Home My WebLink About2003 Ordinance No. 069• • • ORDINANCE 0 . /;,J_ SERIES OF 2003 BY AU TH ORITY !Obi CO NTRACT NO, /J,7-.J.ec,i._ COUNC IL BILL NO . 67 INTRODUCED BY COUNC IL MEMBER GARRETT AN ORD INANCE AU THORI ZING THE EXTENS ION OF A LEAS E AGREE MEN T BETWEEN ABC, INC ., THE CITY OF ENGLEWOOD AND THE CITY OF LITTLETON . \ WHEREAS, the City Co uncil of the City of Englewood auth orized the City to enter int o a Lease Agreement with Radio Prop eny Ventures (KQXI) by the passage of Ordinance No . 44 , Serie s 1991 ; and WHEREAS , the City Council of the City of Englewood authorized a "Consent To Ass ignme nt Of Lease" of this propeny to ABC Inc. by the passage of Ordinance No . 67, Serie s of 1998 ; and WHEREAS , Section IO of the Lease provide s that the Lease ma y be termi.sated by th e Le sso r (th e Ci ti es of Liuleton and Englewood) when the City Council determines that public ne cessity and co nvenien ce require it to do so; and WHEREAS , the City Counci l of the City of Englew oo d determined that publi c nece ss ity and co nve nien ce requ ired termination of the Lease in order to allow for the planned improvements assoc iated with th e Ph ase n expansion of the Liuleton/Engl ewood Was tewat er Tre atment Plant by the passa ge of Ordinance No . 60 , Series 200 I; an d WHEREAS , on Decembe r 26, 2001, the Citie s ofLinlet on and Englewood terminated of the Lease , terminating the Lease at midnight December 31 , 2003; and WHEREAS , on Augu st 20, 2003, ABC , In c. inform ed the Ci tie s of Englewood and Linl eton that it had not re ce ive d th e requi site approval from the Fed eral Communic ati ons Commission ("FCC") to relocate the radio transmitte r tower and did not anticipate obtaini ng th e approva l in time to reloca te the radio transmitter tower and vacate the premises by Dec ember 31, 2003 ; and WHEREAS , given th e de lay caused by the FCC proce edin gs, ABC, Inc . see ks an ex ten sion of tim e to vaca te the premi ses and an extensio n of the Lease Agreement ; and WHEREAS , a six -month extension of the Lease Agreement will no1 delay or imp ed e planned cons tructi on ac ti vit ie s at the Littl eton/E nglewood Was te wa ter Treatment Pl ant. NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF ENGLEWOOD , CO LORADO , AS FOLLOWS: Sec tio n I: The Englewood City Counci l hereby find s th at the Lease ma y be exten ded fo r an addi tion al six months , up to and including midnight June 30, 2004 . Secti on 2: The Englewood City Council hereb y find s that ABC, Inc . may co ntinue to occupy the pre mises until June 30 , 2004 , but must vacate the pre mises on or before midnight Jun e 30, 2004 . Sec ti on 3: The En gle wood City Counci l hereby directs that the Cit y of Englewood ente r int o an Agreement Ex tendin g the Term of Lease Agreement.
