nonconfonning structures stated in Chapter 16-9 EMC,
"Nonconformities ."

centerline of the alley meet. The dist ance from this point shall be
twenty -five feet (25 ') along the street curb line (''B") and twenty -fi ve feet
(2 5') along the alley cente r line ("A"). The th ird side of the triangle ("C")
connects these two sides, creatin g the sight distance triangle . Figure
16-6(5) shall be used to determine cros s-comer vis 'bility al streets and
alleys.

feet (3') '.n height above grade shall be permitted within the ten .feel .flilll
(10') sight distance triangle created at the intersection of a driveway and
street. Figure 16-6(7) shall be used to determine the visi bility at driveways
an d residential streets. When no sidewalk exists, the sight triangle shall be
determined by the City Traffic Engineer .

approval of th e propos ed amendments to City Council.
• RECOMMENDED ACT ION
The Community D evelopment D epartm ent recommends th at Council adopt a bill for an ordinance
approving amendment s to th e City's Fence Ordinance, Municipal Code 16-6-6: Fenc es, Walls and
Visual Barriers.
Staff also reques ts th at Co un cil schedu le a p ublic h ea rin g on May 16, 2005, l o take public comm ent
on th e proposed amendments.
BACKGROUND
Ph ase 1 of th e Unified D eve lopment Code (U DC) proj ec t focused o n a ge neral update and
reformatting of City zon in g regulations. More detailed updates of maj or sec ti ons of the Code are
p lanned in Pha se 2. Sin ce August 2004, th e Pl anning and Zoning Commission has co nduc ted
seven study sess ions on proposed amendments to Municipal Code 16-6-6: Fences, Wall s and
Vis ual Barri ers. Th e Commi ss io n focused o n clarifying and simplifying ex istin g regu lations and also
ad dressed permi tt ed materials and co rner lot fencing issues at th e req ues t of Ci ty Counci l.
City Coun cil reviewed th e proposed ame ndments durin g th e March 7, 2005 Study Sess ion. Though
th ere we re no su bstantive amendments proposed to ex isting subsection M unic ipal Code 16-6-6:D 3
Garage 1:ntrance/All ey Sight Distance Triangle, Cou ncil req ues ted th at th e reg ul ation be deleted
fr om th e l,JC because it r:aus ed many ex istin g fences to be cons icl erec..' nonco nformin g an d \vo uld
