WHEREAS, th e Littleton/Englewood Wastewater Treatment Plant will require a major
expansion of the existing facilities and construction of additional treatment processes; which is the
result of rapid growth in the area served by the plant; nnd
WHEREAS , the proposed rate increase will pay for increased costs resulting from these
requirements; and
WHEREAS, administration fees paid by the Littleton/Englewood Wastewater Treatment
Plant were reviewed by a consultant and it was dctennincd that an increase was appropriate; and
WHEREAS, the Englewood Wate r and Sewer Board recommended approval of the
amendments to Title 12-IA--4, Title 12-ID-I, and Title 1°2-2-3 EMC penaining to the Water and
Sewer section at their July 8, 2003 meeting;
WHEREAS, the Code section on water rates has been moved for clarification.
NOW, THEREFORE , BE IT ORDAINED BY TllE CITY COUNCIL OF THE CITY OF
ENG LEWOOD, COLORADO , AS FOLLOWS :
Sec tion I. The City Council of the City of Englewood, Co lorado hereby amends Title 12, Chapter
I A, Section 4, of the Englewood Municipal Code 2000 , to read as follows :
12-1 A--4: Meter Requirements.
A. Owners of property with connections for re side nti al use havi ng taps one inch (I") in
diameter or larger, or for commercial use of any kind regardless of size of tap s or service,
or for residential use on premi ses with wading pools or other containers, whether
permanently installed or not, with a capacity of two thousand (2,000) gallons or more
which are filled from City supply, wi ll be required to install water meters .
All owners of property having unmetered water service shall be required to install
approved water meters within ninety (90) days after the sa le or transfer of the property or
change in property use from residential to com mercial or industria l. Whenever a meter is
to be installed, it shall be supplied by the City at th e owne~s cost.

B, ~ When th e City deems it to be in the best in 1erest of the Ci ty and wa ter
con sumers, the City may req uire any sched uled fl at rate user to take hi s or her wa ter
through a meter at th e rate s set by the City Cou ncil. Whenever a meter is to be used, it
shall be suppl ied by the City . All meters for new accounlS shall be suppli ed at the co st of
the user.
C. All meters install e~ shall be th e same size as th e size of the service pipe , except in
instances where premi ses have bee n vacate d by a use r that req uired a large r serv ice pipe
to supp ly its de mands than that required by the new user. In such cases , the meter size
may be redu ced appropriately .

All consumers' wate r meters sha ll be serviced and maint ained by the City, and the cos t
thereof shall be paid by the City , excep t that in the case of maliciou s damage , the cost of
the repair shall be paid by th e owner of 1he meter.

12-2 -3 : Fee s and Charges.
A. Purp ose. It is the purp ose of thi s scc lio n to pro vid e for th e paymen t of all POTIV cos ts,

include , but need not be li mited to, labor , repa irs, eq uipm ent replace ment , maint enance,
ne cessa ry modi fi ca ti ons, powe r, samp ling , laboratory tes ting and a reaso nab le
co ntin genc y fund . Th e charge s ,,·ill be ba sed upon the quality a11d quantity of ust.:r's
waste wate r, and also upon th e cap ital and opera tin g cos ts to int ercep t, treat , and dispo se

B . General. Th ere is hereby lev ied and charged on cu ch lot, parce l of land an d premi ses
served by or hav ing sewer co nne ct ion wit h th e sa nit ary sewe r of the City or oth erwis e
di sc harging sa ni tary sewage, indu stri al was tes or oth er li quids, eith er direct ly or
indirectl y, int o th e City san ita ry sewe r syst em an annua l se rvice charge whi ch shall be
co mput ed and pa yabl e as fo ll ows:

I. The charge for sewa ge treatment shall be based on the gallonage of water
delivered to the premi ses during the appropriate water meter readin& period
falling between November I and April 30 . This gallonage convened to an annu al
equivalent and multiplied by the annual rate per one thousand (1,000) gallons
provides the annual treatment charge.
2. A charge for sewer collection system maintenance shall be established annually
by act:on of the City Council where premises are served by the City collection
system. Where the City does not own and maintain the collection system, the
City will collect charges for maintenance of same only when authorized by the
terms of contract between the City and the sanitation district.
3. Where water usage information is not available, sewage service charges shall be
computed using the current rate per one thousand (1,000) gallons and based on
the following normal usage by class, as follows :

Nomial usage by class will be checked by tabulation and averaging at least every fi ve (5) years to
detect and adjust for change • ttc ms of wate r usage .
4. The minimum charge per year for sewage treatment service, by customer class , shall be a
percentage of flat rate charge , this amount representing the fixed portion of operation and
mai ntenance (C &M) costs.
5. Outside City customers will be charged one hundred five percent (105%) of the amount
charged inside City customers for simi lar service to compensate fo r additional infiltration
from the longer interceptor line s. This factor has been included in th e flat rate and
minimum rate tables in subsection B8 below .
6. Charges for service to customers inside the City limits shall be billed in quaner-annual
in stallments in advance. Charge s for sewer only service outside ~~e City may, at the
di sc retion of the City, be billed annually wl,cre thi s would not conflict with special
provi sions of a connector's agreement. All bills arc due and payable as of the billing date
and become delinquent thiny (30) days after the billing date.

