WHEREAS , the use of go pcd s/motori zcd scooters ha s increased in pop ul ari ty for both recreation and co mmut ing : and WHEREAS , the se vehicle s we re not included in the 199 5 Model Traffic Code as adopted by the City of Englewood: and WHEREAS, th ere is a ne ed to categorize th ese vehicles so th at th e pub lic is awa re of the tra ffic rules which apply to them ; and WHEREAS, these go pcd s/motori zcd scoo ters arc si mil ar in power , speed , and use to motorized bicycles so that the rul es for both shou ld be th e sa me; NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF ENGLEWOOD, COLORADO, THAT : .,Slliru . Title 11, Chapter 1, Section I, Subsection B, of th e Englewood Muni cipal Code 2000 is here by ame nd ed by the inscnion of a ne w Pan 4, in numcncal ord er and renumbering of th e re mainder, whic h am end s Section 109 of th e Mode l Traffic Code 1995. This new Pan 4 sha ll read as fo . lows : CHAPTER I TRAFF IC CODE 11-1-1 : ADOPT IO N OF TH E CODE . B. -=4. Paa t Section 109 Motorized bicycles a gopcdstmotor izcd scoo ters anima ls skis ska te s toy ve hicles and alHcrrain rccrcntional vehicles on highway s ,(,),) Every per so n riding a motorized bicyc!e or a gopcd/motocizcd scooter µpon a roadw;iy where motorized bicycle and goped/motori zcd scoo ter travel is permitted shall be granted all of the rights and sha ll be subject to all of the duties and penalties :ipp !icab le to the dd v~r of a vehicle as set &rth in ibis Co de except th ose provisions of this code 1hat by the ir very nature can have no applica ti on Said riders shall also comply with s~ rule s set fooh in this Section and in Part I Section 220 ( I )(bl and ( l) (c) and when using stre ets and highway s within incomoratcd cities and towns -1- 11 b iii shall be subject 10 local ordinances regulating th e operation of mo torized bicycles or gopcd s/(1)o torized scoo ters as provided in section 42.4-111 C.R s. Whenever the word "v ehicle" is used in any of the driving rule s se t forth in this article that arc applicab le to motorized bicycle or i,C)ped/rnotorized sco01er dd, rs such term shall include mot ori zed bicyc les or gopeds tmotorized scooters A person riding a motorized bicycle shall not ride oth er than "J2QD or astride a permanent and regular sea t att ached there to (gJ A person shall not ride a gopcd/motorized scooter excep t on it s ~ ,Q) No motorized bicycle or gaped/motorized scoo ter shall be used to carry ~ persons at one time than the number f~w.his JJ . It is also unlawful for any person upon roller skates or riding in or by means of any coas ter toy vehicle or .s..imilar to go on any roadway except while crossing a highway in a crosswalk and when so crossing such person shall be granted all of th e rights and shall be subject to a)I of the duties applicable to pedestrians This Subsection 00) does not apply to any public way which is se t aside by proper nuthority as a play street and which is adequately roped off or otherwise marked for such purp,Q¥., Every person ridir:g or leading an animal or driving any animal-drawn conveyance upon a roadway shall be granted all of the rights and shall be ~ject to all of the dutie s appljcable to the driver of a vehicle by this Code except those provisions of this Code which by their very nature can have no application .Lil) Where suitab le bike paths horseback trails or other trail s ha ve been estab lished on the right-of-way of heavily traveled streets and highwa ys the Department of Transportation may subject to th e provisi ons of Section 43-2-135 C R S by reso lution or order en tered in its minutes and loca l authorities may wh ere suitab le bike paths horseba ck trail s or other trail s have been established on the right-of-way or parallel to it within four h.u.ndred fifty feet of the right-of-way of heavily traveled streets and highways upon which shall be prohibited any bicycle animal rider animal drawn convcyanc, or the class of kind of nonmotori zcd traffic which is found 10 be incompatible with the nounal and r&.fe movement of traffic and upon such n detcnni"!lti.on th e Departmcr 1t.J,f Transportation of lo ca l authority shalt erect appropn,:!tc offic ial si gns gi•,\ng notice thereof except that with .. <:spect to contro:1~~-vays th e provi sions of Section 42-4-1010(3) CR s. shall apply When such official signs arc so erected no pcr:;on shall violate any of the instruction s contained thereon -3- The parent of any child or guardian of any ward shall not authorize or knowingly permit any child or ward to vio)Jte any provision of th is llil&IL ~-Title 11. Cha pter I, Section I, Subsection B, of the Englewood Municipal Code 2000, is hereby ame nded by the insertion of a new Part 6 in numericol order ond the renumb erin g of the remoinder , which ame nd s Section 220 of th e Model Traffic Code I 995 . Thi s new Part 6 shall read os follows: B. ,g, The reguircmen1 s of Part 2 Sec ti on 220 of th e Model Traffic Code 199 5 titled ''Motorized bicycle s -Jll212[:_drivcn cycles -light equipment -department cont[QJ -use and operations" shall app.l~ ~:illJlQ!Qri.zed scooters as defined herein ~n]. Tille 11 , Chapter I, Section I, of the Eng lewood Municipal Code 2000 , is hereby amended by the insertion of a new Sub sec ti on C, which adds a new Subsection (42)(c) 10 Article II Section 102 , of the Model 1 raffic Code 1995. Safety Clauses. The City Council hereby finds. determines, ond declares that this Ordinance is promulgated under the general police power of th e City of Englewood, that it is promulgated for the health , safety , ond welfu re of the publ ic, and that this Ordinance is necessary for the preservation of health and sa fet y and fo r the prote ction of public convenience and welfare . As a result th ey a re pro hibited to be used o n publ ic hi ghways and str eets, and ca n o nl y be used o n private property o r o n publi c sid ewa lk s . Th ese vehicl es are ca pabl e of travelin g at speeds close tn 30 mph . ThP majority o f public sidewa lks in Englewood are o nl y 3 feet wide.
