The deve lopment included a grocery sto re, bi -leve l relail al ong Soulh Br oadway, single-story retail along En glewood Parkway, and a lwo-s lory parki ng stru clure. In 1995 th e si te was redeve loped lo remove !h e parking stru clure and th e bi -leve l shops alo ng So uth Br oa dway. This redeve lopm ent tr igge red th e Troll ey Squ are PD ap plica lion due l o th e 1994 reg ul ation relatin g lo th e size of the property. Th e red evelop ment adh ered to th e B-1 Dis tri ct standards and did 11 0 1 take adva nt age of any fl ex ibl e deve lop ment options availabl e th rough th e PD µrocess . In 1996 th e PD overl ay dist ric t regul ati ons w ere repeale d and rep laced with th e Plann ed Unil D eve lopme nt (PUD ). FINDINGS OF FACT 1. TH A T the application for vaca ting the Trolle y Square Pla nned Development was brought before the Pl anning Commiss ion by Dillon Real Est ate Co., In c. 2 . THAT the Planned Dev elopment was required only because of the co de requirement that property grea ter than o ne acre b e d eve loped un der the Pl an ned D evelopment process . 3 . THAT the 1995 developmen t fully complied witn the 8-1 District re q uiremen ts and did no t utilize an y Planned D evelopment allowed redu ction s o r variations. 4. THAT the Planne d Develo pment regu latio ns w ere repea led in 1996. 5. THAT the Troll ey Square Planned Dev elopment does not add va lue to th e development since the original development co mplied wi th 8-1 District requirements and th e development, as it c urrently exists, complies w ith current 8-1 and draft Unified D evelopment Code requirements. 6 . DECISION THEREFORE , it is th e decision of the City Planning and Zon ing Commission that th e request to vacate the Troll ey Sq uar e Pl anned D evelopment should be ref~rred to th e City Council wi th a favo rab le reco mmendation. The deci sion was reac hed upon a vo te o n a motion made at the meeting of th e City Plannin g and Zoning Commission on October 21 , 2003 , by Ms . Kriege r, seconded by M r.
