FOR A PERIOD OF SIX MONTHS . WHEREAS, City Council has established goals for enhancing busine ss and economic climate within Englewood: anci WHEREAS, City Council initiated the Broadwa y Plan 2003 supporting Plan goals of identifying strategie s for revitalizing the corridor, redeveloping key nodes , supporting multiple modes of transportation , increasing n:tail spending, improving opportunities for workforce housing and repositioning underused properties for redevelopment : and WHEREAS , Council hus reviewed preliminary research that indicates two-thirds of the corridor contributes littll! directly to the City ta.'< base; and WHEREAS , sales taxes are the single most important source of revenues that pay for essential and emergency services in Englewood ; and WHEREAS . auto uses occupy a disproportionate amount of B-2 zoned land in Englewood when market analysis indicates the supply of auto uses substantially exceeds the community demand for auto uses ; and WHEREAS. auto purchasers do not pay sales tax where the vehicle is purchased; and Wt-lEREAS , the establishment of additional auto uses or expansion of existiny auto uses threatens Englewood's sales and property tax base ; and WHEREAS . Englewood is proposing revisions to the Zoning Ordinance which will address these auto ·1scs that take approximately six months to bec ome effective; and WHEREAS , control of the zoning of these facilities is a lcgitimah! cxcrcisl! of local police power . COUNqL COMMUNICATION DATE: AGENDA ITEM SUBJECT: August 18. ~003 11 a ii Temporary Moratorium on Auto Uses in the B-2 Business Zone District INITIATED BY STAFF SOURCE : Community Development Department Mark Graham , Senior Planner COUNCIL GOAL AND PRtYIOUS COUNqL ACTION: • Council established goals for enhancing the business and economic climate within Englewood RECOMMENDED ACTION; Staff recommends that Council adopt an Emergency Ordinance for a temporary moratorium nn the establishment or expansion of the listed auto uses in the B-2 Zone District. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED: Council initiated the South Broadway Plan 2003 in January ~003 with direction to identify strategies for improving Broadway. Preliminary analysis of Broadway indicates that about ~/3rds of the corri• dor does not contribute significantly to the tax \Jase. Auto uses are the largest land use that contrib- utes little directly to the sales tax base. Early indications are that auto uses are also frequently asso- c iated with low property values. Low property values adversely affect School District, County and City property tax revenues. In addition, the market analysis prepared for the Plan indicates that Englewood supplies significantly more auto related uses than local demand for these uses and that they occupy land that could be better used for uses that bolster the sales tax base, expand residen• tial and employment opportunities and provide retail synergy. In order to prevent the establishment of new auto uses or the expansion oi ex,sting auto uses be- fore re vised zoning criteria can be considered by the City, staff recommends that the Council create a moratorium on the uses that are characterized by vehicle display and storage lots. Staff recom- mends that the moratorium included the following uses: 16-4-1~ (C) Permitted Principal Uses 4) Auto leasing 5) Auto sales 13) AutopJwn 15) RV sales The moratorium shall terminate at 12 :01 a.m. on March 3, 2004. F(NANClAL IMPACT; This proposal has no direct financial impact. TI1e moratorium w ill prevent establishment or expan• sion of auto use businesses that would encroach on the tax base.
