AGREEMENT FOR TEMPORARY LEASE AN [ R RE-DIVERSION OF REUSABLE RETURN FLOWS OF WATER Im roduct io n: Parti es and Purposes. Centennial Water and Saniration Di stric t (Centennial) own s reusable return flow s to th e South Platte River which consist oi Centennial's reusable water discharged by Centennial's Marcy Gulch wastewater treatment plant (the return flows ). The Ciry of Englewood (Englewood) bas a means to re -divert the retur.• ".ows a t Uni o n Avenue, and either retain them for use by Englewood or redeliver same to Centennial. The panics intend that Englewood shall at tempt to divert the return flow s. under the circumstan ces set fort h below, and pay Centennial fo r the return fl ows if same are retained by Englewood; and thur Centenni al will pay Englewood for re-directing the retu rn flows, if same are redelivered to Cen tennia 1. It is anticipated that Englewood will attempt to divert the return flows at its Union Avenue pump ·ta1io11. and ei ther use ·ame immediately in its Allen Treaanent Plant, or exchange same up C:iry Ditch to '.\ilcLellan reservoir. in Englewood 's di scretion. Therefore , the parties have agreed as follows . 2. Cente nnial 10 Gi ve Notice of Availabil itv · Englewood Response . Centennial will advi se Englewood. 011 J daily basis, of the an1ount of available return flows a t Englewood's Union Avenue pump station . Englewood will advise Centennial, on a daily basis, of available return flows Englewood will not be diverting. 3. Englewood to Attempt to Divert . Englewood will make reu.,,)1iable efforts to lawfull y divert the return fl o ws at its Union Avenue pump station . Englewood shall have no o bligation to divert : a) if diversion would impair the ne cessary quality o f water introduced into Englewoo,i's water treatment plant or introduced into City Ditch for exchange. as determined in Englewood's so le discretion : b ) except to the extent that Englewood determines 10 use the return flows immediately in its Allen Treatment Plant. plus the exchange capacity in Ci ty Ditch: c) to the e xtent that the capacity in Eng lewood'; pumping syste m after supplying Englewood's demand is less than ;tl l o f the available rerum flows. While Englew od shall make re asonable efforts to divert the return flows. the parti es rec ogniz e that various factors may make diversi on impractical. and Englewood shall have no liability to Centennial fo r failure to divert . Englewood will pay Cente nnial S85 per acre fo ot for all o f the re turn tlows which it acquires , and pay the pumping costs associated wi th those return flow s. Tempo rarv Pumping Facili ti es from the Forebav Re servoir Next to the Allen Treatment Plant. Englewood c urrently injects granular activated carb on (GAC) into the forebay adjacent to the South Pl atte River, from which Englewood's Un ion Avenue pumpi r g station pumps water tu the Allen Treatrnent Pl ant facilitie s. (The GAC is injected because of the c urrent severe quality problems in the South Platte River.) The water co ntaining the GAC is blackened in color and therefore cann ot be directly introduced into City Ditch for exchange purposes. Therefore , a s ubstitute suppl y of clear water to be ex c hanged up Ci ty Ditch must be pumped into City Ditch from a forebay reservoir adjacent to the Alle n Treatment Plant (not to be confused wi th the fo rebay at the river). (Pumpin g o f this sub stitute suppl y will be unne cessary if the GAC injection at the river forebay shoul d cease .) Englewood has no pump and pipe to accompli s h the pumping o f thi s s ub stitute suppl y fr o m the forebay re servoir. Centennial will provide and install such a pump and pipe. anJ hook it up to a power so urce. at Ce nt ennial's so le expense. Englewood and Centennial will coope ra te in det ermining the locati on. nature and in stallation o f the p ump and pipe. At the e nd o r this a2reement.
