IS~ TO CONNECTOR'S AGREEMENT THIS AGREEMENT, made and entered into by and between the CITY OF ENGLEWOOO, acting by and through its duly authorized Mayor and City Clerit , hereinafter called the "City," and SOUTHGATE SANITATION DISTRICT, Arapahoe anll Douglas Counties , Colorado, hereinafter called the "Dlalrtc1," WITNESSETH : WHEREAS, on lhe 20th day of June , 1961 , the City and the District entered !,,to an Agreement in which the City agreed to L ,at sewage originating from the District's sanitary -r system within the area served by the Disblct. which Ag,_,,..,t was most reoentiy renewed by Connecto(s Agreement dated November 16, 1988: and WHEREAS, said Connecto(s Agreement provides that the district may not enla,ve ila selVice area without the written consent of the City; NOW, THEREFORE, in consideration of the mutual covenants and undertakings herein sel forth , the parties agree as follows : 1. The City hereby consents to the inclusion of certain additior,al area located in Arapahoe County , Colorado , owned by Guy Cook and more fully described on Exhibit A attached hereto and lncoq,orated herein by reference , into Soothgate Sanitation Dis1Tict. The City agrees that said additional area may be served with the sewer faciltties of the District, and that the City will treat the sewage discharged Into the City's trunk line from said addltlonal area, all in accordance with the Connecto(s Agreement dated November'16, 1966. Accot'dlngly , Exhibit A referred to in Paragraph 1 of the Connecto(s Agreement dated November 16, 1988 , is hentby amended to include such additional area . 2. BACKGROUND , ANALYSIS, AND ALTERNATIVES IDENTIFIED Th e Ci ty of En glewood provid es sewage treatment to a popul ati on of about 70,000 pe ople o utsi de th e City thro ugh con tracts w ith numero us con nec tor distri cts. Th e area is defin ed by th e natural drain age and ex tends so uth and eas t fr o m Bro adway to th e Vall ey Highway and fr om H ampden to Lin coln A ve. ex cluding Highlands Ranch. By contrac t th e Ci ty of En glewood must approve an y additi ons o f land to be served by th e districts . Th ese are usually in -fill situati ons th at are w ithin w hat th e City considers to be th e area it ha s committed to serve. Adequate capa city has been provided in the tr ea tm ent plant t o accommodate all su ch future inclusions. Ann exa ti on o f thi s parce l of land will not increase the tap all ocati o n of th e Southgate Sanitation District.
