AN ORDINANCE AMENDI NG TITLE 11 , CHAPTER I. SECTION I, SUBSECTION
B OF THE ENGLEWOOD MUNICIPAL CODE 2000 , BY THE INSERTION OF A
NEW PARAGRAPH 7, WHICH ADDS A NEW SUBSECTION (d) TO SECTION
220 (1), OF THE MOD EL TRAFFIC CODE 19 95 , PERTAI NING TO HELM ETS
RF.QU IRED FOR PERSO NS WITHOUT A DRIVERS LIC ENSE WHILE RIDING
GOPEDSIMOTORIZED SCOOTERS .
WHEREAS , the City Council of the Cit y of Englewood , Co lo:ado ha s a proposed
Counc il Bill 12, Series of 200 4 which would modi fy the Engl ewood Municipal Co de to
all ow 1h c use of gopcds /motor izc d scoo ters in th e public right-of-wa y: and
WHEREAS , goped s/motorized scooters arc not de sig ned to provide an y pro tect ion
for the operators of thes e vehicles; and
WH EREAS, operators of gopeds /motorized scoo ters "'" not required to ha ve
dri ve r's licen ses but arc required to co mply with th e mi es of the road : and
WHEREAS , ope rat ors th at do not ha ve a va li d driver 's licen se sho uld ha ve some
additio nal prmc cti on that is provided by wearing a helmet when the se gop cds/moto ri zc d
scco tc!s arc used in the public right-of-way;
NOW, THEREFORE , l!E IT ORDAINED BY TH E CIT Y COUNC IL OF THE CITY
OF ENGLEWOOD , COLORADO, THAT :
~. Title 11, Chapter I, Sect ion I, Sub sectio n B, of th e Er.glew ood \,tunicipal
Code ;ooo , is hereby amended by the in se rt ion of a new Paragraph 7, whi ch adds a new
Subsecti on (d) to Section 220 (I), of the Model Traffic Code I 995. This new Paragra ph
7 shall be placed in numeri cal order and the remainder shall be renumbered . Th e new
Subsec tion shall read as follow s:

and 1h a1 1hi s Ordinance is ne cessary fo r lh c preservation of health and safe1 y and for
the prot ec 1ion of public convenience and welfare . The Cit y Council fort hcr

RECOMMENDED ACTION
Th e Public W orks Departmenl re commends th at City Council approve an ordi nan ce to am end Titl e 11,
Chapter I o f th e Engl ewood Municipal Code to require operators of gope ds and mo toriz ed scooters in th e
public right-o f-way wea r helmets if th ey do not poss es s a valid drivers license .
• BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
•
Gopeds and m otorized scooters are n ot des ign ed to provide any protecti on fo r opera tors of thes e vehicles .
When th e City passed th e ordina nce to all ow th ese vehicles to be used on public st ree ts, there was no age
restri cti on and th ere was no req ui rement fo r dri ve rs tests to make sure that operators ha ve a good
understandin g o f the ru les of th e road . The City has allowed the use of go peds and motori zed scoot ers by
mino rs believing that th e p arents and guardian s will di sc us s and assur e themselves ih at their c hildren hav e a
good understandin g of safe ope rator behavior and th e rul es and regula tions Jhat operators must obey in
order to sa fe ly occupy a portion of roadway thal is des ign ed fo r cars, buss es, and Jru cks.
TI,is o rdinance mandates that op erat o rs tha t d o not ha ve a vali d drivers li cens e sho uld have some additional
protection that is provided by wearing a bicycle helm et.
As Mark Twain once said -"Good judgment comes from experi ence, and w here does expe ri ence come
fr o m? Experi ence com es from bad judgment." Thi s o rdin ance attempts to provide some margin of sa fety for
yo unge r op erators to gain "experience ".
