WHEREAS , currently farmers market s may operate one day per we ek per site during rhe peri od of June I to October 3 I; and WHEREAS , the current provi sion s and procedures relat ed to fa rme rs markets are too restrictive and nee d to be upd ated ; and WHEREAS , City Council ha s directed staff to review and revi se, if necessary , the provisions and procedures with respect to farmers market s; and WHEREAS, staff will nee d sufficient time to review and coo rdin ate th e pro visions and pro ced ures of the Englewood Municipal Code ; and WHEREAS , Council deems it necessary to coordinate the review and finds it appropriate to cease enforcement until the re view and re vised pro ced ure s arc reviewed by the staff and City Council; and WHEREAS, in order for the City to comply with the arguments made in Or Limited vs . Cjty of EngJewnnd , Case No. A86CV I 243 , the morat orium or temp orary suspension mu st apply to all farmers markets unl ess specific exemptions can be le gitimatel y set forth due to a finding that a speci fi c type of farmer s markets sho uld be exc luded ; and WH ERE AS , the rev isions will help protect th e pub lic hea lth, safe ty and welfare or th e Ci ty in prov iding mun ici pal services : by ma in tai nin g a sound balanc e between avai labl e public resources, facilitie s and serv ices an d the demands for such servic es; and prese rving a safe, health y, and sound environm ent within the City; and WH EREAS. the City Co uncil find s that a six mon th mora tori um or temporary suspension is nece ssary to implement the revisi ons; NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUN CIL OF TH E CITY OF ENGLEWOO D, CO LORAD O, THAT : ... BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED : Se cti on 16-5-5-E(2) of th e UDC limits th e durati on tha t a Farmers M arket may operate to o n e da y pe r w eek p er site during th e p eri od fro m Jun e 1 to Octob er 3 1, and restri cts th e ho urs of operat ion from 6 :30 a.m. to 2:30 p.m . including se t-up and cl ea n-up. A contract b etween the Engl ewood En vironm ental Foundati on (EEF ) and th e c urrent Farmers Marke t ve n dor, Brian Ve rb ec k of Mile Hi Coffee, prop os es that th e Farmers M ark et tak e p lace two days per week at Ci tyCe nter; Saturday m ornin g. and Th ursd ay evening. Mr. Ve rb ec k would li ke to begin op erating th e Sa turday m ornin g Far mers Market as so on as p ossible. Th e Thu rs day evenin g Fa rm ers Market is p ro p osed to b eg in opera tin g Jun e 17'" to coin ci de w ith th e So unds of Summer Concerts at th e CityCenter En glewood Am phitheater. The pro p ose d agreement conflic ts w ith th e term s of Sec tion 16-5 -5-E (2) o f th e Englewood M unicipal Co de pert ain ing to bo th th e durati o n and h ours th e Farm ers Market ca n operate . As a result, the Farm ers M ark et coul d not op era te o n Thu rsda y evenin gs. Curr ently, staff is prep ari n g an O rdinanc e amendm ent to p resent to th e Pla nnin g and Z o n ing Comm issio n fo r recom m endation to City Coun cil ame nding Sec ti on 16-5-5-E (2) of th e U D C to all ow a Farmers Ma rket to o p era te two days p er wee k and to m odify the hours of op erat io n . Th e sc hedu le fo r approval of th is am endmer,t w ill requi re betwee n 4-6 m o nth s to compl ete. FINANCIAL IMPACT: Estab li shi ng a temp orar) moratori um will have no fina ncia l im pac t.
