AN ORDINANCE AUTHORIZING THE TRANSFER OF PROPERTY LOCATED
IMMEDIATELY NORTH OF ENGLEWOOD PARKWAY BETWEEN SOUTH CHEROKEE
STREET AND SOUTH ELATI STREET FROM THE CITY OF ENGLEWOOD TO THE
ENGLEWOOD ENVIRONMENTAL FOUNDATION .
WHEREAS , the construction of Englewood Parkway from South Cheroke·· Street 10
South Elati Street resulted in the creation of a residual parcel immediately north of the Parkw a
and
WHEREAS, th is parcel , co ntaining approximately 30 ,975 square feet , offers few
development possibilities by itself; and
WHEREAS, the most appropriate use is parkir 0 , ,ither in conjunction with the form er
City Hall site or as additional parking for the Phar-Mor , · e; and
WHEREAS, the owners of the Phar-Mor site have indicated tl1a1 they have no int ere st in
this property ; and
WHEREAS, the prior transfer of this parcel to the Englewood Environmenta l Foundation
resulted in a defect in the deed for this parcel ; and
WHER EAS , it was necessary to transfer the property back to the City of Englewood so
that the deed may be corrected; and
WHEREAS , thi s tran sfer of property to Englewood Environme ntal Foundation wi ll
facilitate the redevelopment of the old City Hall Property at 3400 S. Ela ti .
WHEREAS , thi s transfer will re se rve to the City existing utility easements.
NOW, THEREFORE , BE IT ORDAINED BY TH E CITY COUNC IL OF THE CITY
OF ENGLEWOO D, COLORADO, THAT :
Section I, The Ci ty Counci l 'lf the City of Englewood, Co lorado , hereby au thori zes the
transfer of the property shown on Exhibit A locate<l immedi atel y north of Eng lew ood Parkway
berween South Cherokee Street and South Elati Street from the Ci ty of Eng lewood to the
En glewood Environmental Foundation.
Section 2. The Mayor and the City Cle rk are hereby authorized to sign and anest sa id
documents for the transfer on behalf of the City of Englewood, Colorado .

PREVIOUS COUNCIL ACTION:
In 1997, City Council au th orized the creation of the Eng lewood En viro nm en tal Fou ndation, In c.
(EEFI) as a nonprofit deve lopment corporation to further the redeve lopm ent of the Cinderell a ::ity
si te.
On D ecem ber 20, 20 02 City Co un cil adopted Ordinan ce No. 3, Seri es of 2002, which transferred
th e property known as Parc el 2 to th e EEFI to faci litate redevelopment.
February 1 7, 2003, City Council accepted Parcel 2 from th e EE FI and accepted Lo t 1, Bl ock 2,
Girard Pla ce Subdivision from the Englewood Urban Renewal Au th ority (EURA).
RECOMMENDED ACTION :
Staff recommends that City Council adopt an ordinan ce transferrin g the property known as "Parce l
2 Revi se d" to th e EEF I.
BACKGROUND AND ANALYSIS :
This ac ti on w ill co rr ec t the deed transferrin g th e property t o th e EEFI and fac ilitate redeve lop men t
o f the former City Hall Pr operty.
"Parcel 2 Revised " includes an additional 403 square fee t of property not incl ud ed with th e origin al
Parce l 2. This additional p roperty is loca ted between th e north right-of-way of th e En gle wood
Parkway an d sou th lin e of th e retail property. (See attached map labeled remn ant parce l). Th e
remna nt parce l does not serve any useful pu rpose for th e City and will be best utilized as part of
th e proposed parkin g lo t d eve lopment.
