WHEREAS, th e Englewood City Council es tabli shed th e current Co un cil Di stri ct boundaries by the passage of Ordinance No. 15 , Series of 1999; and WHERE AS, pursuant to Article III, Secti on 20 , of th e Englewood Home Rule Chart er, th e four Co un ci l Di stricts established shall be contiguous and compac t and have approximately the same number of registered voters, and every four years Council shall make such di visio ns, changes , and consolidations necessary to carry out th e intent of Article III of th e Home Rule Charter; and WHEREAS , the Englewood City Charter requires th at the number of registered voters should vary no more than I 5% between the highe st and lowe st Council Di stricts ; and WHEREAS , the Colorado Revised Statutes has a popul ati on provision that case law supports, even though the pro vision is not made specifically applicable to muni cipalities ; and WHEREAS , the Colorado Revised Statutes provision stipulates that the population districts reflect no more than a 5% differential between the most and the least populated distri ct; and WHEREAS , the propos ed reapportionment mee ts both the populati on and regi stered elector crit eria; and WHEREAS , the proposed redistrictin g meets the regi stered elector cri teria of the Engl ewo od Home Rule Charter with a 5% differenti al; and WHEREAS , pursu ant to population requirement s estab lished by th e Colorado Revi sed Statute s and th e Constitution of the Sta te of Co lorado , Articl e V, Section 46 , the proposed redis tri ct in g meets th e popul ation criteria with a 3.8% differenti al; an d WHEREAS , th e Englewood Hom e Rule Charte r requires that reap porti onm ent be co mpl ete d at leas t six mon th s pri or to the ge neral municipal election (November 4, 2003 ) at whi ch it is to become effective; and WHEREAS , the Englewood Election Co mmi ss io . is charged with review in g and recom mendin g rea pp ortionment to Ci ty Co uncil ; an d WHEREAS , the Englewood Election Co mmis sion rev iewed the appo ni onme nt an d recommends the proposed rca pponi onment . 10 b ii NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO . RECOMMENDED ACTION The Englewood City Charter requires that th e number of regist ered voters be reviewed every four yea rs in an effort to equalize th e Council Districts. Th e Englewood City Charter requires that th e number of registered voters shou ld vary n o more than 1 5% between th e hi ghest and lowes t Council Dislri cts . Splilling County prec inct lines increases the number of ballot types in a Ma il Ballot Election . so this is also a cost issue . Council asked that we look al the possibi li1y of restructuring Distr ic ts 1 and 2 by incorporating a split along Bro adwa y. Joh n Voboril . Planner I, explains in his memo dated June 19, 20 02 why he reac hed the co nclusion that the Broa dway split was not feasible . Additionally , Chart er § 20 sta les that "distri cts shall be contiguous and compac t and have approxima tely the same number of reg istered voters, as determined by the number reg istered lo vole al the preceding genera l mu ni cipa l election ."
