B, WITH THE INSERT IO N OF A NEW PART 4 AND PART 6, AN D WITH THE
ADDIT ION OF A NEW SUBSECT IO N C TO TITLE 11 , CHAPTER I, SECT ION I,
UN DER DEFINITIONS PERTAINING TO GOPEDS /MOTORJZED SCOOTERS OF
THE ENGLEWOOD MUNIC IPAL CODE 2000 .
WHEREAS , the use of go pcd s/motori zcd scooters ha s increased in pop ul ari ty for
both recreation and co mmut ing : and
WHEREAS , the se vehicle s we re not included in the 199 5 Model Traffic Code as
adopted by the City of Englewood: and
WHEREAS, th ere is a ne ed to categorize th ese vehicles so th at th e pub lic is awa re of
the tra ffic rules which apply to them ; and
WHEREAS, these go pcd s/motori zcd scoo ters arc si mil ar in power , speed , and use to
motorized bicycles so that the rul es for both shou ld be th e sa me;
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY
OF ENGLEWOOD, COLORADO, THAT :

shall be subject 10 local ordinances regulating th e operation of mo torized
bicycles or gopcd s/(1)o torized scoo ters as provided in section 42.4-111
C.R s. Whenever the word "v ehicle" is used in any of the driving rule s se t
forth in this article that arc applicab le to motorized bicycle or

or gopeds tmotorized scooters
A person riding a motorized bicycle shall not ride oth er than "J2QD

proc eeding in the same direction .

roadway shall not ride more than two abreas t except on lane s or parts of
roadway s set aside for the exclusive use of bicycles .
CJ) No person shall operate a gaped/motorized scooter on a street with a sm
limit over thirty (30) miles per hour

within their respective jurisdictions
Persons riding or leading animals on or ;iJong any highway shall ride or lcfili

1.lil) No person shall us e the highway s or streets for traveling on skis toboggans
coasting sleds skates or similar devices It is unlawful for any person to
use any roadway of this State as a sled or ski course for the purpose of
coasting on sleds skis or similar devices. It is also unlawful for any person
upon roller skates or riding in or by means of any coas ter toy vehicle or
.s..imilar to go on any roadway except while crossing a highway in a
crosswalk and when so crossing such person shall be granted all of th e
rights and shall be subject to a)I of the duties applicable to pedestrians
This Subsection 00) does not apply to any public way which is se t aside by
proper nuthority as a play street and which is adequately roped off or
otherwise marked for such purp,Q¥.,
Every person ridir:g or leading an animal or driving any animal-drawn
conveyance upon a roadway shall be granted all of the rights and shall be
~ject to all of the dutie s appljcable to the driver of a vehicle by this
Code except those provisions of this Code which by their very nature can
have no application

estab lished on the right-of-way of heavily traveled streets and highwa ys
the Department of Transportation may subject to th e provisi ons of
Section 43-2-135 C R S by reso lution or order en tered in its minutes and
loca l authorities may wh ere suitab le bike paths horseba ck trail s or other
trail s have been established on the right-of-way or parallel to it within four
h.u.ndred fifty feet of the right-of-way of heavily traveled streets and
highways upon which shall be prohibited any bicycle animal rider animal
drawn convcyanc, or the class of kind of nonmotori zcd traffic which is
found 10 be incompatible with the nounal and r&.fe movement of traffic

Section 42-4-1010(3) CR s. shall apply When such official signs arc so

~-Title 11. Cha pter I, Section I, Subsection B, of the Englewood Municipal
Code 2000, is hereby ame nded by the insertion of a new Part 6 in numericol order ond the
renumb erin g of the remoinder , which ame nd s Section 220 of th e Model Traffic Code
I 995 . Thi s new Part 6 shall read os follows:

~n]. Tille 11 , Chapter I, Section I, of the Eng lewood Municipal Code 2000 ,
is hereby amended by the insertion of a new Sub sec ti on C, which adds a new Subsection
(42)(c) 10 Article II Section 102 , of the Model 1 raffic Code 1995. Thi s new
Subse ction C shall read as follo ws ·

~. Safety Clauses. The City Council hereby finds. determines, ond
declares that this Ordinance is promulgated under the general police power of th e City
of Englewood, that it is promulgated for the health , safety , ond welfu re of the publ ic,
and that this Ordinance is necessary for the preservation of health and sa fet y and fo r
the prote ction of public convenience and welfare . The City Council further
determines that the Ordinance bears a rational relatio n 10 the proper JegisJative
object sough t to be obtained.

and each prnvision shall be treated and held a, st ill remaining in fo rce for the
purposes of sus taini ng any an d all proper actions , suits . proceedings. and prosecutions
for the enforceme nt of the penalty , forfeitu re, or lia bil ity, as well as for the purpose
of sustaining any jud gment , decree , or order which ca n or may be rend ered, ent ered ,
or made in such ac ti ons , suits, proceedings , or pro secu tio ns .

each and every violat ion of thi s Ordinance .

public righl -of-way.
BACKGROUND, ANALYSIS , AN D ALTERNATIVES IOENilFIED

result th ey a re pro hibited to be used o n publ ic hi ghways and str eets, and ca n o nl y be used o n private
property o r o n publi c sid ewa lk s .
Th ese vehicl es are ca pabl e of travelin g at speeds close tn 30 mph . ThP majority o f public sidewa lks in
Englewood are o nl y 3 feet wide. TI,e Publi c Works Dei;e,tm ent dis c ussed thi s issu e w ith the Engl ewood
Transportation Advisory Commill ee, a nd ETA C concurred wi th Publi c Works th at a 3-foot w id e sidewalk,

Th e Ci ty of Englewood coul d prohibi t th e use of these ve hi cles in th e p ubli c ri ght-of-way as has been d one
in Do uglas County, Th o rnt on, a nd Wes tmi nster. Bu t th e use o f gopeds and mo lo riz e d scoote rs has
increased in popula rity in th e pas t five years and responsibl e use o f goped s a nd moto ri zed scoote rs can be
a lt e rn ate m o d e of transpo rt ati o n fo r people in our communi ty. The operationa l c haracteristi cs a r,; very
s imi lar to m o to rized bi cycles w hich are all owed to be o pe ra ted io p ubli c roads and streets. Th e refo re the
Publi c W o rks Departm ent recomme nd s th a t th ese ve hicl es be permitt ed o n public str eets as ha s bee:o done
