons of Title 16;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY
OF ENG LEWOOD , COLORADO, AS FOLLOWS :

C. Board of Adjustment and Appeals.
I. Administrative and Review Role s Under this Title. The Boa rd of
Adju stment and Appea ls ("Board") shall ha ve th e fo ll owing
respon sibi lities in adr. · •istcring thi s Ti tle :
a. Appeals from Building Permit Denials. The Board shall have power to
hear a,d determine appeal s from refu sal of bu ilding pcnl''"
b. Admin is trative App eals . In addi ti on to such other juri sdi ct,v n as
authori ze d by law, the Board shall ha ve the jurisd ic tion and power :

(I) To hear and decide appea ls from and to review any orde r,
rcquircmcnl, decision , or dctcnnination by the Chi ef Building
Official or any em plo yee in the enforcement of this Tit le, or
similar Uniform Co de s adopted by the Ci ty, except th e Model
Traffic Code, nnd 10 hear and dcciuc all matters referred to it , or
upon which it is required to pas s under thi s Title or wy
amendmen t hereto.
(2) In de ciding upon appeals, the Bo ard ma y reverse or affirm,
wholly or panly, or modify any notice , ord er, requirement,
decision, or determination of any emp loyee of the City in the
enforcement of thi s Title, and to make such order , rcouircmcnt ,
decision or dctennination as in it s opinion ought to be· made
and, tn lhal end, shall have all the powe rs of the enforcing
agcn .

c. Zoning Variances . The Board shaU have th e juri sdiclion aud power in
spec ific cases to make specific exceptio ns to the tcnns , or modify th e
st rict applic ati on of the provisions of this Title\ according to the
proc edures within and co nsistent with the general purpose of this
Title .

Title 16, Chap ter 2, Section 2, Table 2.1 of the Englewood Municipal Code _\JOO , to
read rs follows :
16 -2 -2: Summary Table of Admi ni strative and Review Role s.
The fo ll owing table summarize s th e review and decision -maki ng responsibilities of the
entities that have specific role s in the administration of the procedures set fo nh in
thi s Chapter . For purposes of this table , an "(Approval) Lapsing Period" refers to the
total lime from the application's approva l that an applicant ha s 10 pro cee d v. ith , and
oflen comp let e, the approved actio 11. Failure to take th r ·cq uired actio n within th e
specified "laps in g pe riod" will automatica ll y void the approval. Sec Sec ti on 16-2 -3.L

by lhe applicant to develop or alter lhc property as described in 1hc
approve d application before lh e end of lhe lap sing pcriod--or lhc approva l
shall be of no furth er force and cffccl.
2 . Ex tension of Approva l Periods . An app li cant may requesl , and the
decision-making body thal gra nt ed lh c origin al ap prova l may grn nl one (I)
cx len sio n of the approva l fo r a period eq ual lo th e orig in al lapsing period.
Ex tensio n requests shall be evaluated on th e basi s of comp li ance wi th
regulations and policies in effect at the time of the exten sion reque st, and
wi ll be all owed onl y when the fo ll owi ng con diti ons exist:
a. The provisions of this Title or thi s Chapte r mus! not expre ss ly prohibit
th e exten sion : and
b. Th e ext ension reques t mu sl be filed in a form cslablished by 1he Ci1y
and include all ex hibi ts and fee s; and
c . The app li ca nl evidences lhal lhc delay in laking action under 1hc
approval wa s ca used by circumstance s beyond th e applicant's control.

