Was tewater Trea 1me nt Plant and also approved the Brown and Ca ldwe ll contrac t amendment fo r
co nstructio n ma nage ment serv ice s during con stru ct ion; and
WHE REAS , City Counci l also approved by Ordina nce two Int ergove rn menta l Agreeme nts
with the Co lorado Water Resource :. and Power Development Authority fo r the iss uance of Wate r
Revenue and Water Poll ution Co nl'ro l Re vo lving Fund bo nd s fo r the Ph ase 2 Expansio n Proj ect;
and
WHERE AS , th e treatment capacity of the L/EWWTP wi ll need expa nsion because of hi ghe r
tha n antic ip ated popul ati on growth in the fac ili ty's service area and the regu latory requi rement to
remove nitrate from the plant effiuen t; and
\VHERE AS, the Pre •d esign Project was comp leted along wi th the engi neeri ng de sign stage of
th e Ph ase 2 projec t; and the final drawings and specifications ha ve been mad e ava ilabl e to
prequalified ge neral co ntracto rs and subcontrac tors in orde r to obta in co mpet itive bid s for the
project ; and
WHEREAS, the U.S. EPA notified the City that the Littleton/Englewood Wa stewater
Treatmen t Plant Phase 2 Project was qu alifi ed for a $1,000.000 grant in ~004 with net fu nd s to
the Cities fo r S964,300 gram in J004 , said grJ nt fu nds being pa rt of the EPA's Fiscal Year 2004
Appropria ti ons Act.

RECOMMENDED ACTION
We reco mm end Cou nci l approve by Ordinance an Intergovernm ental Agr ee ment with th e U .S .
Environmental Pro tec tion Agen cy (E PA) for th e iss uance of State and Tribal Assis tance Gran ts (STAG) for
the Phase 2 Expansion Proj ect. We also recommend that Mr. Stewa rt H. Fonda , Director of Utilities be
given th e authorizatio n to sign for th e City wi th rega rd 10 th is Interg overnmental Agreement.
BACKGROUND , ANALYSIS, AND ALTERNATIVES IDENTIFIED
Th e lillleton/Eng lewood WWTP has a current t rea tm ent ca pa city of 36.3 milli oil ga ll ons per day (mgd) and
63 ,000 pounds per da y of orga ni c mailer. Two prima ry fac tors have bee n identified th at w ill req uire
ex pansi on of th e pres en t fac ili ty: 1) higher th ." anticipated populati on growth in the facility's serv ice area
and; 2) th e reg ul atory req uirement to remove nitrate fr o m th e plant efflu ent. These two facto rs and th e
nee d for expa nsion we re pre se nt ed to bo th lillleton and Englewood Cit y Councils at a stud y sess ion in
November 1999.
A pla nnin g and ca paci ty assessm ent proj ec t was au th ori zed as a res ult of the stu dy sessi on and Bro wn and
Ca ld well co mpleted th e projec t at th e end of 2000. Th e res ul ts of th e pr ojec t were prese nt ed to both
co unci ls at a stu dy sess ion in Febru ary 200 1. Srown and Ca ldwell recomm end ed in creasing plan t ca paci ty
to a nomin al 50 mgcl and di scussed th e nee d fo r nitrat e remov al that will re sul t from th e ongoi ng nitrate
Tota l Maximum Dail y l oad (TM DL ) study. Th e TMDL was completed by th e Water Qual ity Control Divisi o n
ea rli er rhis ye ar and was approved by th e EPA as of Ju ne 4, 200 4.
A pre-des ign projec t was completed to identi fy spec ifi c plant co mponent s nee ded to ex pand th e faci lity to
th e recomm ended ca pacity and incl ud e de-nitrifi cati r,n (n itrate removal) sys tems. Th e pre-design proj ect
also in cl uded th e identifi cation of th e reg ul ato ry work required to obtain approva l fr o m th e Wat er Quality
Con trol D'vis io n an d th e D enver Reg ional Council of Governm ents, th e 20B pla nn ing agen cy in th e Denve r
ar ea. As part o f th e pre-des ign proj ec t, a preli min ary estimat e of projec t costs was deve loped.
The find ings and recommendations of th e Pr e-design Proj ect have bee n co m pleted alon g with th e
engineeri n g design stage of th e Ph ase 2 ;.,rojecl. Th e final drawings an d spe cifica tions ha ve b een made
avai lable to prequali fied gen era l co ntrac tors and subcontracto rs in orde r to obtain co mpetitive b ids for th e
project. Fin al bids were received by th e Ci ty on May 25 , 2004.
T11e EPA n otifi ed th e City in a l ett er dated May 12, 2004 th at th e Li tt leton/En glewood Was tewater
Tr ea tm ent Pl an t Pha se 2 Projec t was awa rd ed a $1,000,000 gran t in 2004. The proceeds to th e City are
$964,300. Th e gra nt funds are part of th e EPA's Fis cal Yea r 2004 Appropria ti ons Act. Th e City m ay b e
eli gible fo r additiona l STAG special projec t grants in subseq uent yea rs . An applica ti on has been prepared
for an Intergovernm ental Agreement (Application for Federa l Assis tance) for the iss uance of said gran t
am oun t of $1 ,000,000. The grant funds req uire a 45 % local m atch in ex p en ditures for th e project. Th e
grant fun ds w ill be equall y divided for Ph ase 2 capi tal expens es for the City of Er,glewood and the City of
Littl eton .
FINANCIAL IMPACT
Th e cost of th e Ph ase 2 Proj ect is es timated to be $11 3,750,000, is a ca pital cost and w ill b e sp lit 50/50
with th e C ity of Littl eto n. Funds to b egin the proj ec t are include d in the 2004 b udget. Grant funds w ill b e
us ed to pay fo r a portion of th e total cap ital ex p enditures . Th e required matchi ng fu nds are ava il able from
th e Sewer Res erv e Account proj ect expenditures and/or portions of the loa n p roceeds.
