AN ORDI N ANCE AMENDING TITLE 2, CHAPTERS I, 2, 3, 4 , 5, 7 AND 9 AND
TITLE 5, CHA PTERS 3 AND 3A , OF THE ENG LEWOOD MUNIC IPAL CO DE
2000, PERTAINING TO BOARDS AND CO MMISSIONS .
WHEREAS , it ha s been so me tim e si nc e there has been a review of the Engle wood
Ml-ln ic ipal Code rcla1ing to Board s and Co mmi ss ion s; and
WHEREAS , the Cit y Co uncil of the Ci ty of Englewo od, r.olorado asked th e
members of these Ho ards and Commissions for sugges ti ons for updating the Cude
relating to such Boa rd s and Commissions ; and
WHEREAS, the Ci ty Council has reviewed th e sug gest ion s and the provi sions of till'
Code relating to City Boa rd s and Commiss ions and fi r :s that some ordinanc es need
clarification as well as technical changes ;
NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT Y
OF ENGLEWOOD , COLORADO , AS FOLLOWS :
~. The Ci ty Council of the City of Englewood, Colorado hereby amends
Title 2, Chapter I , of the Englewood Municipa l Code 2000, with the addi tion of a new
Subsection 2, entit led Quorum, which shall read as follows:
2-1 : EU:CTION COMMISSION
2-1-1: Com mi ssion Created.
The El ec tion Commissio n shall con sis t of th e Cit y Clerk, wh o shall be a member ex
offic io of the Co mmi ss ion, and four (4) qualified electors of the Cit y. No more th an
tw o (2) mem bers of the Co mmis sion shall be fr om any one Co uncil district of th e
City . The Co mmi ss ion sha ll e lec t a chairperson from its membership . Appointment s
of qualified elector members shall be mad e by the City Co uncil in January of the year
in which the appo intment ex pire s for a fo ur (4) yea r term to ex pire on February I
fo ur ( 4) years hence .

The City Council shall make appointments to fill vacancies for th e un expi red term s.
The City Manager shall appoint a memb er of the Library staff to be an ex officio

2-2-2 : Orga nization and Meetings .
The Public Library Boa rd shall convene at least once in each calendar month for the
tran sac tion of such business as may regularly come before it. A record of each meetin g
shall be kept and placed in the office of th e City Clerk for public inspection . All regul ar
meetings of the Board shall be open to the public .
A simp le majority of the duly appointed members of the Commission shall constitute a
quorum for the transa ction of business In the absence of a quornm such members as are

2-5-1 : Commission Established.
There is hereby establi shed a City Planning and Zoni ng Commission consisting of nine
(9) members, appointed by the Ci ty Council, who shall be citizens-at-large with
overlapping four (4) year terms. The Ci ty Manager shall appo:nt an administrative
officer to be an ex officio, nonvoting member of the Commis~1on . Citizen-at-large
members shall be qualified electors, residents of the C ity at lr.ast one year immediately
prior to the date of their appointment, and shall hold no pald office or position in the

NON-EMERGENCY EMPLOYEES RETIREMENT BOARD
2-7-1: Retirement Board .
There is hereby established a Retirement Board for-ll!e-Qly, eligible , non-emergency,
City employees, which Board shall be called the Non-Emergency Employees
Relirement Board rNEERB). Said Board is to be organized and to have the powers,
duties and functions as set out in Section 3-6-4-1 1 of the Englewood Municipal Code.

Title 2, Chapter 9, Sections 4 and 7, of the Englewood Municipal Code 2000, which

2-9-4: Terms of Members.

Commission shall be three (3) members for a term of tltree (3) years, two (2 )

5-5-JA-7: License Renew al.
A. All renew al applic ation s for malt , vinou s and spirituo us liquor lic enses and
fcnn ent ed malt be ve ra ge licenses shall be su bm iucd to the City Clerk on th e
prescribed forms no later tha n forty-five (45) days prior to the date on which th e
lic ense expi res . The forms shall be ac co mpa nied by a ll the required fees and such
ad diti onal mat eri al s as 1h e Auth orit y Gee ms necess ary to carry out the provi sion s
of the Co lorado Liquor Code , thi s Anic:e and all applicable regulations. Ns
ren ewa l ap plication shall be accepted by the City Clerk which i., not c,,mplctc in
every detail. Any application mailed to or deposi ted w ith 1:,e City Cl erk which ,
upon examina tion , is found to have so me omis sio n or .:.:-ror ihall be returned to
the applicant ~0 r co mpletion or co rrectio n with out any ac~1on on the part of 1h e

be served upon lhe licensee after !h e filing of ap plicalion for renew al.
D. Renewal Of Expired Licen se :
I. A licensee whose license has n pired for nol more lhan nin e! (90) day s
may file a lale ren ewa l app lical ion upon 1he paymenl of a nonrefundable
late applicalion fee of five hundred dollars ($500.00) eaeh le lhe Slale aua
Ill, the City of Englewood. A licensee who fil es a late renewal applicali on
and pay s lhe requisile fees may con1inue 10 operate until both !he Slale and
lhe Cily of Englewood have taken final aclion to approve or deny 1he lale
renewal application.
2. A lale renewal applicalion will not be acc epled more than ninely (9 0) da ys
after the expiration of a li censee's pennanent annual licen se . If more th an
ninely (90) days have elapsed since !he expiralion o f a permanenl annual
license, !he licensee must apply fo r a new license pursuant to C.R.S. and
shall nol sell or possess for sale any alcohol beverage unlil all required
lic enses have been obtained .

of Englewood , Iha! ii is promulgaled for !he heallh , safely, and welfare of lhe public,
and !hat !his Ordinance is necessary for lhe preservalion of health and safety and for
lhe proleclion of publi c convenience and welfare . The Cily Council further
dclermines 1h al the Ordinance bears a ralional relal ion to lh e proper legislalive
objecl sought 10 be ob1ained.
