WHEREAS , Ti tl e lo : Unified Developm ent Code wa s adopted wi th th e pa ssag e of Ordi nance No. 5, 2004 ; and WHEREAS , Ordinan ce No . 5, 2004 was the first maj or rewrite of the zo ning and subdivision re gulati ons in alm os t tw enty years; and WHEREAS, Ordinance No . 5, 2004 reformatte d, reorgani zed and updated the Code as well as establishing new regulations ; and WHEREAS, due lo the complexity of the re organi za tion it was anticipated th at small overs ight s and errors were inevitable and that a "hou sekeep in g" amendment would be initiated to correct them ; and WHEREAS , th is propo sed Ordinance incorporates correc ti ons, omiss ion s and cln.ri fi cation and also provi de s con sistency with th e other sec ti ons of Title 16; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF ENG LEWOOD , COLORADO, AS FOLLOWS : ~. Zoning Variances . The Board shaU have th e juri sdiclion aud power in spec ific cases to make specific exceptio ns to the tcnns , or modify th e st rict applic ati on of the provisions of this Title\ according to the proc edures within and co nsistent with the general purpose of this Title . ~-The City Council of the City of Englewood, Colorado hereby amends Title 16, Chap ter 2, Section 2, Table 2.1 of the Englewood Municipal Code _\JOO , to read rs follows : 16 -2 -2: Summary Table of Admi ni strative and Review Role s. The fo ll owing table summarize s th e review and decision -maki ng responsibilities of the entities that have specific role s in the administration of the procedures set fo nh in thi s Chapter . For purposes of this table , an "(Approval) Lapsing Period" refers to the total lime from the application's approva l that an applicant ha s 10 pro cee d v. ith , and oflen comp let e, the approved actio 11. Approval of a Major Subdivision Plat is required whenever a subdivision of land will require~ the dedication of land for public rights-of-way, -etl9effleftl!t, or public areas. Approval of a Major Subdivision Plat requires a two-stage process involving '.I) approva l of a preliminary plat by the Commission, and (2) approval of a final plat document by the Council. The Minor Subdivision process in Section 16-2-11 EMC , sha ll app ly where dedication of land is not required and to certain boundary adjustments and lot consolidations . ~-The City Council of the City of Englewood, Colorado hereby amends Title 16, Chapter 2, Section 17 , Subsection D, of the Englewood Municipal Code 2000, to read as follows: 16-2-17: Administrative Adjustments . D. Permit1ed Adjustmenls . 2 . Scope of Authority--AII Adjustments Except Reasonable Accommodations Under FFHA . An application for an Administrative Adjustment th at is not related to a request for "reaso nab le accommodation 11 under th e Federal Fair Housing Act may request only the following types of adju stments : a. Side or Rear Setba cks: Adjustments to an y side or rear setback standard may be pcnnittcd as follows: -7- ERMITTED ADJUSTMENTS TO IDE OR REAR SETBACKS feel feet feet feet Inches t foot tloot feet b. Principal Dwelling Unit Expansion : Adjustments may be pennitted to the front and/or side se tback standards for one-unit detached residential dwellings to allow e.pansion of the principal dwelling's habitable space to match an existing front setback encroachment as follows: (I) The front and/or side se tback encroachment existed on the effective date of this Title. (2) The linear frontage of the facade of the expansion shall be less than or equal to the line.a, frontage of the portion of the dwelling that already encroaches into the setback . (Sec Figure 16-2(1): C must be le ss than or equal to B.) (3) The addition or expansion sh all not extend be yond th e front and/or s ide building line of the principal dw elling (not beyond the leading edge of the existing encroachment.) However, no addition or expansion may encroach more than five feet (5') into the required front se tback . (See Figure 16-2(1): A may not be greater tl ,a n five feet (5'). c.
