principa l of Co lorad o's Finest Alte rnati ve High School co n1a c1cd the Ci ty for
as sistance in ex pandin g th e build in g trad es program ; and
WH ERE AS , th e ACTS program wa s able 10 offer a two year Co mprehen sive
Bui lding Trad es prog ram fo r hi gh schoo l student s an d adults to have a "hands-o n"
ex peri ence in buil din g a hor,1 c from the gro und up througho ut the sc hoo l yea r; and
WHEREAS , Ci ty will ac t in th e role of th e deve lope r by providing constru ct ion
funds from th e Housing Rehabili tati on Fund and a si te co nt ractor wi ll be hi red to
coo rdin ate th e day-t o-day bui ldin g ac ti vitie s wi th the ACTS instruc tor and students ; and

COLLEG E/AR..\PAH OE -D OUGLAS CAREER AND TECHN ICAL SCHOOL (ACC.'ACTS) of
5900 South Santa Fe Drivc-#AD -1 27, P. 0 . Box 9002, Li11 le1o n, Colorado 80160-9002 .
WHEREAS , the City desires 10 assist the students in the AC C'ACTS program 10 gain
expencncc for their Co mpreh ensive Buildin g Trad es ACTS classes ; and
WHERE AS, AC C'AC TS de sires 10 provide pra ctical on-the-job experience to Student
Laborers regularl y enrolled in its Comp rehensive Buil di ng Trades classes;
NOW, THEREFORE , in co nsidera tion or the mutual promises made herein the panics
agree as follows: ·
ARTICLE I -DuTIES
A. ACC.'ACTS :
I. ACC/ACTS shall prov ide studen t laborers 10 perrorm co nstru ction job s related 10
the co nstruction of a dwel!ing toca tcd at a si te to be detcnnined (th 1.. ··Project''),
acco rdi ng 10 the plans and specifications 10 be provided by the Ci ty. ACC.'ACTS
shall provide wo rk crews in seµa ratc clas ses .
2. ACC.'ACTS shall instruct the Student Laborers in 1he co nstruction trade s' skill s.
which the y wi ll need in order co pcrfonn their cask s in the co nstruct1on 0f the
dwelling . ACC/ACTS makes no representations that the Stude nt Laeorers will be
skilled in the tasks they arc asked 10 pe rfonn by the Cit,'. (S ec attached Task Lis t
outli nin g respo nsibilities or the Cit,' and AC C:ACTS.
3. AC C'ACTS shall make available ,1 the co nstruct ion si te fo r use bv the Student
Labo rers in co nstruction of the Jwelling, hand Jnd powe r too ls, i::'(c ept tho se
mentioned in Article 1-8 . 3. as ACC:ACTS shall deem adequate in quali ty and
quantity . To che ..:xtent that other l!quipmcnt is needed for the Project :in d is
available ,·,itho ut cost 10 ACC:ACTS. ACC.'ACTS sha ll pro vide the eq uipment. All
other eq uipmen t shall be the responsibili ty o r the Ci ty.

8 . THE CITY:

3. The City shall provide each Student Lab orer wit h the fo ll owing tools or acce ptable

to ols. whic h are los t or stolen . If the Student Lab orer comple te s the course. he or
she shall be allowed to kee p any of the too ls remaining in hi s or her po ssession.
4. Th e City shall co ntribute 530.00 per Stud ent Labore r to ward the cos t of jackers for
eac h Student Lab orer.
5. The City sha ll ha ve th e right to obj ec t to the involveme nt or preve nt the future
invo lve ment of any Student Laborer in the Project fo r failu re to adhere to
instructions of the City or irs agents, vi olation of safety rul es . and co .. ducr which
ma y be hannful to the Ci ty, any of its office rs. di:ectors , Jgc nt s or invitees or to
any other Student Laborer, or co nduct \'. \1i ch wo uld ~o nstinue a misd emean or or
felony. Every effort will be marle to see co mp leti on of the Project withi n one
school yea r.
6. The City shall requir e dlat subcontract ors , other than AC C.'AC TS , shall rake
re aso nable ti me to exp lain the work th ey are pe rfo rm ing . It is expressl y ag reed
that these explan ation s arc merely inc idental to the wor\c to be perfonned by suc h
subcontractors and are to interfere as little as pract icablt: with 1h e sub con:racto rs '
othe r dutie s.
ARTICLE ll LIABILIT Y