Section 4. Title 12 , Chapter 2, Section 3, Paragraph D, of the Englewood Municipal Cod e is hereby
changed to read as follows:
2-2-3-D: If any water or waste s are discharged, or arc propo sed to be discharged to the
public sewers, which waters contain the substances or po ssess the characteristics
en umersted in subsection 12-2-2 B above and , in the judgment of the City , may have a
deleteriou s effect upon the sewage works, processes, equipment or receiving wa ters , o.-
which othe-rwise create a hazard to life or constitute a public nuisance, the City shall also
charge the following fees and tak e such enforcement action in accordance with S .. .:ti on
12-2-6 of this chspter as the City deems advisable.
The City shall also require payment tu cover the added cost surc harge of
handling and treating th e wastes considered as "indu strial wastes" by imposing the

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
The last sewer rate in c.rease was implemented January 1, 1999. The last ra te increase before that was in
1982 by Council Bill /156 . The proposed increase provides revPnues to b uild facilities needed to meet
Federal requirements and provide additional plant capacity.
RECOMMENDED ACTION
The Engl ewood Water and Sewer Board recommended, at their Jul y 8, 2003 meeting, Council approval of
the proposed ordinance. The increase in sewer services charges will be 1 5% January 1, 2004, 15% Janu ary
1, 2005, 1 5% January 1, 2006, 15% January 1, 2007 and 14% Janu ary 1, 2008 .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The Littleton/Engl ewood Wastewater Tr eatment Plant w ill require a major expa nsion of th e existing facilities
and construction of additional treatment processes. The proposed rate i nc rease will pay for increased costs
resulting from th ese requirements. Th e new construction is necessary to accommodate recent
denitrification requirements imposed by the State H ea lth D epa rtm ent. Additionally, th e South Platte River
has recently been reclassified as a Re creational Class I river, which requires increased pathogen dest ru ction.
The plant ex pansion portion of th e project is th e result of rapid growth in the area served by the plant.
Growth has been n ea rl y double the projections used in planning th e las t expansion.
The project is curren tl y being designed by Brown & Cald well Consulting Engineers. It is es tim ated that th e
total cos t of the project w ill be $11 O million, of w hi ch Englewood w ill be responsible fo r 50%. D esign
sh ould be completed by th e firs t quarter of 2004, and at th at time bids should be received fo r constructi o n.
Constructi on is expec ted to take ab o ut three years to complete.
Administration fees paid by th e Littleton /Engl ewood Was tewa ter Treatment Plan t were reviewed ny a
cons ultan t and it was determined that an in c reas e w as appropriate. The City of Engl ewood Fi nance
Department th erefore recommends an increase in the ex is ting adm inistra ti on fee s. The additional
adm inistrati on fees result in an increase of 14% in 2008 instead of an increase of 10% .
FINANCIAi. iMPACT
In order to financ e this construction, th e firm of Bla ck & Veatch was retained to analyze financing
alternatives. Bond covenants require that the City of Englewood maintain a ce rtain minimum debt ratio . In
2002 Englewooci fe ll below the minimum requir ement. The rate increase presented should insure that
bond covenant, are met through 2008 unle ss there are unanticipated shortfalls in rev enues or
unanticipated expenses.
The Sewer Fund incre ase s are necessary ,o fund Englewood's share of the upgrade and ex::,a nsion of th e Bi -
City Wastewater Treatment Plant Sewer rates were raised 20% January 1, 2003 and the last rate increase
before that was in 1982.
It was determined that a bond issue in the range of $55 to 60 million dollars wou ld need to be issued. II is
proposed th · this issue be concurrent with the receipt of the bid. Sewer rates will need tc, be increased to
pay the principal and interest on the new bonds . The proposed rate increases would be 15% January 1,
2004, 15% January 1, 2005 , 15% January 1, 2006, 15% January 1, 2007 and 14% January 1, 2008 to meet
coverage requirements of the bond issue. These results are presented in a memorandum attached to this
co uncil communication.

Executive Summary
Wa stewater Ra te Study
Tue City's wastewater operations are financially self-sufficient with funding for capital
and operating requirements derived primarily from rates, tap fees, and other miscellaneous
sources. City staff has projected a $57.8 mi 1Jion wastewater capital improvement program for
the 2003 through 2008 period which includes the City's share of the Phase 2 expamion of the
Littleton/Englewood wastewater treatment plant and •he purchase of a new IT system.
This study was authorized by the City to assure that an adequate leve l of revenue from
rates and fees is maintained to fund the utility's daily operations, finance the proposed capital
improvement program, satisfy bo nd covenant requirements, and minimize t'ie impact on rates.
This study includes the following:

• Review of City's 6-year financial forecast .
• Projection of2004-2008 revenues.
Study Findings and Recommendations
• A 20 percent wastewater rate increase was needed in 2003 to continue to satisfy
t'ie co •:enants of the existing loans . This increased the average single family
'1:Ulrterly bill by $4 .02 from $19 .92 to $23 .94 .
• Additional rate increases are forecast for 2004 thro ugh 2008 to fu1ance the
proposed capital improvement program, fiu,d daily operations, satisfy bond
covenants, and maintain adequate reserves. These rate increases and the estimated
effect on the average single fiunily quarter ly bill are shown below. The timing and
magnitude of these increases should be reviewed prior to implementation for
updates in the capital improvement program.
