WHEREAS , It has been detennined that because the practic e of Reflexology is limit ed to th e hands , feet and ea rs, it shou ld be licensed separat ely from the massage therapy; and WHEREAS , Th e insurance requirem ent s for massage therapi sts art amended to requ ire profe ss ional liabilit y rather than general liability insurance for the duration of the li cense; NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORA DO , AS FOLLOWS: Section I . The City Council of the City of Englewoo d, Colorado hereb y amends Title 5 , Chapter 5, Section 2, of the Englewood Municipal Code 2000 , by the addition ofa new Subsection G, pertaining to Reflexology , to read as follows : Chapter 5 MASSAGE THERAPY 5-5-2 : License Required. 11 b ii ~1\/1\)IZ-1.t.,lolit,;...i 5\-100 ~ .... .>, It shall be unlawful for any person to offer or perfonn a massage for an){,[ee or remuneration of .,..,.,., d.00 ~•• any kincjland it shall be unlawful to operate a massage therap y clinic in the Cit)' of Englewood 5.,e. ~ .,,_.,. without first obtaining a licen se for such ;1c1ivity except for the following classes of persons : o~ IJ• st A. Ph ys icians , osteopa ths, ph ysica l therapists, chiropodists , podiatrists , or chiroptactors li ce nsed in thi s State, their offices and clinics , and all persons working in their offices and clinic s under their supervision and direction . 8. Ho spit als and all persons employed by institutions and establishments license d by the State as ho sp ital s while pcrfonnincr th eir usual duties within the hosp ital or in stituti on so li ce ns ed. C. Registered nurses and licen sed practical nurses perfonning massage serv ic es in th r cours e of their usual nursing dutie s. D. Cos metologi sts and barbers duly licens ed under th e law s of this State , acting in the course of their usual duties a.., cosmetologists and barbers . E. Trainers of any recogni zed ama teur, semi -profes sional , or profes sional athlete or athletic team . F. The Ci ty Co uncil hereby finds , determines, and declares that this Ordinance is promulga1e d under th e general polic e power of the Cily of Englewood, tha1 it is promulgated for lh e health , safely , and welfare of:he public , and thal 1his Ordinance is necessary for 1he pre serv ation of hea lth and safety and for th e protection of public convenience and welfare. The City Counci l furt her determines th at th e Ordinance bea rs a rational relation to the proper legi slati ve object sought to be obtained . Sect ion 4. Severability. If any clause, se ntence, paragra ph, or part of thi s Ordin ance or th e ap plicat ion thereof to any pers on or circumstanc ~ shall for any reason be adj udg ed by a court of competent jurisdiction invalid, ~uch judgment shall not affect, imp air or in validate th e remainder of this Ordinance or its application to othe r persons or circ umstanc es. Sect ion 5. Incon sistent Ordinances. All other Ordinances or portions th ereof inconsi stent or conflictin g with thi s Ordinan ce or any portion here oiare hereb y rep eal ed to the extent of s uch inconsistency or co nfli ct. Secti on 6. Effect of repeal or modific at ion .