This Agreeme nt may also be terminated if an acc eptable site is not provided by the
City by a date mutuall y accept abl e 10 the parti es.
ARTICLE IV EQUAL OPP ORT UN ITY
.-\CC /ACTS shall adhere to all federal. ,;tate and loca l statu<es. ordin ances and regulations
including , but not limited to, equal oppo rtun ities and civi l ri gh ts law s.
ARTICLE V WAIVER
No waive r of any pro visio n of this Agree ment shall be co nstrue d to be a wa ive r of any
sub se quent breach of the same or an y other pro visio n of th is Agreement.
t\RTICLE VI -INTEGM TJON
Any and all prio r agreeme nts between tbe pa rt ies hereto with respect to the subj ect matter of
thi s Agreement are hereb y canc eled and termin ate d. No amendments 10 this Agreement shall
be made other than by a writt en amendment signed by all the parties.
ARTICLE VU -ATTORNEYS' FEES
In the !!Vent of any :ictio n or pro cee din g brou gh t by l!i ther party ag ainst the other under this
Agree men t the pre vailing party shall be ent it led 10 recove r all e,penses incurred the refore,
including but not limited co, re asonable att orneys ' fees .

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION :
Council pa ssed Ordinance No. 25, Series o f 2002, and Ordinance No. 36, Se ri es of 2003, au thorizi ng
an agreement with Arapahoe Community College/Arapahoe-Douglas Career and Tec hnical School to
build a single family res id ence at 2 133 W. W es ley Avenue and 4673 5. Grant Street res pective ly .
RECOMMENDED ACTION :
Approve a Bill for an Ordinance authorizing the exec utio n of an Intergovernmental Agreement with
Arapahoe Commu nity Coll ege for th e Arapah oe-Douglas Ca reer and Te c hnica l School for th e
sc h ool yea r of 2004/2005 to build one single fami ly residen ce at one of th e si tes crea ted through
the res ubdivision of land surrounding 2399 W . Wesley Aven ue.
BACKGROUND. ANALYSIS. AND ALTl:l!NATIVES IDENTIFIED :
The City of Engl ewood firs t became involve d with th e Arapahoe Community College/Arapah oe-
D o uglas Career and Technica l Sc hool (ACTS) during 1985 w h en th e principal of Colorado's Fin es t
A lt erna ti ve High Sch ool co ntacted City staff for assis tan ce in ex panding the b uildi ng trades
prog ram .
Th e ACTS progra111 serves Arap ah oe Com111unity Coll ege and fi ve sc h ools districts, includin g
Engl ewood. Ev ry stud en t is exp ose d to all of th e building tr ades (i.e. framing, drywall, 111 aso nry,
el ec trica l, p lu111 bing, HVAC, etc.). Th ey lea rn to app reciate how each trade affects th e oth er.
Students are of all ages (men and women alike) and come fr o m all backgrounds.
Ci ty staff w ill ac t in the roll of th e deve lo p er providing construc ti on funds fr om th e H ousing
Re habilitati o n Fund (Fund 46). A si te co ntractor w ill be hired to coordinat e th e day-to-day build ing
.,cti viti es with th e ACTS i nstru c tor and students. Th e house w ill be sol d aft er completion of th e
project and th e p roceeds return ed to Fund 46.
Community D eve lopment staff w ill finalize th e des ign of th e ho use th at th e studen ts w ill bui ld
during th e sc hool year. Attention wi ll be given to se lectin g a des ign th at support s a good quality
level of ma terials , appropriate design fo r the neighbo rh ood and com munity, and finally, a p rodu ct
th at is marketable w ithin th e neighborho od.
The site for th e 2004 -2005 schoo l yea r will be one of lh e lols crea ted th roug h th e res ubdivis ion of
lan d surroun di ng 2399 W. Wes ley '\ven ue. The land is already ow ned by th e Ci ty purchased wilh
fu nd s fr om th e Housing Rehabi lilali on Fund .
FINANCIAL IMPACT:
Th e exis ting empl oyees in Comm uni ty Developme nt are ava il ab le to administ er th e pro jec t and
th eir salari es and ben efi ts are ;,art of th e City's co ntri buti on.
