AN ORDINANCE AP PROVING A LI CENSE AGREEMENT AND GRANTING A
TEMPORARY CONS TRU CTION EASE ME NT FO R 2890 S. CLARKSON STREET IN
ENGLEWOOD, COLORADO .
WHEREAS, Mr. and Mrs . Bray subm itted a Licen se Agree ment and Temporary
Cons tru cti on Ea sement to encroach into th e En glewood's Ci ty Ditch ease ment for a remode lin g
add iti on fo r th ei r reside nce at 289 0 S. Clark son SI.; and
WH EREA S, this encroac hm ent will even out the bound arie s of an encroac hm ent fo r a
pre vious remodeling project ; and
WHEREAS, Englewood wi ll mai nt ain the easeme nt and th e ri ght to in stall , repair,
remo ve or rel oca te th e City Dit ch at any time deemed necessary ; and
WHEREAS, the Licen se Agre ement and Temporary Construction Easement will all ow
the Bray s to constru ct an addition to their resi dence at 2890 S. Clark so n St. encroac hi ng in an
area where the City ditch ease ment run s diagonall y across th e prope rty.
WHEREAS, th e Licens ees expressly ass ume full and strict li ability fo r any and all
damages of every nature to person or property caused by the poi nt or point s where Lic c11 sccs
perfor,n any work in conn ec ti on with the encroachment provided ; and
WHEREAS , the City reserves the right to make full use of th e property ne cessa ry in the
operation of th e City Ditch, in cludin g the co nveyance of stonn wa ter runoff.

8. The rights and duties granted Licensee s he reunde r shall run with the land and
shall inure to the ir hei rs and assigns .
9. .-\II trenches and «cavotions within City prop erty shall be backfilled in the
fo ll owing maMer: the trench or exca vati on shall be backfilled to the origmal
ground line using onl y suitable soft earth material. The back fill materia l shall be