~-The City Cou ncil of the City of Englewood, Co lorado hereby amends
Ti tl e I 6, Chapter 2, Section IO of the En glewood Municipal Code 2000, to read as
follows :
16-2-10 : Major Subdivi sions .
Approval of a Major Subdivision Plat is required whenever a subdivision of land will
require~ the dedication of land for public rights-of-way, -etl9effleftl!t, or public areas.
Approval of a Major Subdivision Plat requires a two-stage process involving
'.I) approva l of a preliminary plat by the Commission, and
(2) approval of a final plat document by the Council. The Minor Subdivision process
in Section 16-2-11 EMC , sha ll app ly where dedication of land is not required and to
certain boundary adjustments and lot consolidations .
~-The City Council of the City of Englewood, Colorado hereby amends
Title 16, Chapter 2, Section 17 , Subsection D, of the Englewood Municipal Code 2000,
to read as follows:
16-2-17: Administrative Adjustments .
D. Permit1ed Adjustmenls .
2 . Scope of Authority--AII Adjustments Except Reasonable Accommodations
Under FFHA . An application for an Administrative Adjustment th at is not
related to a request for "reaso nab le accommodation 11 under th e Federal Fair
Housing Act may request only the following types of adju stments :
a. Side or Rear Setba cks: Adjustments to an y side or rear setback
standard may be pcnnittcd as follows:

b. Principal Dwelling Unit Expansion : Adjustments may be pennitted to
the front and/or side se tback standards for one-unit detached
residential dwellings to allow e.pansion of the principal dwelling's
habitable space to match an existing front setback encroachment as
follows:
(I) The front and/or side se tback encroachment existed on the
effective date of this Title.
(2) The linear frontage of the facade of the expansion shall be less
than or equal to the line.a, frontage of the portion of the
dwelling that already encroaches into the setback . (Sec Figure
16-2(1): C must be le ss than or equal to B.)
(3) The addition or expansion sh all not extend be yond th e front
and/or s ide building line of the principal dw elling (not beyond
the leading edge of the existing encroachment.) However, no
addition or expansion may encroach more than five feet (5')
into the required front se tback . (See Figure 16-2(1): A may not
be greater tl ,a n five feet (5').
c. Exis ting Front Porch: Adjustments may be pcnnitted to existin g,
unenclosed, covered front porches th at encroach into the front
setback, subject to compliance with the following conditions:
(I) The porch encroached into the front setback pri or lo 1he
effective date of this Title .

Spacing of Manufactured Home Dwelling Units on~
~ Lots. Minimum required distances between
manufactured home dwelling units, or additions thereto
enclosed for more than fifty percent (50%) of their
perimeters, shall be the sum of the required distances for the
exposures involved.
( 19) Screening. Adequate protection shall be provided the residents
of the park from any undesirable off-site views or any adverse
influence from adjoining streets and properties . To this end,
the park shall be surrounded by a fence , wall, or planting
screen on all sides abutting er adjeeeel le other private
property, or an arterial street or highway. If a fence or wall is
used, it shall be at least six feet (6') in height and of solid
construction. If vegetation is used in place of a fence or wall ,
it shall be of a nature that provides equivalent protection to
the property and to neighboring property. Notwithstanding
other requirements of this provision, no fence, wall or
vegetative screening shall be permitted to extend into any
required exterior yard al a height or in a manner that
materially impedes the visibility of a motorist exiling from
the park onto a public street.

(I) A maximum of one (I) ground sign is penniued per

(2) The maximum height of a ground sign shall be twenty feet
(20'). The distance between signs on iH1jfteent ~ lots
shall be not less than the height of the taller sign.
(3) If there is more than one (I) business in a building or ifa
group of buildings arc associated by ownership, no ground
signs are pennitted except jnint identification signs.
(4) Where a ground sign bas two (2) or more display faces, only

(5) Ground signs shall not encroach into any public right-of-

BACKGROUNO
Th e adopti on .,, r ,t1 e 16: Unified D evelopm ent Code in Febru ary 2004 was th e fir st maj or rewrit e of
zoni ng and subdi vision reg u la ti ons in almost 20 years. Th e p roj ec t reformalled, reo rga ni zed, and
upda ted th e Co de as we ll as es tablished new reg ulati on s. Due to th e compl ex ity of th e
reo rgani za ti on, it was anti ci pated th at small overs ights and errors we re in ev itabl e and th at a
"house kee pin g" am endment would b e i ni ti ated to co rr ect th em. Over th e pas t ye ar, staff identifi ed
num ero us amendme nt iss ues or to pi cs th at we re reviewe d and co nsid ered by Plannin g an d Zo ning
Commiss ion durin g multi p le study sess ions.
