store. maintain or keep an y inoperable rn vehicle off.ro ad vebici.e or trail er in vio lat ion of thi s
Chapter .
The owner of an inoperable IWllll[ vehicle , 9f off-road ve hi cle 2L!Cilil,er as we ll as the
occupant and owner of the property where such a vehicl e 2L!Cilil,er is sto red , shall be responsible fo r
the maintenance of such ve hicl e in com plian ce with thi s Chapt er.
A. Inoperable iwwu Vehicles ind{{ Reridenlia/ lo11e Districts.
I. No inoperable IWllll[ vehicle shall be sto red wi thin the front yard .
2. No pers on shall sto re or work on any inoperable~ ve hicle within the front
yard or in or on an y public propeny or right -o f way, except that such veh icles may
be temporari' int ain ed in the front yard , on a hard surface , for the purpos es of
transport, loa\.. "'' unloading, or other temporary activities. Such transpon ,
loading , unloading, or other temporary activities shall not exceed eight (8) hours
per day .

or confli cting wilh thi s Ordinan ce or an y portion hcrc:.of arc hereb y repea led lo the exti:nl of s uch

Sec 1i on 8. Effect of repeal or modifi ca tion .. The repeal or modification of any provision of •
the Code o f th e City of Englewood by this O rdin ance shall not release. exti ngui sh. a lter. modify. or
change in whole or in part any penalty, forfeiture , or liability, eit her civi l or crimina l, which shall
h:1ve been incu rred under such provision, and each provision sha ll be treated and held as still
remaining in fo rc e for the purp oses of sustaini ng any and all proper actions. sui ts, proceedings , and
prosec uti ons fo r the enforcement of the penalty, forf..:iture. or liabilit y, as we ll as for the purpose of
sustai nin g any judgmen t, decree , or order whic h can or may be rendered, en tered. or made in such
actions . suits , proceeding s. or pro secu ti ons .
Section 9. Penalty . The Penalty Provis ion of Section 1-4-1 EMC shall apply to eac h and
every vi11 latio n of this Ordinance .

RECOMMENDED ACTION:
Staff seeks Cou nci l support for th is ordi nance ame nding th e In o perable Vehicle and Off Road
V ehicle sectio ns of th e Eng lewood Municipal Co de (EMC). The Po lice Division believes that this
o rd inanc e is enforceabl e and fa ll s wi th i n the framework of its probl em-s o lvi ng, community
int erac ti on, and edu cat ional endeavors.

A t th e reques t o t City Co un cil , staff worked w ith th e Co de Enforce ment Ad visory Committee to
de, e\op requ i re ments relat ed to i nope rable vehicl es and off road vehicles. Over th e past yea r,
seve ral sugges ti ons ""d va ria ti ons of th e ordin ance we re dis cussed . Th is proposed ordinance
ad dresses the consist ency of defi niti ons in th e EMC , as well as in operabl e vehicl es, off-road
vehi cl es, and sc ree ni ng req uirem ents.
