fo r Phase One of th e Sinclair Baske tb all & In line Hocke y Rink project throu gh th e 2005

WHER EAS, Arapahoe Co unt y Open Space Funds for Phase ·1 wo (i nlinc hockey rink)
funds will be req ues ted in the 2006 Budget : and

Responsibility Between The City of Englewood and Englewood School District ;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNC IL OF THE
CITY OF ENGLEWOO D, COLORADO, AS FOLLOWS:

AGREEMENT
DEFINING JOINT RESPONSIBILITY BET WEEN THE CITY OF
i,.3GLEWOOD AND ENGLEWOOD SCHOOL DISTRICT
This Agn:ement, dated and effective as of~-----' 2005, is by and among the
City of Englewood, Colorado, a municipal corporation, whose address is 1000 Englewood
Parlcway, Englewood, Colorado 80110; and the Englewood Schools , Colorado, whose address is
4101 South Bannock Street, Englewood, Colorado 80110 ; to cooperate in a Multiuse
Recreational Facility to be located at Sinclair Middle School.
This Agn:ement is to clarify the can, and maintenance of such Multiuse Recreational
Facility (Facility) and associatd amenities located at Sinclair Middle School 300 West Chenango
Englewood, Colorado 80110 .
These amenities shall include the concrete playing surface, outdoor regulation bask.etb.U
court an ioline hock.ey rink. with benches, player benches , portable storage shed and adjacent
padring lot
This Facility will be designed in accordance with the attached Exhibit A.
As pan of this Agreement the City of Englewood agrees to be responsible for:
I. All costs associated with the planning and construction of the concrete pad and
recreation amenities .
2. Ongoing maintenance and repair of the recreational amenities, pad surface and
surrounding fencing/gates.
3. Scheduling of the Facility after sc hool hours , weekends and non-school days.
Scheduling preference will be given to Sinclair School students.
4. Routine maintenance of the adjacent parking lot (i.e. trash removal, snow
removal, sweeping, striping an,! minor pothole repair)
5. Seventy percent (70%j of the cost of capital repair of the parking lot., (i.e.
structural repair, asphalt overlay , parking curb replacement).
As pan of this Agreement the Englewood Schools shall be responsible for:
I. Thirty percent (30%) of the cost of capital repair of the parking lot, (i.e. structural
repair, asphalt overl ay oarking curb replacement).

The Pa r\.•; and Recrea ti on D epa rtm ent recommend s th at incil adopt a bill fo r an o rdin an ce
au th orizing an Intergove rnm ental Agreem ent (!GA) defining joint responsibility between th e City of
Engl ewood and Englewood Schools for ca re an d maintenance of a Multi-Use Recre ati ona l Faci lity at
Sin clai r Middle Sc hool.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
Staff has negoti ated w ith Eng lewood Sc hool officials to reac h an ag ree m ent on a proposal th at
would benefit city res idents and Engl ewood Schools. In February 2004, City Parks and Recrea ti on
and Pu bli c Works staff atte nded a special public m ee tin g hosted by th e sc hool b oa rd to disc uss a
p la n for resto rin g the Si nclai r pool si te back to alt ernati ve us es. The consens us of th e res id ents,
sc hool an d Ci ty officia ls was to res tore th e pool si te area to open grass area, mainta in th e sma ll
parking lot an d provid e a baske tball court and an inline hockey rin k on th e ex istin g tenni s court si te.
FINANCIAL IMPACT
Ph ase 1 funds h ave been approve d in th e 2005 Budget. Phas ~ 2 (i nlin e hockey rin k) funds w ill be
req ues ted in th e 2006 bud ge t (A rapa hoe Open Space Fund).
