WHEREAS , enfo rcin g th e ex istin g hotel sewe r tap agrccmcr1ts to accura tely ;cflcct ac tu al use has been slo w and ineffi cien t and difficult to enforce eve n when hote l managemen t is cooperati ve; and WHEREAS , diffi culti es have arisen whe n hotel management is un awa re of th e terms o f the agreement; and WHEREAS , there is also difficu lty keeping required fellers of credit updated ; and WHEREAS , fr om th e six exi stin g agreemen ts, the En gl ewoo d Uti li ties Department discovered th at hotels average over th e 50% wa ter co nsumpti on mark , but un der 75%; and WHEREAS , es tab li shing a hotel sewe r tap rate of 75% of the standard tap fee s, which reflec ts the Engl ewoo d Utiliti es Dep artme nt's study , would be an efficie nt agreement to admin ister ; and WHEREAS, th e Engl ewood Water and Sewe r Board reco mm en ded a ppro va l of the amen dment s to Title 12-2-8, EMC pertai ning to Sewer Tap fees at their June 8, 2004 meet in g; NOW , THEREFORE, BE IT ORDAINED BY THE CIT Y COUNC IL Of TH E CI TY OF I NGLEWOO D, COLORADO , AS FOLLOWS: ~. The Cit y Co un cil of th e Cit y of Eng lewood, Co lorado he reby amends Title 12 , Chap ter 2, Sec ti on 8 of th e Englewood Municipal Code 2000, to read as fo ll ows: 12 -2-8: Sewe r Tap Fees . A. At the time of filin g th e app lication, sewer tap fees shall be paid in acco rdan ce wi th the following sc hedule: \Vatcr Meter Si ze Sewe r Tao Fee 3/4" or less s I 400.00 I " 2 333 .00 I 1/2" 4 667 .00 2" 7 467.00 3" 14 932 .00 4" 23 332.00 6" 46 667.00 8" 74 ,667 .00 10 b ii ! For hotels an d mo tels th e tap fee shall be 75% of the um fee as set forth in this Section If th e fee determi ned by th e water meter s\zc from th e a bove schedule is great er th an th e fee determined by th e minimum ch arge of one th ousand fo ur hundred dollar s ($1,400.00) pe r unit, then th e greater fee , as determined by meter size, shall preva il. B. At the tim e of filin g an application for a sewer tap permit, sewer lap fees fo r the following properties shall be increased by the ad dition of a surcharge to the sewer tap fees established by Sub section A of this sect ion according to the established surcharge schedule : I . Pro pertie s within th e City, whic h arc not in an es tabli shed sanitation di strict. 2 . Properties outside ,he City which arc tributary to the Northeas t Englewood Relief Sewer Sys tem which are not exempted by agreement from sewer tap surcharge . The established sewer tap fee surc harge is: .. Water Meter Si ze Sewer Tan Fee I 3/4 " $ 500.00 ., I " 833.00 I 1/2" I 667 .00 2" 2 667 .00 3" 5 333 .00 4 " 8 333 .00 6" I ~ 667.00 8" 26 667 .00 ~ 38 333 .00 For multi -family units, helel,, mete!,, mo bile home courts and other multiple dwe llin g units, the sewer tap fee surcharge shall not be less than fiv e hundred doll ars ($500.00) per dwelling unit . Fo r hotel s and motels th e tap fee shall be 75% of the 1ap fee as set forth in this Section If the surcharge estab li shed by the water me ter size from the abo ve surcharge sc hedule is greater than the Ice of five hundred doll ars ($500.00) per dwellin g unit , the greater fee shall be charged. 3 . Properties th at connect to the Big Dry Creek interc eptor system shall pay a sewer lap sur charge fee in the sum of three hundred dollars ($300.00) per single-fa mily residential equivalent lap in addi ti on to all oth er charges. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED Enforcing th e exis tin g h o tel se wer tap agre ements to acc urately refl ec t actual use has bee n sl ow and inefficient and diffic ult t o enforce eve n when hotel man age ment is cooperative. Difficu lties have arisen w hen hotel management is una ware of th e terms of th e agreement. There is also difficulty keepin g req uired lett ers of c redit updated. From th e six ex isting ag ree ment s, th e Utilit ies Departm ent dis cove red that hotels average over th e 50% water co nsu mption mark, but under 75%. Estab lis hin g a ho tel sewer tap rate of 7S % ,of th e standard tap fees , wh ich refl ec ts th e Utilities Departm ent's stud y, would be an efficie nt agreement t o ad minister.
